    I am filing a complaint against Fischer Homes for mold contamination, financial losses, and health issues due to faulty HVAC installation at 7990 *************, ***********, **. Despite multiple attempts to resolve this, Fischer Homes denies responsibility ******************* 1. Oversized HVAC System A 5-ton unit was installed instead of 2.5-ton (AIRTITE HVAC load calculation).This caused short cycling, excess moisture, and mold growth.2. Unsealed Ductwork Improper sealing allowed mold spores to spread through the home.3. Improper Bathroom Ventilation The master bath exhaust fan was outside the shower, failing to remove moisture.This led to black mold growth, affecting the master bedroom and closet.4. Master Bedroom Contamination Mold damaged carpet, furnishings, and bedframe, requiring costly remediation.5. Fire Hazard An HVAC manual found inside the plenum posed a fire risk by blocking airflow.6. Health Impacts Mold exposure caused eczema, respiratory issues, and fatigue.Medical expenses: $58,310.Attempts to Resolve Fischer Homes was notified before HVAC replacement.Four HVAC companies confirmed improper installation and mold growth.Mold remediation company confirmed contamination and performed remediation.A mold detection dog signaled mold at every HVAC register.Fischer Homes falsely claims HVAC replacement prevented them from verifying defects, despite prior complaints.Summary of Costs A.     I am writing to bring to your attention a critical issue concerning the plumbing system in my home, I have experienced numerous water leaks that have flooded my basement multiple times and are now affecting the main level of my home. Hallway Plumbing, the contractor hired by Fischer Homes, has had to cut open the walls on the main level to locate the latest leak (See picture attached). Based on a recent report from *********************, the multiple instances of water leaks are attributed to excessive pressure in the plumbing system, which uses PureLink *** pipes supplied to Hallway Plumbing by HeatLink.I have attached a warranty report from *********************, which highlights critical findings related to the plumbing system installed in my home. The report indicates that the system pressure consistently exceeds the maximum operating limit of 80 psi, with a peak pressure recorded at ***** psi. It also notes that a sample of the 3/4" PureLink *** Blue pipe exhibited brittle fractures, likely due to this excessive pressure.The report outlines several recommendations to address these issues:1. Pressure Reduction: It is essential to install a pressure reducing valve (PRV), or if one is already in place, to ensure it is set to 65 psi or lower.2. Expansion Tank Installation: A suitably sized expansion tank must be installed to manage pressure spikes caused by the water heater, preventing damage to the plumbing system.3. Pipe Replacement: Given the damage likely sustained by the *** hot water recirculation system, it may be necessary to replace the affected pipework.4. Compliance with Plumbing Codes (UPC): which specify a maximum water pressure of 80 ****** prevent further damage and ensure compliance with applicable plumbing codes, I request that Fischer Homes take immediate action to address these issues: Review and implement the necessary modifications as outlined in the attached report to ensure our house gets put back together and livable again.

    I closed on a new Fischer home in February 2023.Fischer has a pre-closing inspection, ninety day inspection/report and one year inspection/ report to provide Fischer with items needing correction.There are three items still requiring correction from all three reports.Additionally, in the main bath the curb was installed backwards, so water drained out onto the floor instead of into the shower.Fischer had the bath installer come out once to repair this, but now after a couple months its draining into the wall.The three items remaining from the inspection/reports are the garage door leaks, the front porch has water pouring off it when it rains, and the back yard is poorly graded, which directs water to run through the middle of the yard.Fischer refuses to recognize or do anything about any of these issues.I've spoken to the two local Fischer Superintendents, ***** ********, and *****, the Warranty Manager ***** ********, the Superintendent's boss ******** Penthan, and Chandlers boss **** ********.All refuse to do anything, though one Superintendent, ***** ********, did promise to replace the garage door, which he now denys.I went to the county to inquire about the water drainage in the backyard. Paulding county said any water drainage has to run to the front or back along property lines, and provided me with a plot map showing no water through the middle of the yard.Water cannot run through the middle of the property, I informed Fischer of this and they ignored **** would like Fischer to repair these four items, or reimburse me for the expense of having them done by an outside vendor, which I haven't looked into as of yet.

The garage door drips rainwater from between hinge panels when in the opening mode just like all garage doors do. When the Field Manager said a new door will do the same, it was perceived by the customer that he was going to receive a new door. There was a diverter installed on the area that was allowing rainwater to hit the front porch.The bath matter was also serviced and complete.

