    He completed work on my property the day after the hurricane. I signed a blank piece of paper he said he would get back with me before he put anything done on paper but he didn't he also keeps changing the tree numbers on the assignment of benefit that i signed without my permission and we agreed on ****** dollars and he is charging me ****** and he also broke my drive way. there is alot more to the story

    Each and every one of ********************* claims are totally false. She is making an attempt to not pay for services that we provided. Her subpar insurance policy has been slow to pay her on her claim and she is either trying to keep insurance funds that she does get or not pay the entire bill were the insurance to not pay out. 

    The following are facts to this job:

    1) The contract ***************** originally signed was for 12 trees and were clearly written on what she signed. Originally there was no cost written on the contract as we were to bill for men and equipment on the job, as insurance companies like to see. We were to submit this to the insurance on her behalf and assist with this portion of her claim. 

    2) On the second day we realized that there were 4 additional trees not readily apparent when we originally were contracted by the customer. We then added these to the bill making total removals 16, not 12. We then submitted the contract with 16 removals to the insurance.

    3) ***************** signed a contract with all of our policies and procedures on the back side, clearly detailing that if the driveway were to be damaged by equipment then we can not be responsible as we are unable to know it's load bearing capabilities. (copy of these procedures on the contract up loaded here) 

    4) ***************************, ********************* neighbor for more than 10 years is having an affidavit signed and notarized as we speak stating that this driveway has been broken since long before we provided services, regardless of the driveway waiver signed by the customer. One of their neighbors had even fallen on this area of driveway two years ago as a result of the damage. Also, ****************** has stated that many of ******************** statements regarding the number of trees and what had been asked of us etc. were in fact absolutely false as she was present during each dialogue between us.

    5) **************** claims that I agreed to charge $10,000 for this job, which is patently false. If this were so then why would that not be on the contract? I specifically told her that we were to be billing based on man hours and equipment used on the job and would then submit this bill directly to the insurance company. We were there to assist them in a time of need after Hurricane ******. Also she says in this complaint that the bill is $60,000. I have also attached the final invoice submitted and for the 16 trees billed as well as the crane service used totaled $53,700, not $60,000. Not one single statement that she has made here or to her insurance adjuster has proved to be true. If she does not cease and desist then we will be filing a slander and libel lawsuit against her for defamation.

    None of him or *********************** statements are true. Neither one of us have lived in this neighborhood for 10 years.And if he wants to hire a lawyer, please do save me the time because I have proof of everything that I have. And I signed a blank piece of paper.  That now I know I should have not done. And he keeps changing the number. Every single contractor that I have had out here has said the same thing. There is no way there was twenty five trees and I have asked him several times to send me pictures of what he has before and after and I'll be willing to pay my part. But he sent me pictures of somebody else's yard and not myself. Just like he also promised to pay my deductible but that never happened either.

     We have in fact provided the customer with photos of every tree laying on the house, the workshop, the fences around the yard, ones merely laying in the yard as well as blocking access to rear of house. I am also attaching  a notarized affidavit from Ms. ******* next door neighbor that witnessed each and every communication between us and is prepared to testify to such in a court of law. I pray that **************** does the right thing and pays her bill because it is not going away and our company did a great deal of work for it. Attempting to keep insurance funds for yourself rather than allocating them to the contractor owed is a felony in ******* ****************. Theft of services and Fraud by Conversion are both felonies. We in fact did cut every tree that we billed, plus some. We are not going to take any more time debating this with **************** here, but let the attached Notarized Affidavit speak for us.
