      I contracted with ALL-PRO Pest Serices at ****************************************************** for mosquito control services for this summer season 2024 (to include 7 applications). So far, they have sent notices that they applied 2 applications to my lawn, but DID THEY NOT COME and do the work. There have been no technicians on my property to my knowledge, and I have been at home when they say they have come. I believe this to be a con as well as false advertising. I called their office and talked with a spokesperson who did nothing to resolve the issue. I want a refund and cancellation of their so-called services.       I paid All Pro Pest Services $310 in mid April 2023 for an annual contract (to run through July 2024) to monitor for termite activity and a retreatment/repair warranty. Service was canceled at my request in March 2024 and All Pro Pest services retrieved their termite bait stations (also in March) and are no longer protecting and/or monitoring the property for termites. Despite several written requests and also speaking to a manager named ****, All Pro refuses to provide a prorated refund (approximately $100 for ? year) for services unprovided. Note: I will also be reporting All Pro Pest Services for selling repair warranties to myself (and many others Im sure) that exclude coverage on the very homes theyre being sold to cover.

      Page 2, Line item 1 of the contract states "The Customer may cancel this Agreement in writing within three (3) business days of this Agreement without any fee. If the Customer
      desires to terminate this Agreement after such three (3) day period, he may do so after paying All-Pro a cancellation fee equal to twenty
      -five dollars ($25.00). The three (3) day right to cancel this agreement is waived when service are rendered. "

      ***************** took possession of the property July of 2020.  The renewal for this property was paid 2021, 2022, and 2023.  The terms of the contract haven't changed in this time period.  

      A copy of the warranty, and the terms and conditions was provided at the closing in 2020.

      I am rejecting this response because:

      All Pro Pest Services has not provided an explanation or defense here whatsoever, all they have done is simply admitted to selling me an erroneous contract for the last 4 years, and getting away with it.  All Pro Pest Services is effectively saying that if I didn't realize I was being deceived before, there's no reason I should be complaining about it now, and that if one cannot figure out that he or she is being sold an erroneous contract within 3 days then too bad.
      It does appear to imply that if I pay the $25 dollar fee to formally cancel the contract, then they will provide the appropriate prorated refund.  Is this the case?