    I am rejecting this response because I had the home inspected by an outside inspector, Property Inspectors of ******* that confirmed the problems that  Fischer refuses to correct.
    See attachments.
    Those being the following:
    Garage door leaks. This is my 9th home and I have never had this as an issue before.
    Those homes being in **, (5 )NE, (1) NH (2) GA (1),  all having considerably worse weather than this Fischer home with the exception of my previous home in **, .
    Additionally, I have spoken to my neighbors that use their garage for furniture storage, and none of them have the issues I have with water leaking into the garage. 
    Fischer sent me an email from the door manufacturer stating they can't guarantee a door in the state of *******. That isn't releveant as the home is in ***
    ***** ******** the site Manager committed to me in a conversation that he would replace the garage door.
    This conversation took place at my home with *****, ***** ( don't know his last name ) another Fischer construction employee and I.
    When I asked Fischer about this conversation, they replied ***** doesn't remember. I then asked if they contacted ***** and they said no.
    Rain water not draining properly at front roof and gutter system.
    Water pours down at this area, during rain storms. It's so bad it will fill a five gallon bucket.
    Fischer agreed there is an issue, and was going to install a diverter.
    Instead of doing as promised,they had a metal plate installed that we never discussed, when I wasn't home.
    I suggested to Fischer a correction for the problem, by shortening the gutter to catch rain coming off the roof, they refused at it would change the appearance of the home.
    Then they have the metal plate installed that wasn't discussed, and changes the appearance of the house.

    Back and side yard graded poorly.
    Negative grading on the left side of the home is leading water to the foundation wall.
    The backyard is poorly graded and not to Paulding County specifications'.
    No where is the yard level as it rolls up and down.
    The middle of the backyard is a gully that rainwater flows through.
    I went to the ****************** to inquire if this gully is allowed and the answer is any rain water has to drain along property lines each side of the house, to either the front or back of the property. Water cannot run through the middle of the property.
    When doing our inspection with ***** ********, I pointed tout his problem out,  he recognized it but  said he couldn't correct this as he would have to fix all other lots.
    See attached diagrams showing lot with no easements for water.

    The last item which was not in my original complaint is the master bath shower curb is slanted towards the outside of the shower which means water leaks outside the shower.
    Fischer did have this corrected once by the same installer that did the tile when the house was built.
    Now after a couple months the problem is back, as the curb slants towards the outside of the shower, and water leaks onto the floor and inside the walls left and right.
    I had the shower repaired at a cost of just over $2,000 which I want to be reimbursed by Fischer.
    I can provide receipts of this work if desired.

    I am rejecting this response because Fischer is still not accepting responsibility for poor workmanship, and refuses to fulfill their warranty obligations. When talking with Fischer representatives they to a person have the same response. That being, this problem really isn't a problem as I have the same condition on my home. I would think they would be a little more creative. In any event, it's more than frustrating to try and get Fischer to respond to valid issues.

    They mention a drainage easement when there isn't one, as the plot diagram has no easement, which I confirmed with the county. The issue isn't standing water, it's the river running through my backyard. The garage door leaks, as I have shown to numerous Fischer employees. As I mentioned I've spoken to many of my neighbors about this and none of them have a garage door that leaks water into the garage and have safely stored furniture and other items with no water falling on them.

    ***** ******** did commitment to installing a new garage door in a conversation with one of his associates ( ***** ) and I .Fischer is not being truthful about this and there was no misconception of what Fischer was going to do to correct this issue. Fischer refuses to ask ***** what was discussed which tells the story. The "diverter" on the front of the house was not discussed with me before Fischer having this installed and did not correct the problem. Question for Fischer, why did you have someone come to my home and work on it without discussing it first with me?  The bath matter was serviced and the results were a disaster. The curb was installed leaning to the outside of the shower, the membrane at the front of the curb was short so water leaked behind the corners and in the front of the curb. This resulted in us having to remove and replace the curb, tile, and moldings left and right. Fischer did have it looked at on my original complaint,  but the "fix " was worse than the problem. another example of Fischer's poor workmanship. The attached pictures show the damage and mold that grew due to the water leaking. Tis poor workmanship cost me over $2,000 which I want Fischer to reimburse me.

