      On 3/17/25 @ 7:45 JSX Hauling delivered a rolloff to the home accross the street from me. After the driver set the *** ** drove his vehicle on the sidewalk fronting my home and smashed the paver bricks into the ground and causing some of the others to buckle. The company can call ****** Stone to have this redone or I can hire a handyman to do the job. I think Futura Stone will cost over $1K but think I can do this with help for $400. As there is no broken pavers it needs to be removed and the sand bed be redone and the paver replaced and leveled.

      On March 17, 2025 we delivered a roll off container to a customer located across the street from the Complainants property. During the drop, our driver had to climb the curb in order to avoid hitting parked cars in the surrounding areas. That day, the Complainant called our office and explained what transpired, and also sent photos of the damage. He explained that he had covered exposed plumbing pipes from the Board of Water Supply, with sand and placed loose pavers on top of the sand. He went on to say that our driver ran it over, and it was now sunken in. I told him that I would speak to our driver, and call him back. I called him back on March 18, 2025 at 9:56 am, no answer. Since then I have not heard back from him. Our customers are required to sign our terms & conditions prior to any delivery, which clearly states that we are not liable to any damage caused by our equipment. In this case, ***** is not our customer but since he did address the issue while our driver was still on site, we do acknowledge the claim and are willing to fix the issue, so long as we would not be interfering with any Board of Water Supply or City & County regulations. I am now in contact with both agencies, and will come to a resolution very shortly.

      I am rejecting this response because: there was no message on my phone.  I viewed my security cameras when he delivered the rolloff and when he picked it up.  When he picked it up the driver needed to go forward and back a few extra times but didn't need to drive on the sidewalk area.  I am asking for $400 to hire someone that can redo the sand bedding and reset the pavers.  I estimate this will take about 4-6 hours of labor and can hire my former maintenance workers that worked for me previously.  The company can try to call Futura Stone where the pavers were purchased 20 years ago but I think they will charge about $1-2K as they have done part of my back yard.  I infomed the company that the water line is directly below and could be damaged from the sinking of the soil area.  To date I see no damage or leaks in the area.

      In response to Allens rejection, I have cell phone records to prove I called and can provide upon request. Also, in our defense, we operate hook lift trucks which requires a minimum of 12 feet vertical clearance and at least 50 feet in length. This road was very narrow with parked cars on each side. We had no other choice but to climb the curb, which unfortunately in this case has resulted in this issue. So with that being said, and after speaking with BWS & C&C, we will take responsibility & pay $400 as requested by *****, so long as ***** agrees to sign a waiver releasing us of any further liability. If agreed, we can do this by email or an in person hand off. We apologize for any inconvenience this may have caused, and would like to remedy this issue asap.

      I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution is satisfactory to me.   They can mail a check to me at *******************, ****************************************************.  I can then proceed to hire personnel to repair the damage.  Any damages to the Board of Water supply lines prior to their meter will still be the companies responcibility.
