We had been granted a three payment deferral due to a family illness. We only needed two months so we filled out the forms for two months and paid the deferral fees. After the two deferrals We received notification that we owed the diffferal for the third month. Called in and paid then sent the third month paperwork in to a different address as instructed. Started getting dinged on credit reports for a late payment. After several calls with no solution my husband ***** called ******* ******* and they resolved the problem by us making up the difference on the three deferred payments. ******* was to get our credit report issue erased. Mahindra finance usa or whatever they call their self has sold c*** equipment. been in the shop more than I have got to use it. From broken wiring harness at 4 hours to multiple hydraulic leaks to the Rental Pro(**) who sold the tractor who wants to charge 200 each way to come get it for service work. The first was with 4.5 hours on it. They delivered it with 4 hours on it. So in 1/2 hour I was responsible for 400 extra cause I drove the tractor thru the yard. Now they will not service it cause I will not pay them their stupid delivery and pick up fee on a brand new tractor. Kiss my *&%. they have had it in the shop more than I have had to use it. You sold a c*** machine that leaks hydraulic leaks like a water hose at every fitting. Nothing is torqued right. Mahindra is such a c*** company that you can not even find a way to make an online payment without working your a** off. Once I did find the way to pay online, I signed up for auto payments. Get a letter in the mail that its paid off and its up to me to stop my bank, not Mahindra, from sending auto payments. Cost me 35 dollars to end auto pay. Bull s*** I will never buy from this company again. EVER>. your machine is c*** won't shift right and a million other problems on a machine which only has 70 hours on it. Im working on it like it has 4000 hours. Cant make contact with nobody thru Mahindra. Oh yea fill out a contact email and we will get back with you. Biggest mistake I ever made buying this junk. Should have stuck with orange or green. Stuck now with a low hour machine I have to sell and no service from Rental Pro. The only dealer within a hundred miles. ** I could afford it I would burn it to the ground on the trailer in front of the dealership. Your 7 year warranty is c*** if you dealers won't honor it. I owe rental pro ****** for pickup and delivery on a new tractor with less than 80 hours on it. S*** in one hand wish in another. Not getting it. Yea I'm ******.Business Response

On 4-7-23 I purchased a tractor from Mahindra. They said the backhoe was on back order, for 2 weeks and I would have it. It was not back in stock the sale went south after that. (Salesman) I voluntarily let them have the tractor back because of no backhoe. I went that day and purchased a new **** Deere with the equipment I needed. They sold the tractor privately for $******. And said I owe them $*********. This screams "sold to a friend." And I looked on line and can not find a tractor for sale at that price and hours (17) without it being a 2015 or older with hundreds of hours on them but Mahindra told me that the $ ****** was a competitive price for that equipment with that many hours. I can rent a piece of equipment for a week for $1,300. I absolutely would of put more than 17 hours on it for a week.I believe they breached the contract when they sold the tractor without the whole piece of equipment I signed the contract for. They are now sending me threatening letters saying that if I didn't contact them in 20 days I would owe the whole amount on contract. I contacted them within the time frame they were saying I owe the $ *********. I do believe I owe nothing this contract was was not fulfilled on their end for what I signed the contract for. I am rejecting this response because:
In the contract it statess they can not modify it and they did, in picture that I sent to you you can see that it says that but they modified it anyway, then sold it for $11,000 with only 17 hours on it for a 2023 tractorI looked for a tractor for that price and can not find 1 near that price with out going all the way down to 2015 with several hundred hours on it. I had already contacted mahindra they want to settle for ***** that is not acceptable. They are in the wrong with the contract. They broke the contract by altering it before selling. The amount theysold it for is beyond ridiculous for a new piece of equipment. It still screams "sold to a friend." They say because I accepted the piece of equipment at time of delivery that I have no right to dispute the contract, but I believe I do from the information that I told you and the pictures I've sent to you

On 11/6/2018 my company Bull Gang Industrial bought two Mahindra's for the business. We were working in Georgia Pacific at the paper mill in *******. As it turned out there was a cool red gas powered vehicle then they talked our estimator and husband into buying this green desiel powered vehicle. They were supposed to be both new vehicles. They told them they would give them a deal if they bought it also as it had been on the lot longer and needed to sell , so we got both planning on using the red vehicle as personal and the green one was taken to the plant to transport men and work tools.The first week the green back rear end exploded. It was taken to TNT in ************ where it took weeks to get parts, the ring gear in the back end. When they removed the clutch covers water ran out. They told us the vehicle had been submerged in water. We had not taken this vehicle into any water. Soon after that we left ******* and returned to our home in ***** **. Mahindra was told we would buy the red one but green one was sold to us as fraud. We later learned the Mahindra dealer in ******* closed due to fraud. Mahindra ignored my request and picked up both vehicles. Later on they sold them both at auction. Then tried to get us to pay the difference. I gave them the evidence that I had tried to keep the red one, if they would take the green one. I told them the sale was. This went on for a few months and then I heard nothing. I thought surely they agreed the Around Aug of 2023 we received a letter from their lawyers that they were there to recoup the difference after the sale of 10k. I told them it was a fraud sale and I was not paying anyone anything. They threatened court and I said come on, you'll lose this one. Bother me with court and they will pay me the 10K. But, I'm sure they are hurting my perfect credit. I want Mahindra finance to send an apology and take them off my credit.Business Response

