On March 10, 2023, ******* ****** and Anterro ****** entered into a fixed-fee owner's lot contract with Scott Collins Communities of ******* for $725,000 to construct our home at ******************************************. The contractor provided us, the homeowners, with an *************** Warranty Agreement covering all materials installed and workmanship performed under the contract for a period of one year from the date of completion. In conjunction with ***********, we ultimately paid Scott Collins Communities of ******* over $1 million to construct our new home. We received our Certificate of Occupancy from ************* on February 28, 2024.Despite the fixed-fee contract, the builder later attributed the cost overage to increased material costs and expenses associated with subcontractors. He also stated that he had worked closely with each of his subcontractors and had even helped establish several of them in business. However, when we requested the builder to address warranty claims, he refused and had his attorney send us a letter falsely claiming that we still owed him money. This claim is entirely untrue. Additionally, at the conclusion of construction, the builder executed a Lien Release from ***********, dated April 23, 2024, certifying that all labor, materials, equipment, and services used in constructing our home had been paid in full.Furthermore, I am considered totally and permanently disabled solely due to my service-connected disabilities and am unable to make these repairs myself. Given the circumstances, it is critical that the builder upholds his contractual and legal obligations to address the necessary warranty repairs.
