    *** ***** took $3,000 from me on July 12, 2022 & said my fence would be installed in 3 days. Weeks later his excuses included: he had COVID, his team walked out on him, problems with vehicle. After numerous excuses over a period of 3 months., fence was finally up. Two weeks after I paid him the balance of $3,850; fence began to fall apart. I called, texted pictures & each time I was told he was coming & an excuse for why he did not come before. He finally came on Saturday, November 26. I was not there but a relative visiting from out of town said he & someone walked around the property where fence was and then left. I have continued to call for 3 more months & now I am being told that I violated the warranty because he told me to stain the wood and I did not. I asked about staining even before he had finished the fencing. His said I could wait until Spring - around April - or could stain it in about 3 months if water was seeping through the wood. 3 months would be end of December. The wood planks started falling down back in October two weeks after installation was allegedly done. I have been trying to get him to replace the old pieces of wood that warped and or fell down two weeks after installation. All I have gotten is excuses, aggression, and threats. Yesterday, February 3, 2023 he promised me he would be at my home at 1 pm today. I texted him at 1:10 and 1:21. I finally called at 1:30 pm and was told he sent text saying had problems with his brakes and would have to reschedule. I told him I never received a text and reminded him that I’ve been trying to get the fence repaired since October. He started screaming & saying that he was not coming to fix any fence because I violated the warranty. *** *****, should.not own a limb business license . He has cheated me & my elderly mother of $6850 & my fence is falling apart. I have 2 dogs and HOA requires I have them fenced in but I have no money to pay someone else to repair the fence that has been falling apart.

    Prior to this complaint, and after numerous promises made by the Owner *** *****, to come and repair the fence and not showing up, he agreed to come on Saturday February 4, 2023. When he did not show up, I called him once again. He indicated that I violated the terms of the warranty because he told me to stain the fence and I did not so he is not coming to repair the fence.

    This fiasco began in July 2023 when I commissioned *** ***** to build a fence in my backyard. We agreed on a price of $6,850; he said he would take a down payment of $3,000 and promised to have the fence installed in 3 days. After coming once every 2 weeks, providing excuse after excuse and not complying with his word; he finally completed the job the last week of September 2022.   I asked him if I should stain the fence after he completed installation and he said I could wait until the Spring 2023 but had to wait until water could seep through the wood. He indicated that he would be happy to stain for Two weeks after fence was installed my neighbor told me that she picked up a few of the planks that had dropped. I sent him a text and called him. I also sent him pictures to show that planks were dropping.  I just kept getting promises that he would come and he did not show up until Saturday, November 26, 2022; walked around the property and then left. I continued to call throughout December, January and beginning of February and now all of a sudden, the excuse was that I did not stain the fence so he was not responsible for repair or replacement of warped and wooden planks that had fallen. 

     

    How could I have stained after 2 weeks – when planks started falling. He indicated that I had to wait until water could seep through the wood – which is usually about 3 months.

     

    I am out $6,850 and this is not fair. I want a reimbursement since I now have to pay someone to redo this fence.

     

    Please give me so advice on how I should move forward as I do not have the funds to hire an attorney and as I read some of his reviews (which I should have done at the beginning) I am realizing that there are others who have lost money. One person took him to court, won the case but has never received the money.

    She never stained her fence. You can't expect wood not to go bad if you don't stain it. I have it in text messages and everything else.

    I already went out there and repaired what I could but I'm not going to keep going out there because she is neglecting to do her part of staining it.

    I am rejecting this response because: Mr. ***** suggested that fence could be stained but I had to wait at least 3 months. He even said I could wait until April as it would be better to stain in the Spring time. This was said to me in September and the fence started falling two weeks after the statement was made.  I have text messages where he kept promising to come from October.  He finally came on November 26, walked around the property and then left. I continued to call and text with more promises of “I will come but it’s raining or my car is not working or I am sick.”  Finally, in January I received a text message stating that I violated the warranty because I did not stain the fence.  I have been waiting from 2 weeks after fence was installed to get it repaired.  The fence falling apart has nothing to do with it not being stained as it began to fall apart 2 weeks after installation and he told me I had to wait at least 3 months or until April before I could stain. My neighbors are witnesses to the fact that the fence began to fall apart 2 weeks after he was finished with the job. He needs to replace the rotten warped pieces and use strong pieces of wood instead of the cheap, thin pieces he used to build a fence I paid $6850 for. I will continue to write reviews and use the law to protect me against this incompetent, unprofessional person

    I have attached a copy of the document I signed on July 12. Please note that job dragged on with many excuses until end of September. We agreed to a one year warranty beginning when installation was complete and I added note prior to signatures. No note was made that warranty was based on staining of fence. I asked if fence should be stained and was told that I could wait until Spring - April but should wait at least 3 months. Installer is claiming I violated warranty because I did not stain fence but fence started warping and falling 2 weeks after installation. I called, texted and sent pictures and kept being told, “I’m coming on Monday.” Monday would come and I would call when no one showed up and would be given another date. He finally came on Saturday, November 26; he walked around property and left. I kept calling and getting more new dates to visit. In January 2023, I received a text that I violated warranty by not staining the fence.
