      I was in a accident last night, the police offered a tow truck and they took it to thier lot and told me to reach out to them in the morning I came to get my car the next morning to have it towed to mechanic for a damage appraisal Now their holding my car hostage and saying I can't receive my car back with out title, I went to get title, now their saying the title has to be in my name and not my business The car was transferred to my LLC but it clearly states my name on the paperwork that transfers car from my name to LLC Their trying to hold my car longer to run up a bill , that's so messed up

      *****************:Advocate for *********************** (age 84) On 12/29/2022 ************** tried to start her 2012 ************** Sonata for the 1st time since her cancer treatment, surgery, hospitalizations, & coping with side effects from Jan,2022, when she found her battery dead.Her neighbors tried to jumpstart the car as directed by the dealership.After enough jumpstarts to get the car out of the garage,the parking brake became stuck in the ON position after the last try. *************** called Statewide Wrecker in ******* to tow it to **************** in Stone Mtn. on Hey 78. I told the wrecker driver that the parking brake was stuck in the ON position. He said,"Oh, that has nothing to do with what I'm doing." She paid the tow bill over the phone to the *********** office due to difficulty with the website payment process.Not hearing from the dealership, she called on 12/30/22 to check on her car. ***********************, Service Advisor, returned her call on 12/31/22. Her battery needed ************ ***** brakes were "torn up". Parts were ordered,etc. & she picked up her car on 1/11/23. In the following days, I questioned *** about the brake damage & mentioned the tire marks in her driveway. He confirmed that the extent of brake damage could not have occurred in a sitting car, and that the damage could have been caused by the tow. Jan. 25 we went to the ******* office, but "no supervisor here". I called the ******* office twice in 30 minutes on 1/26/23 & was finally given ****'s email address. I sent him an email on 1/27/23 describing the events that occurred. When he called on 1/31/23, he said he was responding to the note left on 1/25/23. We submitted invoices, ************************* to ****, Supervisor, at the ******* location on 1/31/23. On 2/10/23, **** denied her claim. I have tried to email the *** & the owner of ******* location, but got "wrong email" notes in return. I called their HQ, & left my name & no. on 2/10/23 with ********, & have received no response to date.

      Our initial observation to this claim was both the advocate and the mechanic or advisor stated the vehicle was towed.  In fact, the vehicle was transported by the manufacturer's approved method by placing the vehicle onto a flatbed tow truck.  The vehicle was not rolling, therefore requiring the vehicle to be winched onto the flatbed tow truck.  Winching any vehicle onto the deck of a flatbed tow truck with one, all, or none of the wheels free-rolling will not cause any damage to a brake system, or any mechanical component of an automobile.  In fact, by winching a vehicle with seized brake components, as was apparently the problem in this case would be ideal since no component in that system would have been moving to cause damage, a fact that any mechanic with experience beyond an apprentice level would know.  Inoperative vehicles are winched onto flatbed tow trucks countless times a day.  A trained operator using industry standard towing methods can successfully perform this task resulting in no consequences or concerns, as illustrated by our operator's comments to the vehicle's owner on scene.

      Secondly, the replacement of the battery is in no way related to the transportation methods of this company, therefore this portion of the claim is dismissed.

      Statewide was not notified to verify or investigate any damage claim during the pre-repair process, nor was there any evidence of damaged mechanical parts saved by the mechanic for inspection. 

      One should wonder if unnecessary repairs were done by the dealership and the suggestion was made to place the blame on SWS when they were questioned about said charges.  

      This company has a well-rounded track record of customer satisfaction and has always met the responsibility of correcting any damage to which we were responsible.  This claim is no different.

      There is a possibility that ************* has a claim for the repairs to her vehicle.  That claim does not fall on Statewide Wrecker Service or its employees.

      We are in the process of securing legal counsel and information from an independent mechanic familiar with 2012 ************** Sonata.  We were not aware that the brake damage was not due to anything we did during the jumpstarting process until after the repairs were complete and we began to question the cause of such damage.  The extent of the brake damage is what started the search for answers, in light of the lack of driving by *************** in the previous fifteen months.

      We are not pleased with the difficulty in contacting supervisory personnel/management at SWS from the local office to the headquarters of SWS.  Customer ********************** to an admittedly captive audience still requires courtesy and a timely response.  

      We will proceed as advised by legal counsel with facts from the independent mechanic.

      I am rejecting this response because: I am not convinced that the towing/winching of Mrs. ****** Hybrid vehicle was not the cause of the brake damage that occurred: reference the tire marks left on Mrs. ****** driveway.   Nowhere in the responses by SWS is there any mention of the towing/winching of a hybrid vehicle.  

      The Service Advisor at the dealership consulted his Management about Mrs. ****** dilemma, and he was advised that the staff is not to get involved with her claim.  Therefore, our legal counsel advised us that without their input, the complaint would be difficult to prove.  We reluctantly discontinue our claim for reimbursement of damages, but, in no way, accept SWSs claim of no liability.

      I hired Statewide Wrecker Service to tow my **** Range Rover on June 20, 2022. This was a scheduled tow from my home related to an electric issue. This was not roadside and the car was safely parked in my driveway. During the tow the driver improperly dragged the vehicle and significantly damaged the transmission. My mechanic immediately alerted me to the damage and confirmed in writing that the damage was solely the result of the tow truck driver improperly hooking the *** up to his truck and dragging it. I would like Statewide Wrecker Service to cover the damage that it caused. After many calls and emails, Statewide rejected the claim without reviewing any photos, records or speaking with the third party mechanic involved in assessing the claim. I would like to resolve this matter amicably; however, I intend to pursue litigation if necessary.

      SWS towed ******************** vehicle on 6/17/2022.  **************** did not contact us that there were any problems with the vehicle until 7/29/2022.  At the time of this call, the vehicle had already been repaired by someone.  SWS did not have an opportunity to examine the vehicle to confirm that damage had been done.  We have no way of knowing when the damage occurred between 6/17 and 7/29, nor what the extent of the damage was.  We also were not able to open the attachments **************** submitted with this complaint.
