Ms. *************;purchased a non-refundable program and chose not to participate in the program. She violated several of the agreements in our signed contract, attached here, in regard to participation, communication and personal responsibility.

She was made aware during our conversations before joining the program that attendance to the retreat without participation in the group program is not permitted. The program is offered as one package only and we do not offer spaces on retreat to participants who have not attended the group program. This was clearly stated in our conversations before she officially joined the program.

In Week 11 (out of 14) of the program, we had a 1:1 conversation where she stated she was no longer interested in learning from me or listening to the other participants. The following day, on July 6th, 2023 she sent me a message via Whatsapp that she has decided not to attend the retreat.

I have responded to ****************** numerous emails and sent her a copy of the contract she signed.
The contract clearly states the program investment is non-refundable, even if the participant chooses to withdraw at any time.
I have provided her with our legal tax address in an email as well.

I am rejecting this response because:

When I joined this program, I was looking to connect spiritually with others, work in my personal growth and spend my 50th birthday (October 11th) in a luxury retreat in ****. It was very surprising for me to hear **** say, on week 11 of 14, that I was not a good fit for her program and I could not attend the retreat. I did not know that I was risking getting kicked out of the program for not participating in all the sessions, especially when others in the group had missed as many or more sessions than I had, and it is outlined in her contract that it's fine with just watching the recordings.

During the 1:1 sessions is when I learned about my ineligibility to attend the retreat. I consider this her own personal choice and decision after hearing me say her coaching method was giving me anxiety. It's all in the recording. She never mentioned anything about me losing money for the 1-week luxury retreat in ****, in fact she avoided talking about a refund in our 1:1 conversation. The next day is when I received an email where she stated the following:

In conclusion, this is how I request that we proceed from here:
    1. You do not join us for the remaining two calls of the program.
    2. You will not receive a refund.
    3. You will not be joining us for the retreat.
    4. We will be complete from here and there will be no additional services or experiences offered in addition to or in replacement of any elements of this contract.
    5. Upon acceptance of the information presented in this email, I will send you a revised contract to sign that contains and acknowledges what is outlined here.

To finish I just want to add that I never received a "revised contract", she just ignored my emails after I didn't agree her.

Also, I never got a sales receipt for my $6800 payment.

    Sincerely,

    *********************************

Hello, I would like to close this matter. I have provided the contract for both your and the client's review. There are no refunds, her signature is on it.

This person has emailed me countless times and made several claims that are not accurate. She signed a non-refundable contract, and we delivered the program to her.

Please let me know what can be done to close this matter and move forward.

I am rejecting this response because:

To recap, I signed up for a 14 week program and a luxury retreat in ****. During the course of the program (Week 11), the coach found a reason to kick me out stating I was not in compliance with the contract agreement and found me ineligible to attend the one week luxury retreat in ****.

What I understand is that a company needs to render services for the client or customer in order to receive the payment. And if there's an issue, the business needs to work with the client to resolve the problem.

In this case, the business received full payment upfront but the services were not fully rendered and now the business is not willing to work anything out with the client other than saying it's a non-refundable program and there's no money back.

So in my opinion, this is the definition of a SCAM.

    Sincerely,
