    We bought a newly built home in February 2023. There were windows that were broken, screens that were ripped or and missing, paint is bulking up on the inside of the house, concrete in the driveway is cracking, the sod was not installed in the yard and the builder has a contract with us. I have sent a certified letter, texted him and called him and he has not yet honored his contract. He does not respond and he has told his employee not to come over or respond back to me. I thought if we have a contract that he and I have to honor it, but Mr. ******************** is not honoring his end of the contract. Instead he has cut all communications. I was really looking forward to retirement here but *** has turned this whole experience into a nightmare. We paid $276,000.00 for this house and approximately $213,000.00 up front in cash.

    In response to the letter sent by ****************, She has been told on multiple occasions that the window manufacturer that was used in her house is no longer in business and we have had a difficult time located a bottom window sash that will work in her windows. However, we are working on getting the broken glass replaced and will have that done soon.

    As to window screens, no where in ******************** contract does it say that windows screens are included in the purchase of her house. If one of my guys installed a screen by mistake and that screen is torn we do not have a contract with **************** for installing window screens nor has she paid for window screen.

    In regards to any interior paint, we did 3 punch lists for ****************.  All of which we touched up paint. My last visit to the house, the paint looked 100% complete and a quality job was done. I have not received any pictures of what she has referred to has "bulking". However like all other builders in our area, we do not do any interior paint touch after occupancy has been made at the residence and furniture has been installed.

    If the concrete driveway has a crack, this is very common in any flat work concrete. Concrete however carries no warranty against cracking in the state of **. As far as sod in the yard, the area in the front that we had originally planned to put sod, **************** asked for a extended concrete parking area in the front yard. We did this concrete work at no additional charge in leu of sod being install in this area. All other areas of the yard were seeded and straws as per what is required in my contract and local building code.

    I am rejecting this response because:
    I have emails from *** ******************** confirming to finish the work.  He never said ************** was out of business, he kept saying that the windows were on back order.  When I did walk through of the house blue tape was put on broken windows, torn screens and I was told missing screens would be replaced as well at walk through.  Realtor told me they had been having a lot of problems with the concrete and they were working on a solution for that.  The paint is bulking up in the kitchen between the pantry and laundry room doors.  As for the sod it had nothing to do with the parking pad. And the realtor confirmed to me that the yard would have sod installed.  As for me not paying for whatever he says wasnt paid for is totally incorrect.  We paid $206,000.00 in cash for this house and financed the rest.  We most certainly paid for this house.  I can assure you that Mr. ******************** has not given us anything and he needs to finish our home.  I have very many emails to him and a few replies.  Can we have an in person meeting with the BBB, *** ******************** and myself.  Thank you.
