    We paid the contractor $23,200 .. we started the project in April and he said it would take about a month to complete. The work is still not complete as of today. All of the work that he had done so far has needed to be redone again. We’ve contacted him on numerous occasions about the work. Our shower had been leaking and he told us he would have it fixed about a month and a half ago. His company still hasn’t shown up and we haven’t heard from him. We told him on a few occasions that the floor needs to be leveled. It wasn’t leveled and now needs to be taken up again leveled and put back down again. We had a signed contract with him for the work he was supposed to do. He never fulfilled that contract to us. It has created a huge hardship on us and for us. The plumbing wasn’t done correctly also and needs to be redone again. His communication with us was very poorly done unless we contacted him. Then he wouldn’t fulfill what he said his company was going to do. He agreed to do the work for $25,000. He said that was a deal for us. Which was fine but the work wasn’t done correctly and hasn’t attempted to complete the job. We had a signed contract. We have signed contract, messages from him, and also pictures of the work that was done wrong. He told us a few times that all of the work would be done by certain dates and wasn’t completed. The last date he told us the work was going to be done by Christmas of 2023. We have given him lots of time and tried to work with him and been very flexible about getting our work done. We do know he was in an accident but he told us that wouldn’t affect getting our house done. He had the workers to finish it. Which actually he should have had our house completed before the accident happened. So that’s not a excuse to not have our house done. He had the time and workers to complete it. He worked on other jobs and not completed our house.

    The customer failed to mention in the complaint that they told me they was having there *** ***** deliver materials and it never happened.  I had to continually pick up materials for the job and that wasn't in the contract. They set me off 3 times with insulation getting sprayed, Electrical and cabinets. Let's tell the truth here cause I can't put everything on hold cause the customers can't seem to get it together about time lines ect. I was in a wreck and have a broke back and fractured neck. I was injured more working on their project when they knew I didn't have any employees. I have the text messages to prove everything and now due to ne not being able to work my company of 15 years is completely shut down. I was asked specifically by the customer to personally work on there home when they new I was injured and instructed not to pick up over 5 pounds. Up until the wreck my company worked on there home until they set me off with other subs that couldn't hold a deadline.  The customers never mentioned in the beginning and signing of the contract that my timeline I gave them would be interrupted because of there poor planning.  I had to continually leave the site to go pick up materials that they were supposed to already have on site. There *** does this for a living as well and he is the same that was supposed to have the Flooring there from the start if the job. Also the customer accused the Flooring installers of steeling and he was a ****** and I proved that he wasn't steeling. The installer refused to come back. The customer originally was supposed to replace all subfloor but didn't and just replace some. Also the customer started framing walls and did it when he was told bit to by his ***. The customer built his walls on a inlevel floor and with them being 3 inches out expect my company to perform miracles. Why isn't there a truth button on here so the customers tell the WHOLE truth? Just automatically blame the contractor about there miscommunication about materials.  There wrong walls built out of square and plimb when he was asked by his *** to not build anything else. Me asked to work personally on there home when I was hurt and I had 2 employees at the time and told me they would sue me if I didn't. Now I'm hurt worse from it. My company is closed and out of business.  I'm in recovery for 12 weeks and then my next surgery is to follow. I did a 100k job for 25k cause they wanted to nickle and dime me out if price. I'm done with this and I will secure my damages as well from working hurt and having to go pick materials up that were supposed to be there. I couldn't send all employees home cause they failed at telling me I would have to wait on the electric and insulation and materials.  None if that was in the contract and I wasn't told about it from the beginning.  The customer scheduled the installation and electric and it threw my deadline.off way off.

    I am rejecting this response because:

    First of all, we are telling the truth.  We live in ********* and GA and go back and forth. We left GA in April 2023 and expected date to come back was in November. Our *** ***** got busy with his work and wasn’t able to help us a lot. So we managed it from *********. We told Scott what was going on with ***** and the flooring. Scott said that he could pick it up. We said that would be great and gave him the information. We paid for the materials. This was all before his  accident. We asked  multiple times to make sure the floor was level before the floor was down and said he would make sure. He hired out a contractor because he said he was busy. They didn’t put any leveling compound down. We have cameras on the inside and outside of our house. We have a video of one of the workers walking out the back door instead of walking out the door by the carport with what appeared to be a full box of flooring. He stopped at the corner and looks around to see if anyone is looking. The video looked very suspicious and we sent it to Scott. He thought the same thing.  No one said they could take any of the scrap pieces with them. We have the video saved.  Since our work was not done by Christmas we have had to hire other contractors to finish the work. We had a contractor come in and remove the flooring and there wasn’t any leveling compound. We have pictures of the floor when they removed it. That contractor has since leveled out floor and reinstalled the flooring. It is a solid floor now with no soft spots and leveled. As far as materials we had all materials picked up that the workers asked for. Additional materials were needed and yes Scott picked them up and we paid for them three different times. We came back to GA again in October. We asked to meet with Scott and he asked if we could meet at his house. So we met on October 12. At that point we still didn’t even have a toilet in our house. We were scheduled to be back in GA in November and concerned because we couldn’t still stay at the house. He told us that he had been in an accident. We told him we only wanted him to Supervise at our house not do any work. ******* ** ****** *** ** **** ** **** *** ******** **** *** ****** At that time he told us that he would have our house done by then. We gave the date when we would be in GA of November 7. He said no problem! After that no workers showed up for a couple of weeks again. We have cameras at our house and neighbors checking on our house. Then all of a sudden it’s a rush job and a few days before we are here workers would come in the evening and then work till 3:00 in the morning. This was very upsetting by our neighbors because of the pounding noise. We came November  7 and it wasn’t still done. We met again.  Again he had three workers working at our house. We mentioned to Scott that we didn’t want himself working on the house, we only wanted him supervising!! If he chose to work on the house, that was his choice. Again he promised it would be done by Christmas. So we again adapted to his promises. As far as our delays the foaming was one day that was because of the foam chemical.  They worked same time as electrician worked in the house. In construction there are delays one way or another. The only other time is the end of April when we were securing our financing. That was two weeks. But bottom line is we started this back in April 2023 there was plenty of time to get this job completed. He told us it would take four weeks. There was lots of days and weeks with no workers at our house at all. We have videos and neighbors who know when they were here. It wasn’t done by Christmas. We felt we gave him many chances and almost 8 months to get the job completed. So we’ve had to move on and hire other contractors.

    Again the reason we wanted Scott there at our project was ONLY to supervise. He had workers that were working. The work that had been done was very poorly done and we have pictures of what type of work that was done and he even walked in our door and said the same thing. He had problems with his workers. He even fired someone on our front doorstep. Again we only needed his advice and supervision to oversee what was happening at our house.
