Our current baseball ****** package was expiring. When we inquired as to what would be the best package for us to purchase based upon our children's needs going forward the facility offered us a package deal for $2000 purchase cost that would provide $5000 in class value. This equates to 50 - one hour classes and 90 classes of 30 minutes each. Payment had to be made via cash via Zelle, CashApp or Paypal. There was no expiration time or date specified. However, on 1/26 it was stated in an email sent at 2:01 that payment had to be made "today" still no expiration time was shared. I had informed earlier that I would make payment "today" referring to 1/26. I work full time and had a full calendar of back to back meetings. I made the payment on 1/26 at 5:50pm. I received a Thank you confirmation from the person I had interacted with from the facility. On Sunday 1/28, I was told my payment was past the expiration of 3 PM and that I would ahve to pay another $1000 o get on the deal that was currently available. I was never informed of a cut off time. In a later email they stated a 2PM expiration time which was strange given he was still making the offer via email at 2:01. I am continually being told it is out of their power to give me my deal, but if I pay $1000 more I can get a better deal with a value of $10000 in services. Very strange and deceptive business practices. My sons regularly take ******s and all I want is the deal I purchased to be fulfilled. I don't want a refund as we would make use of the ******s and I don't want to pay an additional $1000 for another package. For one, I have lost a level of trust and feel uncertain the agreement would be honored. Plus I have not budgeted for another $1000 in cash for baseball ******s and went out of my way to make the other deal work financially.

    Case # ********

We are responding to the complaint filed with the Better Business Bureau by *****************************.  First off, we are a company that takes matters such as this very seriously, as our company prides itself on excellent customer service, transparency, honesty and fairness in all of our dealings.  Further, investigation of our business practices will reflect both an excellent credit record, as well as excellent customer satisfaction.

This matter was first brought to our attention as a result of the complaint filed by ********************.  ***** to the complaint, we had no knowledge of this matter whatsoever.  Our review of the facts presented in the complaint and accompanying documentation would point to the unfortunate occurrence of an unknown third party committing an act of fraud against ********************.  This nefarious party impersonated a representative of 6-4-3 DP Athletics and proceeded to offer a ****** package deal to ******************** that does not and never has existed by this company.  We have reached this conclusion due to the following facts: 1) all 6-4-3 DP Athletics employee emails use the structure first name.last *****************************.  The emails that ******************** received had email addresses with endings (@cutey.com).  2) the party is requiring ******************** to make payment by Zelle, Cash App or PayPal.  6-4-3 DP Athletics does not now or has ever historically accepted any payments by any third party payment apps like Zelle, Cash App or Pay Pal.  In fact we would encourage your asking ******************** if she has ever paid 6-4-3 DP Athletics with a third party payment app.  We are confident her answer will be no. 3) A review of our company website (www.643dpathletics.com) will clearly show our advertised rates for ******s, which are not remotely close to the absurd offer made by the third party committing this fraud.

We feel very badly for the scam perpetrated against ******************** and will offer any assistance requested to help locate these people, in hopes of recovering the money lost by ********************.  ******************** has been a good customer of ********************** where her son has taken private ******s.  Please let me know should you require any additional information from our organization.

    Respectfully Submitted,

    ********************* - CFO & Owner