    I am rejecting this response because Fischer sill refuses to recognize and correct the remaining issues.The main bathroom shower cost me over $2000 to be redone, as Fischers contractor did a poor job when the first shower curb was installed backwards, and again when the same contractor attempted to correct the problem only to make it worse. There was mold behind the tiles and on the wall next to the shower, which was shown in the pictures I sent in my last response.

    Fischer states there was confusion as to the garage door being replaced. There is no confusion as ***** Blackmon committed to replacing the garage door, and as I have repeatedly said in previous responses, another Fischer construction employee named ***** was present when David  committed to replacing the door.The only confusion is Fischers refusing to admit this and contact ***** to see what he says.

    The piece of tin Fischer put on my home is an eye sore and does not prevent water from running down. Additionally, this was done without my consent, and no prior conversation as what they intended to do.

    The backyard is a disaster, water as per the county cannot run through the middle of the yard.

    Fischer says there is no standing water after 48 hours, which is true. The issue is and remains, water running through the middle of the yard. Fischer states there is an easement which is a lie. There is no easement in the front or back yard, as shown in the county diagram I have previously sent, that I was provided to me by Paulding county.

    I am rejecting this response because: Fischer continues to not live up to its obligation to repair my home. I went to the Fischer home owner portal and there are no documents.The sample for resolving complaints mentions mediation or arbitration. I would be ok with this but the form doesn't explain how to proceed. Additionally, I would be open to comprimising with Fischer to resolve the two most serious items and ignoring the other two. The two most important are corecting the water problem in the backyard and reimbursement of the $2,000 I spent to correct the shower leak in the main bath due to poor workmanship.

    Transaction Date: March 20th, 2024 So Far: $41445 has been paid to business in good ***** They are suppose to be a semi custom builder of homes in the *********, ******* areas, That I hire to build me my retirement home. Nature of dispute: Fischer Homes is in the business of trapping buyers in contracts that are totally unreasonable and nonflexible. The smallest request was denied and no work has been started. I am afraid that this is only the beginning of their bullying the buyer. Once the work starts we will be forced to accept anything that does not meet our approval. They have threated to keep all my money if I chose to back out at the point, which I don't want to do, but I am very scared of the process.At this point they have not considered my position at all, See details in files attached.

    Fischer Homes has incurred costs of more than $15,000.00 in permits and other internal expenses at the time our customer voiced her displeasure and notice of cancellation on April 25, 2024.  

    Here is a summarized timeline.

    > Agreement Written: 2/26/24. 
    > Loan Approval: 3/18/24.
    > Selections & Deposit: 3/18/24 
    > Permits submitted: 4/2/24. 
    > Permits Approved: 4/15/24.

    > Customer sent an email to our legal department, ordering to stop work: 4/25/24.

    Fischer Homes is actually entitled to $15,000.00 in damages but reduced the amount to $8,000.00.

    We met with our customers virtually on Tuesday April 30th, giving extra concession in the form of lender closing cost to help with their "home to sell"concerns.  They informed us the next day they are canceling (without ever speaking to our lender about the additional closing cost).  

    Fischer Homes has shared the timelines, and the reasons we are retaining a portion of the deposit with our customer as well.

    We have attached the terms of the contract between Fischer Homes and our customer. A business cannot absorb all the costs that are associated with starting the process of building a new home. We understand she is upset, but signing a contract to build a home and then deciding to cancel two months after weve fully set the wheels in motion is why were maintaining a portion of her deposit. Fischer Homes should not bear the burden of the cost incurred; we were fulfilling our contractual obligation at the time of the cancellation.

    I am rejecting this response because:  Customer was not notified that any work was being done on the lots. At this point, I was an unsatisfied customer, because of ********************** unreasonable policy and bullying tactics. I requested that no work started because of the poor customer service I received. Knowing that a customer is not satisfy, one would think to ask the customer if they should proceed with permits, not take upon themselves to trapped the customer and try to take their money. I am very upset. I do not have this money to give away. Please help.

    Im trying to seek quick resolution to a dispute. As a customer, I reached out to ********************** to help address a sewer backup which caused extensive damage within my home at the beginning of the month. The backup was due to poor design and products during the build. Through email communications, the representative assured me that Fischer would reimburse me for the cost to fix my pipe. I find it very discourteous and misleading that after the repairs had been complete, the representatives emails me to say that Fischer will not honor their commitment to reimburse me the cost for the aforementioned fix to the pipe. My actions and commitment to the plumbing company for the fix was solely predicated on this email thread.*** reached out to many individuals at ****** and received zero responses.I have emails and text messages as proof of communication. Its been a few weeks and no ones provided a response or even acknowledge receipt of the email, thats showing a lack of respect and care.

