I entered into a contractual agreement with Ray Engineering for an inspection and engineering report valued at $1,500. I provided a $750 deposit via check after my request to pay by credit card was declined, as they only accepted checks, which is documented in our email correspondence.Upon the arrival of their engineer, who had traveled 39 miles from ************** to my property in **************, I was informed that the inspection couldn't proceed. The reason cited was that the inspection was meant to assess work done on the property, and as no such work had been completed due to its existing poor condition, the engineer couldn't fulfill the scope of the contract. After a brief 10-minute conversation, we both left the site.Subsequently, I attempted to reach out to the company to negotiate a partial refund, as I believed it was reasonable for the engineer to be compensated for his time, even though the primary elements of the contract (inspection and report) remained incomplete.Since then, I have engaged in an email exchange with *************************, the president of the company. ****************** has asserted that the 39-mile journey, along with the 10-minute conversation, warrants a charge of $822.50. This amount is deemed unacceptable, particularly in light of the fact that the inspection and report, which constituted the core components of the contract, were priced at $1,500.Additionally, ****************** contends that the 39-mile drive took 3 hours and argues that he is *********** bill at an engineering consulting rate of $235 per hour for the travel. This discrepancy is compounded by the absence of a specific clause in the contract supporting such charges. As evidenced by our attached communication, I have diligently pursued all available avenues for an amicable resolution. However, when untruths began to emerge in an attempt to bolster his arguments, I felt it necessary to initiate a formal request for resolution.
