I bought a 10 pack of classes on 7/28 which had a 6 month expiration period, so they didnt expire until 1/28/2024. However the business permanently closed on 10/14 without any prior warning. I still have 7 credits that I had not used yet. I would like to be refunded for these credits by YogaSix corporate (this is a chain of yoga studios). I would like to be refunded for my 7 unused classes.

On 1/3 I tried a "one month of unlimited yoga for $23" offer at YogaSix in midtown. There was a contract that they did not talk me through, and they required that I sign at the bottom to attend my first class. I saw a charge of $136 on my credit card on 1/23, so I called and emailed asking that any ongoing membership be cancelled. In reading the contract I signed, it says that if my initial term is one month or less (which it was), I must give at least 30 days written notice of cancellation. I signed the contract on 1/3 and my membership began on that date, and the reoccurring charge of $136 happened on 1/23 (20 days later). That was charged within 30 days, so I still should have had 10 additional days to let them know that I did not want to continue with a membership. I let them know via phone and email on 1/23 that I wanted to cancel, and again on 1/25. The first response I received was today (2/2), stating that "Because that intro deal is attached to a month of classes, I will not be able to refund the one month payment from 1/23." It seems exploitive to allow a charge of $136 to go through on 1/23 when I requested that it be cancelled on the same day (inside the 30 day window). Or if they really are unable to edit their system in any way to STOP an exploitive charge or issue a refund, they could have at least altered the month of classes to which the intro deal was attached to be 4 or 8 classes. It seems unlikely that their system really cannot ever issue a refund. I tried to contact ************ times (by email and phone on 1/23 and by email and phone on 1/25). I would like them to abide by their contract and honor my request to cancel any membership that was created by trying the one month of unlimited yoga for $23.

As stated in the contract at the top in bold letters, the term of the special we offered was that customers received the first 20 days of their membership for $23. Following the 20 days, your 1st month begins at regular price.

That special was a sale on our Unlimited membership and could not be use independent of at least 1 months payment of regular membership dues. This is all stated in the agreement.

Our 30 day cancellation policy means that we require notice of cancellation ****************************************************** other words, memberships reach their final expiration date 30 days after notice is received. ****************** did not send the required written notice of cancellation until the day after her payment was due. However, we did ****************** a favor by deciding to override our 30 day cancellation policy, only holding her responsible for the payment that was due the day before she requested to cancel.

Additionally, the final payment we held ****************** responsible for ($136 on 1/23) is still showing as past due in our system. We have only received one payment of $23 in membership dues from *******************

I have attached a pdf showing the payments due from ****************** according to our 30 day cancellation policy, and which payments have been paid.