We appreciate you raising this issue to our attention and the opportunity to respond. Please note that the contract contemplates a transaction for agricultural purposes, and not for consumer purposes.
While MFUSA is sympathetic to Mr. ***** situation, MFUSA believes it has acted appropriately regarding the Retail Installment Contract and Security Agreement entered into between Bull **************** **** (the Customer) and North ******* Tractor LLC (the Dealer) which was subsequently assigned to Mahindra Finance USA LLC (MFUSA).
While we understand the Customer may have experienced issues with the equipment subject to the Agreement (the Equipment), please note that MFUSA is merely the finance company under the Agreement and is not the manufacturer nor the seller of the Equipment. Per the terms of the Agreement, the Customers payment obligations are unconditional and not subject to claims,defenses or counterclaims of any kind or for any reason whatsoever, all of which were expressly waived by the customer as against MFUSA.
However, MFUSA strives to be a valuable partner and resource to its customers. As such, in this particular instance, MFUSA actively coordinated with the Customer to repossess the Equipment at the Customers request. Upon review,MFUSA took possession of the Equipment on or about June 10, 2022. Once MFUSA received possession of the Equipment, it began the sale process, including completing any necessary repairs, obtaining appraisals, conducting searches for other secured parties, finding a buyer, and providing notice of private sale to the necessary parties. On or about August 9, 2022, the equipment was sold via private sale for the appraised value.
Additionally, it is MFUSAs belief that the Customers account has been reported fairly to the credit reporting agencies and that no corrective action is necessary.

On September 21st I made a payment to pay my loan off. I called the next day and asked for them to send my title expeditiously and today October 14th I have still not received it. I was told it was mailed on the October 2nd and still have not received it. Every time I speak with a Representative they are very rude and unprofessional. I bought my side by side utility from ***************** During COVID. I was under the impression it was for 4 years and that it was 0 percent interest. Turning to the merits of the complaint, Mahindra Finance USA LLC (MFUSA) believes the terms of the contract as signed by ************ accurately reflect the terms under which MFUSA approved this transaction. More specifically,this transaction was submitted to MFUSA for approval with an interest rate of 3.99%,which is the rate included in the Contract. The Contract also disclosed the number of payments as 84. Additionally, ************ was provided with a payment schedule which provides the payment amount and due date of the 84 payments.As to the availability of other transaction structures, including various interest rates and manufacturer discounts, MFUSA was not a party to such negotiations. However, it is MFUSAs understanding that *****************, LLC (the Dealer) has not offered 0% interest on UTVs, and such offers have only been available for compact tractors. The interest rate quoted to ************ was provided and submitted by the Dealer to MFUSA. MFUSA performs its underwriting and review based on transactional details a Dealer to MFUSA.
Also,per the terms of the Contract, ************ acknowledged having read the Contract in its entirety before signing.
Lastly, it is important to note that Mr. ***** account with MFUSA is for agricultural/farm purposes and not for consumer purposes.

My agreement number with Mahindra was 000601-0044964-000. On September 28, 2022, I submitted my final payment and payoff of $3,332.94. At that time, I was told that I would receive my payoff letter and official title in 2 weeks time. I did not receive my official payoff letter or title. So, on November 14, 2022, I called and spoke with the ********************* ***********************. She told me that there was a letter mailed out on October 18, 2022. I informed her that I never received the letter and I was also looking for the title. She said that should've been mailed out the same day. She emailed me a copy of the payoff letter and asked if I would check around my neighborhood and see if anyone else recieved it. I did that, checked my old address, and with the post office. No one had received my mail. I emailed her back on November 22, 2022 and told her no one recieved it.I didn't hear back, so I called again on November 29, 2022 and was told that they were checking to see if my title and letter had been sent out and that they will call me back the same day or the next day. No call! So, I called again today, December 5, 2022, and was told that my title and letter was sent out on October 27, 2022 and since I haven't received it, they will send out a securities letter so I can go and purchase a duplicate title to replace the lost one. I asked if I could be reimbursed for that and they told me no. The manager, "Cali" or something to that effect checked with other people at the company to see if there was anything they could do and was told no. I upheld my end of the purchasing agreement and they did not! My title and letter should have been mailed out certified, but was not! Now there is no way of knowing where it is! I now have to pay for something I've already purchased! Also, my identity is at risk of fraud, since the title and letter has my personal information on it!Business Response

Turning to the merits of the complaint, Mahindra Finance USA LLC (MFUSA) has reviewed the complaint and believes it has acted appropriately.
On October 1, 2022, *************************** paid off her account with MFUSA via ACH payment. On or about October 18, 2022, MFUSA sent ***************************, via regular U.S. Mail, a letter indicating her account had been paid in full along with the released title for the related equipment to the address listed on ***************************** account. On November 14, 2022, *************************** called MFUSA to indicate she had not received the paid-in-full letter, nor the released title. In response, the customer service representative emailed a copy of both to ***************************. On November 29, 2022, MFUSA emailed a copy of a No Security Interest Letter to *************************** in an effort to assist in obtaining a duplicate or replacement title.
We believe the experience *************************** had to be an outlier and we acknowledge her frustration, however, MFUSA has acted appropriately and is unable to assist directly with the postal service error. MFUSA is happy to provide any additional documentation needed to obtain a duplicate or replacement title, if requested.

I am rejecting this response because:Hello.
The majority of what was stated in their response was lies. The only copies I received via email was the payoff letter. The only thing I received in the mail was the no securities interest letter. Mahindra Finance needs to do a better job at getting important documents to their customers! They sent my important documents via regular mail. I would like repayment for having to go out of my way to fix their mistake! I paid my account on time and paid it off early. The least that they can do is reimburse me for my trouble.
