    03/01/2023 We pulled our daughter from this school that operates as a private business because of lack of responsible actions from the owner from one of their teachers displaying verbal aggression or "tough love" as the owner said towards our daughter. After her "investigation" in which my daughter was pulled into an office by herself with no 3rd party witness was only asked one question. The owner told us she found nothing that warranted discipline against this teacher and that she was always in the room and never saw anything of what our daughter was claiming. We decided our daughter was not to attend this school anymore because of this irresponsible response from a serious claim. We asked for our daughter school records on 03/01/2023 since she had been attending for 2.5 years there. We were told verbally on 03/01/2023 that we were supposed to be keeping everything she brings home and that those were our records. This was never mentioned written or verbally in the 2.5 years we had been attending there. There is nothing stated on the school website, parent handbook, emails or at the school that mentions this. Multiple parents have stated now that they were never told of this either and that they would happily write me testimonies of this if needed. I was verbally told by the owner in November 2022 that they keep copies of everything, and we just had to ask. I was showed my daughters record folder on 02/06/2023 with a witness in the owner's office when complaining about the teacher situation and was also told that teachers were logging students' progress on a computer program and that she could be in serious trouble if she wasn't keeping records. After multiple attempts by email the owner has not responded to any of them about getting any records for my daughter's school records for 2.5 years. This school is not accredited and has no federal funding. They operate under "homeschool". We have a contract, and nothing is stated about having to keep our own records.

    I received your letter from Friday, March 31, 2023.  I had already acknowledged the customer's concerns presented in the first letter and they seem to be a rehash of their perspective in this second.  At this time, we are not having a meeting of the minds.  We have done everything we were contracted to do, are able to do, and had those offers rejected. 

    No possible resolution was offered by the parent in the letter from the 31st.  The parent has not been ignored asking for documents.  They have ALL of the original tests, plus work samples that we do not keep copies of. The student was at a guided reading level Y in reading at semester change (they can look for that from her take home folder) but was pulled as we were in the middle of doing current running records as she left.  They also received a report of progress at semester change from her English/Language Arts teacher which also was sent home in her take home folder.  In math she was pulled before I could document her learning for the first semester (the teacher that was terminated for not having records). They have daily class work samples from math in a yellow folder that the dad showed me. Her parents could use the same or similar standardized assessment as I am using to monitor her learning at the end of the year. It would address English/Language Arts and math if they want to know what learning she completed from 6th grade.  It has a homeschool version. Quite simply, what we have now is all old data as she has been gone for over two months (about four months of public-school learning), we are now in the final weeks of the year and have all new data on students that are still growing with us.  I understand that the student is enrolled in an on-line school.  That school should have placement information that is newer than what we have and will have end of the year information for them. 

    As both parties cannot find a resolution, the student was withdrawn last quarter, I sadly consider this is the end of the relationship.  Please let me know if the BBB needs anything in addition to this response.

    I am rejecting this response because: copies of school documents have not been given and no fulfillment has been reached. Owner is stating lies that I was given everything. The owner has copies that she stated and is refusing to give them. Lawyers next steps are to be preceded.
