    Date of service is 9/26/2022.Amount I paid for service $2,650.00.The service was to cut down several trees and grind and remove tree stumps in backyard, which they did. The dispute is: *********** damage a section of my driveway. *************************** was supposed to send a person he knew out to look at the damages to get an estimate, but the person never contacted me or came out. I provided an estimate to **************** of damage on 10/7/22 by text of $615.00 from a driveway concrete co. On or around 10/12/22 **************** called me and ask if I would accept $450.00 and I agreed. On 10/27/22 I text **************** to follow up about our agreement of him paying me the $450.00. He texted and stated he would have a check to me by Monday. On 11/3/22 **************** asked for my Zelle or Cash App. I responded by providing my cash app. As of 11/8/22 I have not heard or received the $450.00 from ****************.

    Greetings...Thanks for your patience. We missed the 1st message. We appreciate doing business for ******************************* 

    On 9.22.2022 ****************************** signed the agreement which states that due to the size of our equipment and weather and water accumulation Heflin Tree Service is not responsible for any concrete sidewalk driveway or grass damage. 

    I attached to docs showing the agreement and ******************* dated signature. I've only stated that and attached the docs to make sure that all the details are listed and stated on this correspondence. 

    Ms.************; stated that she neglected to read the full doc and would like some assistance with the repair. Because we value ***************** as a customer I did agree to the $450 as she stated and I also asked for her Zelle and cashapp.

    I take full responsibility for the delay in the $450 payment. It was an oversight on my part and wish she would've sent me a text message or phone call because we pride ourselves on being an honest small black business. We make every effort to also be completely transparent and communicate effectively on every aspect of our customers tree removal process. It is an honor to be chosen by ****************** to complete the project. *************** please. Accept my sincere apology im the delay to send the funds we agreed upon. It just slippedy mind. I hope that we can still do business in the future.We will get the $450 sent within the next 5 days via zelle/cashapp.

    The first contract agreement which I did read did not have anything about not being responsible for damages to concrete driveway or sidewalk.  A change in the number of trees to cut reduced the cost.  When the 2nd contract agreement was sent to me, I read the price change and did not think I would need to read the entire contract over again since the price was the only think changing.  **************** added about not being responsible for the damages to the concrete driveway in the second contract agreement without informing me.  If he had advised me that he added a term that he is not liable for certain damages, I would have read the 2nd contract over entirely and discussed this with him and probably would had not used him. **************** agreed once he saw the damages to have it repaired and since his person did not contact me or show up, he agreed to reimburse me $450.00.  I accepted his offer, but he still has not paid.
