      Today, **********, I spoke with a leasing agent from *********** Apartments, **** *********** ****** ********** ** ****** I then completed the online rental application and authorized the $50.00 application fee for a credit card charge. Shortly thereafter, I received an email confirming the $50.00 application fee charge that I authorized. I then get another email with the subject line: Your Rental Application - Earnest Money Payment Confirmation in the amount of $300.00. The problem is, I did not authorize payment for $300.00. Another problem is this is fraud because I did not authorize it and this was never discussed with me; because I would have walked away and found somewhere else to rent an apartment. I did not sign the lease agreement because of the leasing agent's actions of fraud. Notice in the attached lease summary there is no mention of earnest money free because it's a fraudulent and hidden fee that should have never been charged to my credit card since I didn't authorize it, it was a fee that was hidden from me, and it's charged before signing a lease.

      Thank you for bringing this complaint to our attention.  Our online application process does indicate that an applicant must agree to pay the $50 application fee to submit an application.  It further states that "if screening is approved, then we will charge an additional $300.00 on the payment account used to pay the fees."  This is done immediately after the approval to ensure that the applicant reserves the exact unit that they desired and had applied for and removes it from the market.   I have attached screen shots of the two pages of the online process that walks the applicant through the process. Since the prosect has indicated that he no longer wants the unit, we have removed his hold on this unit and a $300 refund is in process.

      I am rejecting this response and at the same time accepting the business action of refunding $300.00, because: When I initially contacted the leasing agent, I asked several questions. At no time during our conversation did the leasing agent mention or explain a "Ernest Money deposit". Furthermore, upon receiving the lease agreement, that I ready carefully, an "Ernest Money deposit clause" wasn't in the lease agreement. While I am satisfied that the $300.00 is being refunded, I am not satisfied with the leasing agent attempting to deflect responsibility and avoid the fact that he attempted to defraud me.
