    My home property line butts against a Rights of Way that has a dry creek with two easements where water from rain should flow and drain. The area is jointly owned by two HOA. The side that butts against my property is owned by *************** HOA managed by ******************************* (***** *****). The other side where the two easements sit are owned by Twin Lakes HOA with contact persons being ***** and *****. Both of their areas have been severely neglected and have not been mowed or maintenance for years. I purchased my home on August 25, 2021 and we have been trying to get this matter resolved and locate the responsible parties. Due to the overgrown weeds and bushings, the original dry creek is filled with weeds and grass and the two easements are blocked by the same thing thereby preventing proper water flow in the dry creek and into the easements. This issue has caused the water that should be flowing in the creek and into the easements to flow into my back yard, create false creeks and flood my yard every time it rains. It has washed away my soil in the back yard and created four deep crevices where the water runs. I have more than 4 trees that's compromised due to the soil washing away and their roots are exposed-- being severely damaged. I have contacted both HOA's and they are not addressing the issue and ignoring the problem even though I have provided pictures and the property plat that shows peer the state of ******* that the areas legally belong to them. They're responsible for the damaged caused to my back yard and trees. They need to mow each of their areas and keep them maintained. They also, should rebuild my back yard with soil and remove the trees they've caused to be damaged. I am at the point of hiring an attorney and take each party to court. This is not ethical as they should not be allowed to be neglectful and disregard what is clearly their responsibility. My property and home should not reap their neglect and be at risk.

    This area is a Power Line that was graded and developed by the developer of the community to allow the power lines to run through it. After the complaint by you, Mrs. ******* I visited you on more than one occasion. The area of ********* bed, as evidence of the Rip Rap stones lining the area has subsequently been maintained. You claimed another dry creek bed existed on the north side of your property as well. I walked that area and there is no ***************** bed there to maintain. It is simple "power line" area that gets cut when the ************* comes and cuts it. When land is graded and water flows downhill, it is the responsibility of the property owner to capture the water on their lot and help it flow through or leave it as is but cannot dam the area stopping water flow. What is happening behind your home is happening due to the natural design done by the developer. I am not aware of any unmaintained dry creek bed in the area except for the one pointed out earlier and we have maintained it now and put it on the annual rotation along with the detention ponds. You may contact a landscaper to see how to best "channel" that water by building your own dry creek bed to avoid the overflow and erosion you speak of. It is happening because you have done nothing to mitigate the water coming onto your property as the person at the lowest point in a long run of development.

    I am rejecting this response because:

    ***** is ignoring that according to the plat from ************* which can be seen on ********** shows that ************** HOA owns the entire strip of land that butts against my property line and that entire strip of land needs to be mowed. The power company does not own that land but ************** does and they are responsible for clearing it and keeping it cleared. Twin Lakes HOA owns the other half of the strip of land with the two easements in which they also need to mow and clear there's. They do not have any contact information other than  an email in which I need them addressed also. There email is ********************** Please look at the property grid that the State of Georgia says that Heritage Pointe and ********** own, as well as the un mowed grass and weeds that stands over 3 feet tall.

    These photos are but a few that I have taken and supports everything that I am saying. If ***** is adequately managing ************** then he should know what land belongs to the **** The small piece he's trying to claim, he didn't even know that until the City of Senoia workers came out and said that and provided the same documentation added here. I am only asking for both HOA's to mow the complete areas and not just a corner or none of it. If we have the water rerouting then it cannot even run into the easements because of both Heritage Pointe and ********** over grown grass and weeds. We cannot even begin to reroute the water until they mow the area and we can redirect the water at it's starting point.

    For ***** to say that I have not done anything to prevent this is a lie. I purchased the home in August of 2021 and I have been clearing the back area as able because of the excessive water which had the grounds extremely wet and no tracker could go back there to mow and cut the over grown bushing. This has been an on going thing since we purchased the property and since knowing that the none mowed areas belong to both HP and **********, this is where I've contacted *****.

    ***** has not been diligently clearing even the small area that he's saying as it as of today, is not mowed and not clear. It is disappointing to see companies operating in a lack of integrity. Overall, if the two areas owned by each HOA was being properly mowed, then the water flowing would have flowed forward into the easements because it would not have been any weed blockage to prevent it. This is what caused the flow of water into my back yard. PERIOD!

    The area in question is deeded land to the *** but it is left natural to the extent that the power company maintains it for their easement. The *** has never cut the power lines. There are many areas of common land that are not regularly cut by an *** and this has always been one of them. It has never been maintained by the *** and as a management company, I only take the actions that the *** approves. I manage 63 communities, each one has it's own leadership and it's own level of services provided. I, ***** with HomeLink, do not decide the level of services at any communities. I only execute what is decided and I have taken care of all the common areas that the Board has approved in their landscaping plan. Never has the board of directors for your *** instructed us to get a quote for and maintain the powerline areas.
