      I contacted **** ***** at Superior Commercial Contracting to get an estimate for storm damage to my home. He sent me a contact to allow him to contact ******** on my behalf, I signed that. He then sent me different prices and I asked why. He said that he was now using ********'s payment estimate, this was after he asked me to send him ********'s payment plan. I asked why did he adjust the prices and he started to say that this is standard in the industry. I disagreed with him and told him that I would go with another contractor. He proceeded to contact ********, stating that I was trying to commit insurance fraud, trying to avoid paying my deductible, breaking the law and that I'm actually trying to "pocket" money. He slandered my name with the insurance company. I have not had any work to my home and his accusations are baseless. The next day he sent me an invoice for over $2,200.00 for time that he spent on getting the estimate. He also stated that he could repair my fence himself and use that money for other repairs. He started using strong arm tactics and his attitude was use my company or pay me $2,200.00 plus. His harassing behavior is becoming more stressful each day.

      When you reached out to us, our representative **** ***** worked diligently on your behalf, spending over 20 hours assisting you through the insurance process, reviewing your claim, and communicating directly with your insurance provider. Superior also paid a 3rd party to help expedite your claim. As a result of his work, your insurance company increased your claim payout by approximately 49.4%, securing you significantly more funds to properly repair your property.
      The reason our estimate aligned with the insurance carrier's approved scope of work is because that's the standard process in insurance restoration projects. We work within the insurance-approved budget to complete the work properly for the amount paid by your carrier.


      Regarding the termination fee: Like many service-based businesses, we invest considerable time, resources, and expertise into each project. To protect against situations where a homeowner cancels after benefiting from our work as outlined in the agreement you signed we charge a fee to cover our costs. In this case, our costs totaled $2,200, which reflects the actual time and resources we dedicated to helping you with your claim.
      We understand there was some miscommunication, and we are sincerely sorry if you felt pressured that is never our intention. Our team takes accusations seriously, and any comments made to the insurance company were strictly to ensure all parties followed proper procedures, as we are obligated to do when working on insurance claims. With all of that said, we take concerns like yours seriously. As a precaution, we have suspended **** without pay pending a full investigation. We will deduct the companys costs from any future commissions he may be owed, and if these allegations are substantiated, we will proceed with termination. We sincerely apologize if any inappropriate remarks were made, as that is not reflective of the standards we uphold at Superior Commercial Contracting.

      I am rejecting this response because:
      I did not have a point of contact with this business, I have asked for a detailed bill which erroneous, and I doubt the truthfulness of who ever responded. **** ***** is a part owner of this business and suspending him, without pay is highly doubtful. I don't believe that a business would list the employee by name and state what actions they took against an employee/part owner. This company was wrong to allow **** ***** to make false and disparaging claims against me and expect to get paid for it. I really don't expect for them to seek a resolution, nor respond. There were a lot of companies that came through town after the hurricane and used strong arm tactics if you discovered flaws with their company.

      We appreciate the opportunity to provide further clarification regarding *********** complaint. While we regret that he is dissatisfied with our services, we firmly stand by the validity of our contract, the work we performed, and the invoice we issued.
      Clarification of Facts
      Contract Agreement & Services Rendered
      Mr. ****** signed a contract with Superior Commercial Contracting, allowing us to work on his behalf with his insurance company.
      Our representative, **** *****, along with a third-party service that we paid for, worked over 20 hours advocating for a fair claim adjustment.
      As a direct result of our efforts, ********************* payout increased by approximately 49%, securing him significantly more funds to repair his home.
      Industry Standard Practices & ******************************* restoration projects, estimates are based on the insurance providers approved scope of work. Our estimate aligned with standard industry practices to ensure the work could be completed within the claims approved budget.
      As explicitly outlined in the signed contract, if a customer cancels after benefiting from our work, a termination fee applies. This protects us from exactly this scenariowhere a client receives financial benefits from our services but then cancels to avoid payment.
      The $2,200 invoice reflects actual costs incurred by our company, including the time, labor, and third-party services used to maximize ********************* claim.
      Disputes Over Employee Actions & Resolution
      Mr. ****** claims he did not have a point of contact with our company; however, his contract and multiple interactions with our representative demonstrate otherwise.
      He also questions whether disciplinary action was taken against **** *****. While we are not obligated to disclose internal HR actions, we take all complaints seriously. Regardless of any personnel concerns. After reviewing Mr. ******** allegations against ****, We found he did in fact have a signed contract after alleging he did not, this does not change the fact that Superior Commercial Contracting provided legitimate services that increased his insurance payout, and we are owed compensation for that work.
      His assertion that we engaged in "strong-arm tactics" is categorically false. Our communications were professional, and our actions were conducted within the legal and ethical standards required in insurance claim management.
      Final Statement on Resolution
      Superior Commercial Contracting remains willing to resolve this matter professionally. However, the facts remain clear:
      ? Mr. ****** signed a contract acknowledging our terms.
      ? He benefited financially from our work, receiving 49% more from his insurance claim.
      ? He canceled our contract after obtaining this financial benefit but refuses to pay the agreed-upon termination fee.
      We respectfully request that this case be closed as resolved in our favor. If Mr. ****** continues to dispute payment, we reserve the right to pursue collection actions or legal remedies to recover the amount owed under the contract.

      I am rejecting this response because:
      The claim of increasing my insurance payment of 49.4%. The price was raised over 10% after **** asked me to send him Allstate's estimate, he then increased his price over $1,500.00. That was on of the reasons that I did not want to work with him. 

      I never said that I did not sign a contract with **** to contact ********. I did not sign a contract for him to do any work, because there was a $1,500 price increase in the 2 contracts. 

      The only point of contact that I had was **** ***** and the company told me that he was suspended without pay. So naturally I couldn't contact him.

      The strong arm tactics that I am referring to was **** contacting Allstate after I told him that I no longer wished to work with him and told my insurance adjuster that I was trying to commit insurance fraud, not pay my deductible and pocket $1,500.00. All are false statements, because I have not filed a claim for payment. Then I got a bill for $2,200 and I asked for a breakdown of that bill and was ignored. This communication was not professional nor ethical. 

      I also asked how he came up with a 49.4% increase in payment. Over 10% came when he asked me to send him Allstate's estimate and he raised his prices by over $1,500.00.

      The statement that the company made about dealing with me in a professional and ethical manner is not truthful. **** intended to cause me harm, emotional distress, and questioning my integrity. 

      I would like to see an itemized bill for services, including third party. I would like for the company to remove the logo about being rated A+ accredited by the BBB, because that is also not truthful. Consumers really pay attention to that when searching the internet and not all go to the BBB official website.

      Better Business Bureau:

      I have reviewed the response made by the business in reference to complaint ID .********, , and find that Mediation is necessary.

      I find that mediation is necessary. I spoke to **** ***** last week and he apologized for his actions with ************************** and said that he would get someone else to work with me. That does not negate his actions with ******** and the false statements that he made to the insurance company about me, including insurance fraud, trying to pocket $1,500.00, and trying not to pay my deductible. I find his actions to be malicious, harmful, unprofessional, and lack honesty. Since my last contact with him, I think that a Magistrate Court will have to settle his billling matter as well as his conduct.
