On February 19, 2025, we closed a loan with Rocket Mortgage, with Fidelity National Title & Escrow of Hawaii ("FNT") acting as Escrow agent. On the funding date, *** called to confirm wire details. They then called right back and said "they didn't have the money" so it would be the next day before we got our money. Turns out, they actually had the money at 6 am HST, hours before they called me and said they didn't have it. Interest on our loan started on the day they got the money, even though we didn't have the money yet. This is unfair, and perhaps, illegal. If this is a systemic practice on the part of ***, then they are defrauding consumers. By the way, FNT deducted $656.72 from our loan proceeds for their "services." The very least one would expect is that they would NOT hold up moving money into our account. They owe us the interest we paid on money we didn't have. Properly handling the escrow for loan closings seems to be a pretty basic part of the service we should expect. They should refund some or all of the fees they charged us for bungling something that basic.Business Response

On June 7th 2021 escrow closed on a property I sold using Fidelity National Title Company located in ****, Hawaii, Prior to the close of escrow the title company received 2 separate levy's from the State of Hawaii ********* The title company chose to pay only 1 of the levy's, They ignored the notices from the *********, which resulted in the state coming after me for the payment .while adding penalties and interest The Title company violated the Statute and according to the statute they are liable to pay they continue to ignore all communication, leaving me no choice but to file a lawsuit.Business Response

I am rejecting this response because: Fidelity National to date still has not completed their investigation of this matter, furthermore we have acknowledgement from Fidelity that they received the levies from the State of Hawaii prior .They failed or possibly refused to pay and stopped responding to the State of Hawaii. Their failure to act responsibly has now resulted in damages to me.

I am rejecting this response because: I never received the said letter of April 25th,Furthermore the State of Hawaii took the money and sold stocks from my retirement account to satisfy the levy that was caused by the Title company. This was all done prior to the Title company stating that they satisfied the levy, I believe that what is being said by the Title company is simply not true at all and I begin with the letter that they said was sent to me that was never received.

I am rejecting this response because: The Title Company has Not resolved this issue, I am the one that provided the release of the lien as it was sent directly to me from the State of Hawaii, Yet the Title company is leading the BBB to believe that they are the ones who has provided the release, Furthermore the State Of Hawaii has already liquidated my retirement account for the mistake that Fidelity National Title Company has made. I have incurred additional damages as well. Lastly How can the Title Company say that they will not answer a fifth time when they have Not resolved the Issue??? This is the tactics they used when corresponding to the State of Hawaii and with my Attorney they simply stopped responding now they are trying to use the same tactics with the BBB instead of resolving the issue!!!I shutter to think of the how many other lives have been destroyed because of their negligence. I urge the BBB to hold them accountable and make them come to a resolution on this matter.

I am rejecting this response because, This is just another way of Fidelity National Title Company skirting the issue/problem. My Attorney will be in contact with the Title Company shortly, I urge the Better business Bureau to stay engaged in this matter to ensure it is resolved ,otherwise I fear that the Title Company will simply act as they have in the past and simply ignore or not respond . ie The reason I was put in this position to begin with.

RE Escrow file: FHAW72208093 ********************* with the Fidelity Hawaii Office on Maui was selected by the seller of a property I purchased to facilitate the escrow. During our escrow, which had to be extended, there were 3 title transfers that took place, from Seller A (*ank) to Seller * ****** of VA), then from Seller * to Seller A, and finally from Seller A to myself. Prior to this escrow. First Hawaii Title facilitated the transfer from the previous owners to Seller A.When I then resold this property earlier this year, and used First American Title to facilitate the escrow, they discovered unpaid HOA transfer fees totaling $1,200. The breakdown for this $1,200 is a $300 per title transfer assignment from the **** After the discovery of these previously undiscovered ***************, I contacted my former escrow officer, who passed me along to ******************. ******** took my information and request for reimbursement in the amount of $900 for the 3 title transfers prior to my taking title, via phone in the last week of October. She said she would get back to me the next day, and never did. It wasn't until I emailed her to follow up on 11/20/23, that I received the response: "My apologies for the delay in getting back to you. In review of our closed file, we were not notified of any Association at the time of closing. Therefore, we will not pay for any fees transfer fees due."It is a Title and Escrow companies job to do the due diligence required to determine if a subject property is in an HOA and if there are any outstanding dues owed. Fidelity failed to do their required level of due diligence and provide proper care in this transaction, which resulted in my being forced to pay a total of $900 in back due transfer fees that should have been the responsibility of the previous seller.To date, ******** has only attempted to pass me along to their title claims department and did not comply with my request to loop in their legal counsel.Business Response
