      $40 was debited from my account for my final payment but they also cashed the check i sent. i've called for three months. i realize it's only $40 but that's alot of money for me. the four times i've called they tell me my refund is ********** was taken out of my account in april and cashed my check in april also.please help me.thank you,*** ****** ************

      Upon opening this email notice of the complaint, we investigated and immediately reached out to the patient. She paid our third-party billing partner a $40 payment by check, and also paid us a $40 payment directly by credit card, all for the same charge. She was contacting the third-party company, who could see a refund was due, but did not notify us of the concern, and we had not processed the refund. We processed the $40 refund back to her credit card today, and she is aware that this has happened.

      The clinic's web page indicates that they perform cataract surgery in *********. They list ********* Ambulatory Surgery Center as their affiliate under "about us" on their web page. (Although they may have changed the web page now after my complaints. I have screen shots of the original page.)After my 81-year-old husband's 2 hour "cataract evaluation exam", we were told he would have to have surgery in another city, ************. We do not have transportation to get there. We believe that the web page is false advertising and that we are victims of a "bait and switch".We believe that neither our insurance nor us should be held liable for the cost of the evaluation exam. My husband will need for his insurance to pay for another exam at a different clinic.

      This is in response to the complaint submitted to you by **********************
      The nature of the complaint stemmed from a page on the Wolfe Eye Clinic website that indicated a current affiliation with the ********* Ambulatory Surgery Center.We previously did perform cataract surgery at that facility and are in the process of establishing cataract surgical service there again.
       It was an oversight that the ********* Ambulatory Surgery Center location was not removed from that page in the interim, not a nefarious act of bait and switch and the site has been corrected. It was not our intention to mislead, and we feel badly that we inadvertently did.

      Before we were made of the complaint registered with your office, we were aware of the feelings of her and her husband by an online submission from ***** to us on 1/15/24.
       On 1/17/24 we started trying to contact either of them by phone to apologize for the error on the website and let them know that we were not submitting a claim to the insurance company for the evaluation. They incurred no out-of-pocket costs with their insurance plan. The phone call was unsuccessful, and a voice mail left 1/17/24. We unsuccessfully tried to contact by phone again on 1/18/24.
