    3/11/24 ******* Purchase and install carport The business committed to install carport within 4-6 weeks After 8 weeks plus I was told I had to purchase a $2500 special brace after signing initial contract that didnt include this brace. I was then turned to partner coast to coast carport. The parts are still on alleged back order. Nothing was ever made or customized for my carport and absolutely refuse to return my deposit. Now after 3 months my circumstances have changed and I must tend to my ailing father and no longer need or want this carport. I spoke supervisor **** extensively on 7/8/24 and no matter what will not turn my security deposit after nearly 5 months of back and forth.

    Scheduling did contact ****************************** to install his carport, however, Mr. *************** would not schedule his install date due to a back injury he sustained. Also ********************** is welcome to cancel his order at any time, however as stated on our TERMS AND CONDITIONS contract that ********************** signed on two different dates(3/11/2024 and 4/19/2024 that is attached) That all deposits are NON-REFUNDABLE.

    I purchased a building on 9/8/23 for $7, ******. I paid ******* on this date. The check was lost.It never cleared the bank. The building was a 12 X 24 metal building. ***************** a sketch of the building with a Roll up door on the end with a walk in door and a window on the side. The building arrived on 10/3/23 without the side door and window. The Truck driver call his boss. The boss sent the drawing with the window and door X out. I have a copy of the drawing. I gave the Truck driver a check for $ ******* that cleared the bank. **** is now saying the price on the contract does not include the price of the door and window. The Truck driver told me they would send someone to install the door and window. They are saying I never gave them a check at the time of purchase. Why would a building be ordered and built without any payment. They stated they would pick the building up and I would be charged a 15% re-stocking fee. The contract was misrepresented at the time of purchase.

    American-StructuresII is distributor for ***************** The ************ is who received payment, built and delivered the building to ************. ************ received several building quotes before he purchased his building. ************ advised our rep **** that he wanted to purchase the building that totaled $7,163.28. Attached is a copy of the order from our office. As you can see there is no walk in door or window listed on the order. That building was a 12x24 value series that included one roll up door. As you can see there was not a charge for a walk in door or a window. ************ signed the order and it was submitted and built. At the time that ************ ordered his building The ************ was running a Zero down sale, which meant no payment was due at time of order and balance due would be paid at time of delivery and acceptance of the building. The copy that ************ attached was not written on by our office staff at American-StructuresII nor ***************** That is the reason the first payment was not received nor processed by The ************ and as stated by ************ he is still in procession of those funds. The building was delivered and ************ accepted it and paid half of the balance. ************ is now stating that it should have included a window and a walk door, these items were not listed on his invoice nor was he charged for them. ************ advised he wanted to return the building, and as stated in the cancellation part of the contract he is welcome to do that with a 15% restocking fee.

    I am rejecting this response because: You failed to add the drawing (sheet 3) that *****************. If you look at the upper left of the page, it states ***********. It also has the order number. ***************** this and had me to sign and date. She had us to believe we were getting the building for the contract price with a side door and window.

    We delivered the building on the signed contract. At this point the order has been completed, delivered to ************ accepted by ************ and paid half of the balance. You will need to contact the **************** at ************** for a resolution on this. This issue is with ************ and the manufacture **************** NOT American-StructuresII.
