    In 1999, we needed a Termite letter. Bought a lifetime termite warranty 850$ with annual premiums of 183 for as long as I paid the amount and was the owner. Recieved a bill that is 50 more. I call an talked to **** the owner. He said he is speading the increase in his insurance costs accross all customers regardless of what was provided in the past. He would not accept continuing the 183 warranty, so in like of his breach of contract, I would like a refund for all monies paid.     On May 27,2005, our company and the client entered into a contract and warranty agreement for termite retreatment and termite damage repair (Agreement) of the clients house.  The term of the Agreement was for the life of the house and was transferable from the client to any purchaser of the house provided proper notices to our company were given and other provisions were met.  The contract price for the Agreement was $849.00 with an annual renewal amount of $195.00. The Agreement provides that our company reserves the right to adjust the annual renewal fee.  For nineteen years, our company made no adjustments to the annual renewal fee.  In 2024, our company raised the annual renewal fee for every customer, including the client here.  Our company provided the client with the requisite notice of the increase.  The client,however, was unwilling to pay the adjusted renewal fee.  After several conversations with the client explaining the terms of the Agreement and the adjustment to the renewal fee, the client threatened to post unfavorable information about our company unless our company agreed not to increase his annual renewal fee.  Our company was unwilling to treat the client differently than all of our other customers.  The Agreement, therefore, by its terms was automatically terminated as a result of the clients failure to pay the adjusted annual renewal fee.  Our company was willing to reinstate the Agreement provided that the client paid the adjusted annual renewal fee.The client, however, refused our offer of reinstatement.

    I am rejecting this response because:  We had an agreement for many years where I paid the annual fee.   They arbatrary increased it even though they advertised it as a lifetime treatment as long as I paid the 184 each year.    It was not a threat to tell others of this treatment, if asked I will tell as many people as possible of my experience.   They should not enter into an agreement and then arbatraily decide to not honor it.   Ask them if I missed any payments or was late.   The answer will be no.    They breached the contract.   The BBB should post the negitive feedback as they should in all cases of breach.

    Unfortunately, the customer is unwilling to accept that the contract governing the terms of our companys relationship with the customer is in writing, a copy of which was provided with our original response to the customers complaint.  Our Company complied with all of the provisions of the written contract, including the right to increase the annual renewal rate.  The attachment provided by the customer demonstrates the notice provided by our company regarding the increase.  The customer refused to pay the properly increased annual renewal fee, after being given additional opportunities outside of the required timeframe; consequently, the contract and warranty was terminated as it would have been for any other of our customers on the same set of facts.
