As a 78 year old I searched your website for a contractor to add some room to my home. The young man who came to my home named ***** ******* was a nice young man. After chatting I asked him to prepare a proposal for the project with an estimate. The proposal did not include the scope of the work or any dimensions. With the help of my grandson on the drawings a decision was made on the project. I was asked to get the building permit from my County. I needed the contractor's license for the permit form and he told me I didn't need it. This is what brought things to a halt. He flat out did not want to pull the permits for the job. He made offers to have a ***** do it for him. I did check his license which belonged to someone else who he claimed was a silent partner. Now, I have asked him to put the job on hold which made him very angry. He says he is going to bill me for all the time he spent working on the estimate even though he offered free estimates. Please help!

This isn't true. I did ask her too see if she could get a home owners permit too make things easier and cheaper on her send we were already cutting things out trying too meet her budget. Once I was found out Paulding county didn't do home owners permits I told her that k would pull them please see attached photos for your proof. Iv been working on this for her for over a month for her and have hours tied up in this for her and planned everything for doing her job because she has already signed contract with me for the job. He is a silent partner what's the issue with that ? She asked for a license I gave it too her. Now she's blowing all this up. As for her grandson He didn't come up with the dimensions he just reworked mine too his wants. Yes I'm billing her for the wasted time she has caused iv got so much invested in this for her and I need too be paid for my work if she's not going too let me go the job.

I am rejecting this response as I would like to provide further clarification based on the contract and my experience.

While we did sign a contract, it is important to note that the contract is ambiguous in several areas, particularly regarding the buyout clause. The contract states that either party may "buy out" of the agreement for "&500" if no work has been started. The use of "&500" instead of specifying a clear dollar amount raises questions about the enforceability of this clause.

When I raised concerns about the permits and licensing and requested to put the project on hold, Mr. ******* became defensive and angry. He insisted that I apply for a homeowners permit, despite my understanding that such permits are generally intended for homeowners doing their own work. This caused further hesitation on my part, especially after I could not verify his contractors license through the official state website.

Additionally, there was no mention of any billable work or fees related to the estimate or planning stages until this disagreement arose. The contract made no mention of charging for the estimate or preparation work, which Mr. ******* originally offered for free.

The contract has now been officially terminated as per the buyout clause, but the unreasonable demand for payment of 25 hours of project planning at $50 per hourwhich was never agreed uponwill not be entertained. As per my email to Mr. ******** we have offered the ambiguous buyout amount of &500, in this case assumed to mean dollars, to properly terminate this contract. Payment has been made in full.

There will be no further payments, and any additional demands for payment will not be entertained or acknowledged, as there was nothing pre-agreed, either verbal or written, nor anything stated in the estimate or contract regarding any costs before work started.

Lastly, Mr. ******* decision to repeatedly send demands for payment that he knows are not legally justified, particularly to someone in my position as a 78-year-old woman, is both deeply unprofessional and unethical.

Thank you for your time in reviewing this matter.

    Sincerely,

    **** ******

Here is proof that I never insisted on her, pulling a homeowners permit after she told me that the county did not offer that I tried to tell her that was on me as a contractor and she could not understand the process I never was and got mad with her I told her multiple times that was not trying to be rude or sound any kind of way I just didnt understand her reasoning. I already had contractors, electricians plumbers and everything lined up for her for her to get back out the day before were supposed to start Why she has a vendetta against me I have no idea. If I was such a bad contractor then why did she ever sign a contract with me for $100,000 to do her home if there was so many bad things in my contractor if there was holes or questioning my estimates, why did she ever sign a contract, especially that amount of money I have five star reviews because I always go above and beyond customers treat her differently than any of the other ones .
