    In the course of installation of the radon mitigation system (the 'System'), Honor Radon proceeded to drill approximately twelve (12) inches into the ********************* perforating the foundations water barrier and damaging one of the piers supporting the foundationgravely damaging the structural integrity of the foundation. Furthermore, due to the depth of the drilling, the System began drawing groundwater into the Property, which caused extensive water damage to the surrounding flooring and trim.Honor Radon has not communicated with us since or attempted to help resolve the issue.

    Drilling into the foundation of most homes is necessary for radon mitigation systems and drilling into a footer is not uncommon.  This situation was unique in the homeowner failed to disclose that the home previously flooded the night before closing on the property and was prone to future flooding.  In addition, the homeowners were informed during the closing process that a sump pump must be installed to remedy the home's water issue. This information was identified by my team post radon mitigation.   Both homeowners were asked during the investigation if there had been any water issues.  The wife stated yes and informed us of the information above.  The husband was asked during the investigation about any home water issues and he stated "no, there were no water issues with the home." Our mitigation team then contacted a third party water disaster company to assess the issue.  It was determined that the home had a high water table and no water pipes or lines were permeated during the drilling for the mitigation system.  The third party company shared their findings with the homeowner.   I attempted contact with the homeowner on 3 separate occasions in which calls went unanswered and messages were left.  In a fourth attempt to contact the owner, the homeowner stated not to contact them as they had retained counsel.

    I am rejecting this response because:

    1. Based on evaluations from several local contractors, the business should have checked the depth of the drainage tiles prior to drilling and not exceeded that depth. Additionally, the drilling was done into the pillar support structure, not the footer, compromising the structural integrity of our home. We were informed by 2 different companies who evaluated the damage that Honor Radon should've realized the concrete drilling was in the pillar, and not the footer, once a certain depth was exceeding during drilling.  

    2. The prior flooding was not related to this project and was caused by a broken sump pump discharge pipe. At the time of the radon mitigation system work and after the water damage occurred, the plumbing company confirmed the sump pump was functioning properly and in fact, was empty to indicate water should not have been coming into the home.  

    3. We were never provided the name of the 'water damage company', nor given the opportunity to discuss the issue with that company directly.
