tow company ignored all state laws and my complaints regarding a illegal tow. I kindly ask for them to release my car , due to it being unlawfully towed but was refused with no update. I am rejecting this response because:I know y'all are doing y'all job...I have nothing against you all.... *********** police department deputies aren't lawfully trained in the realm of traveling. they presumed my automobile fell within their jurisdiction of a motor vehicle ( commercial use ) which it does not. I practice law so I know they don't know, the court date is on feburary 11th 2024. I just want the automobile released before then, I filed a petition for a emergency court order . It's not a lawsuit... it would just be telling you all to release the automobile without hassle. and the so called debt that I owe can be discharged by the *** with a 1099a form.......I am currently the priority lien holder in Gwinnett superior court via the ***** and claim has been officially made, so the automobile is currently held in a private trust (you all can call court and ask) ...please consult with the company litigation department for clarification on this response. Current case with ******* police will be dismissed giving me leverage in any legal proceedings after documentation Is provided to judge. A court order supercedes police authority as well as supreme Court rulings. As they operated outside of their legal capacity ....See case law below

Hi, Did you read the Lilburn Impound Vehicle Tow Receipt attached? S & W did not tow the car illegally, it was towed for ************ via ************** Dept.
The law OCGA 40-6-10 states it is illegal to drive a motor vehicle without adequate insurance coverage on their vehicles. A failure to have appropriate coverage can result in the driver being charged with no proof of insurance.
It does not matter whether the driver owns the car or not. A vehicle must have at the minimum, the state required insurance on it.
Again we are not holding your vehicle. Please pick up your vehicle and pay the tow fee.

My vehicle was stolen and impounded on October 26th. On October 29th the individual who stole my vehicle went to S&W towing and was able to get my vehicle using fake documents.Attachment #******. My vehicle was reported stolen and was impounded again later that same day. I was not able to get my vehicle out until November 23rd, because on November 11th the tow driver I scheduled never showed up. On November 23rd. A copy of my registration was given to me from S&W to prove ownership. I was also charged $33.00 a day when they sent me a letter saying I would be charged $25.00 a day. I contacted S&W towing at ************ and spoke to ******** on 11/26, 12/02, 12/09. She had mentioned that she would try to have a resolution by 12/13. Being I hadnt received a phone call. I called her twice and left a message. You can look at the attachment #****** and tell its fake. Look at the font on the paper license for the name and address. It is off center and bigger than all the other font. The signature starts with an A. ************* is not a binder. And the registration is fake with a different birthday than the license. If they would have verified their information the same way they verified mine. They would have known the information was fake and they were not the registered owner nor authorized to take possession of the vehicle. In reading ********* non consensual towing. They are not supposed to charge a fee on days they are not open. And they are not supposed to release a vehicle to someone who is not the registered owner or authorized by the owner.Business Response

Also note the name, and dob on the fake/forged documents. The vehicle was impounded on 10/26 for no insurance. On 10/29 it was released to the person who stole the vehicle using fake/forged documents. It was again impounded on 10/29.Business Response

No I did not go to the annex. Why would I go there? My issue is not with the tow. My issue is with the tow yard releasing my vehicle to someone who clearly used fake documents. And the fact that I was sent a letter saying I was being charged $25.00 a day, and when I got to the yard it was increased to $33.00. This after I told the person working that I was told $25.00. And he refused to call **** or anyone to confirm. The individuals you mentioned stole my vehicle. I have no idea who they are. The documents attached ****** were what was used to get my vehicle out after the first impound. That is not me. And that person was not authorized. Also none of the documents used match. The date of birth is different, address is different, The name is not the registered name for the vehicle. When I came into the office an e-service document was pulled to confirm ownership. Which I attached as well. Showing my name, address and expiration date of the tags. Which if you look at the forged identification, with the large font. The birth date is not the same. ********************* towed my car for an expired registration tag which I corrected the next day and got my car the morning after they towed it. When I picked up my car the front bumper was hanging off the side of my 2022 Prius and I can't pop it back in because the plastic fastener is broken. I've called them every day since the day that it happened (10 days in a row). They have told me to leave a message with the supervisor and I have left 10 messages with my name vehicle # and phone #. After requesting multiple times for the tow truck driver to roll the window up on my car on 08-13/2024 during an traffic arrest, i went searching for my car and and was ran all over the city to locate it. Upon picking up and liberating the vehicle on 08/28/2024, I found the window still rolled down, and recalled that there had been several inclement weather forecasts (Rain, thundershowers). We paid $631.00 to liberate the car from impound, (and they illegally skipped registration) a man working behind the desk playing solitaire on the computer jumped up during conversation about the damage to my vehicle and rudely called me a "dumbass" while pointing out forged documents regarding my car. On the exterior, the towing company tried to dismiss damage to the front bumper and support clips that was not present during time of impound, and due to negligence from rolling up the windows, it appeared that some sort of vermin (suspected rats or squirrels) got into the interior, deficated and urinated all over the inside after getting into food left inside the car, and preventative insect bait traps that were in the vehicle. There was evidence of rat f**** still in the half eaten bait traps and urine smell everywhere, which made the vehicle unbearable to drive home. I may have to check into a hospital to find out why i am so sick right now, but this proves that S&W is untrustworthy of proper care and consideration in business. I would like to pursue a small claims negligence and damages against this company or warn others of the distrust this company has caused to a perfectly good car before they towed it and ruined it!Business Response

On August 13 2024 note area incident occurred was on private property However the following events occurred. . My car was impounded illegally by *************************. My vehicle was illegally seized without being convicted or even tried for a crime. The ********************** agents pulled me Ive for traffic violations no injury or damages were done to the public safety by me getting traffic violations they police then violated my 4th amendment of the constitution and search my vehicle illegally and found nothing they then called S&W towing to steal my car. S&W then alleged that they have a contract with ********************* which infact means that S&W gets paid by the ********************** being there is a contract between the 2. However S&W first stated that the toeing fee is 250 dollars for me th get my vehicle back. However I was incarcerated over 7 days and they alleged that its not over $500.00. This is illegal also ga law only allows for a tow company to charge 175. I specifically told them about the law and its limits however they refuse to give me my vehicle. Also lilburn police department is the responsible party for paying the towing company in which they have a contract with. I have no contract with either company so I am not legally liable to pay any charges in which I did not authorize any services for. Note the S&W can not steal my car they have no interest in my vehicle nor does the ************************* have authority over my property. Note traffic violations are allegations are not a criminal matter its civil. I demand that you make S&W release my vehicle immediately and compensate me for all injuries and damages that i have aquired from the unconstitutional misrepresentation and vehicle theft they and the lil burn police department and it agents and natural representatives has caused me. My bus was towed by S & W Towing from *********************** on May 9 2024 at noon. The tow company damaged my bus. I went to retrieve my bus and found extensive damage. After removing my bus from the yard, I contacted the tow company to alert them of the issue and request their insurance company's info. The person I spoke with stated that I can send the photos but they will not do anything about it. I obtained the email address and sent pictures.