The Customer Relations team provided me with an email in 2020 regarding a different matter and a service request from 2016 that was related to a backup in the sewer system. The noted action was the plumbing trade partner removed paper towels from the homes sewer system that caused the backup on 02/12/2016.

    We bought a home in Crescent landing subdivision in ******* - our unit is **** lantana village way. There has been lots of issues since we bought this home. The quality is really bad or to say worst. From day 1, we see serious issues with framing and flooring. There's been squeaky and noisy floors everywhere due to poor framing structure and and even they exist after the initial repairs made by builder. This itself shows their poor quality of work and they never cared about the customer satisfaction. The floors has been wobbling and getting pressed and they don't want to repair that even.Am thinking how can this builder is still allowed in housing market as he is not at all following the proper quality and have no work ethics and zero customer satisfaction. We are all going through all the mental stress due to these unexpected issues with the brand new home (it's not even a year we closed this). Not sure who can help us here.

    Thank you for allowing Fischer Homes to respond to this matter. We have researched this and found that the author of the complaint is not the original customer we contracted to build the home for. Our Construction & Purchase Agreement specifically states that the one-year limited warranty is provided to the original customer and does not transfer to a subsequent purchaser. However, as a courtesy to this homeowner and RWC **** Fischer Homes will inspect the warranty request on the flooring issue. Our ************* Manager will contact the homeowner and set up an appointment to review this very soon. 

    Fischer Homes disagrees with the accusations that this homeowner made in the their submission to the BBB. Fischer Homes has a very high percentage of customers that would recommend us to their family and friends. This comes from surveys that are completed at the Closing, and both the Initial and Final Warranty periods. We're very passionate about our customer satisfaction and our referrals from our contractual customers.

    Our homes are quality built by our trade partners and our Field Managers are onsite to assist with every phase of the process.

    Hi, **** from Fischer homes called me and said the floor can be repaired out of warranty (not sure it's ************) as it's new but he needs to check with his manager. He said he'll update me today or by monday. 

    We are not even inviting guests to our house out of embarrassment due to all these issues in a new home where Fischer is saying the quality will be of topnotch. Requesting fischer to atleast repair the floor issues on the main floor as it's buckling up very badly in most areas in the main floor. Even we can have floor inspected either Fischer or 3rd party people to analyze it and get the report what can be done.

    Hope fischer homes being a reputed builder will help us and get us out of this mental stress. Thanks in advance

    Thanks so much Fischer homes for your response and attention in this matter.. **** contacted me earlier and he tried to repair the squeaky floors by bringing in the original framing guys but it made the problem more worse post repair. The sounds are more frequent now and they hit hard as that the ceiling in main floor got full nails and light stopped working. **** examined all these when he visited our home last week and said he'll bring in the correct framers to identify the root cause of squeaky sounds and repair the nail pops and electrical light as it was impacted during ************.

    Today, **** from Fischer homes visited along with other manager to assess the repair area. They accepted there is something wrong with wood boards and floor joists in 2nd floor as the sounds are too much when we are even walking normally. There is a flaw in the way the framing and joists work has been done (it's structural work and design flaw, I can get it inspected by 3rd party and submit the report and even workers from Fischer homes agreed it's not good). But unfortunately even when they agreed it's not good and has to be repaired, they said they have to check something and can't provide any assurance to repair these. Earlier the ************** from Fischer homes came for repair and post repair, it makes more worse as squeakiness and sounds increased and damaged the first floor ceiling with nail pops and **** said they will get repair the damage the framing guys did. Now, they are saying a total different thing. 

    I thought Fischer homes as a premium and reputed builder will be consistent in their sayings and the work quality but the impression is totally gone now. Can you please kindly help us here.

    We hoped you will help us in these dire kind of situations and hoping you will resolve this (atleast issues with structural framing and floor joists).

    We discovered we have a massive hole under our driveway. We called Fischer homes who directed us to their warranty company. The warranty company tells us they will not cover it even though we have part of our 10 year structural warranty and this would qualify as structural as our driveway is sinking.

    Please see the attached document from the ************ booklet that states what is not covered under their warranty. On page (4) item number (17) clearly states that driveways are excluded from coverage.

    Again, Fischer Homes does not have a warranty obligation in this matter.
