    "If the stable manager was on the job at the time, the barn will most likely be liable for the manager's conduct. A horse barn manager can be held liable if your horse is injured on their property if the injury was caused by their negligence, such as failing to maintain safe facilities, neglecting proper care, or ignoring known hazards, even if the horse owner signed a liability waiver; however, the specifics of liability will depend on the circumstances, local laws, and the terms of any boarding contract between the owner and the barn manager."On April 11, 2024, my foal was one week old and the barn manager felt it would be ok to turn her out for the day, without any guidance or watching her. The barn manager, I do need to mention was a raging alcoholic and everyone will contest to this matter. I received a phone call around 3:00 that my foal (Storm), was injured and could not walk. I go there and all he had done was put a frozen bag of peas on her fetlock. He never bothered to call a vet, and she needed immediate care for her injury. He chose not to do so, and actually told me she was fine. I called the vet out and he immediately told us to get her to **************************************************. We did so and that cost us over *******. Then she was sent to ***************** for surgery and a two month recovery. That bill cost us over ********* charges for her. I have attempted to ask him for help and he has blocked me from any means of reaching out to him. He needs to pay most or at the very least 75 percent of these charges. He has insurance, and as you can see, he is liable for her care.

    To begin, the owner never notified the ranch that her horse was pregnant. The ranch is not a breeding facility, nor has ever claimed to be a breeding facility. The birth of the foal was a surprise. Once the foal arrived, the manager suggested a smaller turn out space for the foal and purchased fence panels to create the space, but the owner declined the suggestion. The manager offered the owner advice on proper foal care which went ignored. The owner had turned her foal out with no incident the day prior. The owners boarding contract was for self care meaning they are responsible for the day to day upkeep of their horse. Even so, the manager was willing to turn out the foal on the day in question at the request of the owner. The manager observed the foal for several hours with no incident. Once the manager noticed the foal was injured, he brought her in and called the owner and the vet, per ranch protocol. At this time the foal was limping, but walking. The manager does not recall telling the owner the **** was fine. The manager literally carried the foal onto the horse trailer to get her to the vet safely. At no time was the manager intoxicated during this incident. The ranch is sad that the foal was injured but as the managers advice was ignored, the ranch does not see how it is liable.

    I am rejecting this response because:
    Everything the manager stated is a complete lie!!!!!!! We did not know our mare was pregnant and he knows that, as well as our vet was unaware (they will testify to this). Our foal was turned out one day for 15 minutes with complete supervision. The drunk manager told me she needed to be turned out the next day from 10:00 am until 4;00 pm. He said he would take responsibility and check on her. The last time he checked on her was at noon. I asked him why he didnt check on her until 3:00, hand to Bible he told us he forgot. Thats because he was intoxicated. When I arrived he was sitting outside intoxicated and yelled at me stating I was going to blame him. All he had done was put a bag of frozen peas on her fetlock. AND HE DROPPED HER AS HE WAS LOADING HER INTO THE TRAILER. There are several witnesses to this. AND YES, by law, he is liable. Everything he stated I denied is a complete lie and again I have witnesses. We DID NOT KNOW SHE WAS PREGNANT and neither did anyone else and he knows it. EVERYONE AND I MEAN EVERYONE KNEW HE WAS DRINKING HEAVILY EVEN AT THE ***** That is against the law. He is legally obligated to her well being. Self care means nothing more than feeding your horse, cleaning the stall and turning them out/weather permitting. *** NEVER ONE TIME OFFERED ANY CARE INSTRUCTIONS to me-EVER. All instructions for care came from my vet. 
    This man owes us money for his lack of legal obligation. If he refuses here, this issue will not go away.

    You dont how to respond because you are straight up lying.  Thats obvious. ***, this case is now being forwarded to the States Attieney General. You owe us half of the ****** weve had to spend on this poor foal because of your negligence. And you have the nerve, the downright audacity to lie about EVERYTHING. Its going to the state now.
