On March 29th I hired contractor/ builder Accurate Builders to build my house in ************ **, specifically *************************************************************** My closing date was scheduled for September 29, 2023. Paid ******* money and upgrades after selecting lost and floor plan. Throughout process my realtor confirmed we were still on track to close on 29th, builder and their realtor (Heritage Oaks) confirmed still on track for 29th. On September 5th builder fraudulently told my realtor that we must terminate contract for house because there is a back order on windows that wont arrive 8-12weeks. My realtor relayed to them I am willing to wait despite the delay, however builders signed termination and has been demanding for me to sign the same. I conveyed a request of proof of back order, justification of termination without attempts to salvage deal, and for documents regarding when windows were ordered. Builders refused but insist I sign termination for contract. I refuse to sign until language in termination is changed but they refuse to Modify language to reflect cause to justify termination. As to date, the house is continued being built, and I have physical that evidence that the builder has inserted windows into my specific property and all other properties they are building since September 5th. Windows are in house and builders are still forcing me to sign termination. I presume they are attempting to sell my house to other buyers for a higher price. I have proof they fraudulently misrepresented the truth to force a termination and are currently trying to intimidate me and breach a contract without justification. Our contract permits delays however, builders do not want to reschedule closing but only want to wrongfully terminate under false pretenses. I believe it is also racially motivated.
