    On 6/27/2023 I accompanied my wife to her eye appointment. The exam was great and they were initially upfront in the cost of testing. At checkout they instated an add on fee for contact lenses exam of $100. We argued the fee and said that it is unfair and asked for her prescription. The officer ********* don't recall her name) came to the window and stated that according to ** law they had to charge a separate fee to give a contact prescription. I looked up the law (OCGA 31-12-12) and nowhere in this law did it contain this language. It did however refer to the Fairness to contact lens consumers act which appears to have been violated. I questioned the language of the contract because it acknowledges receiving a final prescription, which we did not have. I asked what if she does not sign and pay the $100? The ******* replied that she will not get her prescription and would have to see another eye doctor. The contract was even questionable! IT was on a laminated piece of paper and you could faintly see the last person that had signed its name, which is a HIPA violation as being treated with contact lenses is protected medical information. I requested a paper copy for her to sign and was refused. The officer ******* stated that we do not use paper forms! She said that they scan it into the chart and then wipe it off. I told her that this was not a valid electronic capture device required to insert things into the chart. My wife reluctantly signed the sketchy contract under duress because she had used her eye visit for the year provided by insurance. The insurance was filed immediately when we left the office as opposed to the normal couple of weeks.

    To Whom It May ***************** received a complaint regarding our Contact Lens Fitting and Evaluation. Our office abides by the Georgia Law O.C.G.A 31-12-12 Section b) All contact lenses used in the determination of a contact lens prescription are considered to be diagnostic lenses. After the diagnostic period and the contact lenses have been adequately fitted and the patient released from immediate follow-up care by persons licensed and regulated by Chapter 29, 30, or 34 of Title 43, the prescribing optometrist or ophthalmologist shall, upon the request of the patient, at no cost, provide a prescription in writing for replacement contact lenses. As soon as the patient is finalized and the patient is released from immediate follow up care, they are given a copy of the final contact lens prescription by Cherokee Eye Group. Contact Lens Fitting and Evaluations are an additional service provided to patients that are wearing contacts. Therefore it is an additional fee for service charge that the patient is expected to pay on the date the service begins.  Our forms clearly states that the patient will incur no additional contact lens visit charges for the designated fitting period and the office procedures for being evaluated for contact lenses and follow up needs. This form is properly scanned and securely saved in the patient's chart as is any other document for our patient's charts. Unfortunately, the complaint has been filed for a person that is not on record for Cherokee Eye Group. If the person in which they are referring to, has any further questions or concerns we would be obliged to help in any way. As for now we do not have a current Medical Records Release on file that would allow any further explanation via the Better Business Bureau.
