These people are constantly calling and leaving messages. I am a senior citizen and dont answer any calls that are people or numbers I dont know. I have two credit card accounts and an auto loan. I have paid these on time and have never missed a payment in years and years. I am not in a bad debt situation with anybody and I want them to quit calling my number. I have had this phone for several years and I think the lady that had this number before me was not great with her finances. I think they are after her and not me.Business Response

I get several calls a day from Capital Recovery, calling me by a different last name I have never used, claiming I have a debt that was transferred to them. I have no unpaid debt. The number they provide in voicemails does not work, and if I pick up it says to press 1 to speak to someone and nothing happens. I am beyond desperate to stop these calls, and do not even understand the point unless it's meant purely to blow up my phone and harrass me. The Captial Recovery is calling to collect a debt that was settled with another collection agency (via settlement not full amount). I also received a letter stating that this item has been closed. This company is constantly calling me and leaving messages. I pressed one to talk to someone and they hung up on me. Dont call me back. I am unable to locate any information in my system related to this person or any of the contact information included in the complaint. More information is needed regarding the alleged communication the consumer received including:
1. the phone number the calls received came from
2. when we place calls, we leave messages with an account number. We need that number as well please.
Without the above information we cannot prove that it's us contacting the consumer. There are many companies with similar names as us, and we are commonly confused with one of them.

I was contacted by email stating that I owe $20 for service and $20 for another date of service. *** contacted them and prove to them that I paid on those days of service that theyre billing me for. Now I get another email stating that it was for another date, but they refused to give me the date. And now Im getting another email stating that I owe them money. I included the proof of payment on the dates they are claiming I owe for.Business Response

The Consumer, *********************** reached out to our team on 1/3/24 with proof of payments. The problem is this consumer is a recurring patient at this medical facility in question. She has many dates of service, some with accrued balances over time. A common practice of our client is to post patient payments to dates of service not already sent to collections. Once a balance is in collections its our responsibility to collect it. The proof of payment she provided was posted by our client to other dates of service that were due per their policy and common practice. The payments made were posted to dates of service 12/13/23 and 12/18/23 therefore making dates of service 12/22/22 and 5/2/23 (sent to collections on 11/14/2023) still due. We can request that the client move the funds, but that means $40 is still due, just on different dates now. So the balance does not change until she makes payment. We can Cease & Desist this account; however, the balance owed to the creditor still remains due, in which they will require payment before she is ever treated again. No credit history has been affected with any credit bureaus.
Additionally, This consumer was responded to and informed of this in a timely manner by my team, and she still has a valid balance of $40. We have no control over how our client posts payments. She entered a treatment plan and agreed to certain financial responsibility requirements with the creditor. Our team responded to her concerns immediately. Proof attached.

I have proof of payment for every date I have had any service. So again I am asking for the actual dates of service so I can prove my payments were made. I pay the moment I check in for my appointments so again I do not see how I owe the money they are claiming. I have asked the ************** and they show a $0 balance. I am asking for the proof that I owe them. If it in-fact rolls over from a previous date then they should be able to provide the dates it started on.Business Response

Attached is the statement from the clinic proving the balance is owed. As far as where all her payments have been posted, she will have to take that up with the clinic and their billing office as we are only authorized to speak on the collections dates. She has been a long time patient at the clinic and I see several notes of payment transfers on her account. They will have to track it all to the beginning for her as she never made any payments to us, so we are unable to track that. The Clinic's billing office can be reached at ************. furthermore, being that we don't credit report and that was one of the concerns here, we are closing this account and returning to the client. I do see she has an appt on Feb 14th in which all balances should be paid prior to her being seen, as this is the clinic's policy. I received an email from Capital Recovery Corporation on 5/22/2023 saying I owe $59.00 to *******. I called Capital Recovery at ************. I talked to ***** who could not explain the email. I called back and talked to ****** who laughed and hung up when I asked him about the bill.Business Response

We have already responded to the Originator of the complaint, who is not a consumer, this is a B2B account for DF *********** LLC.
The call recordings revealed that our representatives were professional and accommodating up to the point where he was condescending and rude, causing them to end the call because we do not tolerate verbal abuse. If he had been patient and listened, as he expected us to, we could have easily advised on what the bill was for. We pride ourselves in our level of customer service.We are a ******************** accredited business, ******************************* members and ** ********************** members. We train our staff to be professional and courteous to all callers and not to accept poor behavior by ending the calls when someone is displaying combative behavior. We realize that we are debt collectors, and we understand the frustration and shock that *** arise when someone learns of a collections account; however, we are still human beings and deserve respect.
The debtor was sent to collections by Shirtsy for an unpaid fulfilled order. The order contained 3 custom mugs (3 pack). The order was placed under company name DF *********** LLC and the person who placed the order was *************************. It was placed on 11/19/22 and shipped on 12/1/22. Tracking number ************. The invoice is attached.

Her analysis of the calls is not objective and are biased.

We dont have to agree on an outcome but the debtor has what he requested and had he allowed my representatives to get a word in without telling them to be quiet and dont talk then they could have fulfilled their job duties and obligation to the debtors request.
