      We hired Mr ********************** ***** with Landscapes by ********************** in August of this year for leveling of land and landscaping work in two diff. Areas of our home. We paid a deposit of over $11k on August 7th with a written agreement of start of job to be by early September. After he missed the agreed start, we followed up many times in Sept/Oct. as well as requested proof of materials. No response received on proof of purchase, and he had various excuses of not starting in Sept. In October, After multiple attempts to contact without receiving any response, We finally reached him by phone Oct 23rd. He stated difficulty at the same job going on- he needed to paint the house now due to his crew getting stain on the siding but he would arrive at our home next morning. He showed up but without materials or equipment. I politely expressed frustration and concerns job was not started as agreed and he was showing up at our house with yet another statement of why he would not start the job. ************* became angry, yelling at me, and hung up. He then followed up with a text stating he could not start our job after August 25th or any other date after due to ac units being connected. This was his latest made up excuse! We have two different areas of the job where area without units would be the first start of the project. He also did not have ac units being disconnected as a condition of accepting the job/ our deposit/ or condition of the start date! I tried calling back but no answer. I messaged to try work something out and ************* was unresponsive. We have learned, since our final effort to have start date confirmed, that he misrepresented himself. We are a young family with two kids. $11,344, in a sense, taken from us is very difficult for our family. We are reaching BBB as our final route (that is, not through a filing in the legal system against the *** AND a filing against ************* as an individual) to contact ************* /Landscapes By ********************** for return of our deposit.

      Landscapes by Brett visited the customers property to provide an estimate for the job request.  During the initial conversation Landscapes by Brett advised the customer that in order to start on the project 2 A/C units would need to be moved.  The customer provided a non-refundable deposit for the project and the project was scheduled for a general timeframe in September with the stipulation that the start of the project is weather dependent and the A/C had to be moved.  There were 4 requests with 811 to have the necessary lines located on the property and after this was completed the A/C units still had not been moved.  The customer did not schedule the units to be disconnected/moved as agreed upon due to their desire to line up the move date with the start of the project so they would not be uncomfortable with potential hot weather.  *********** they contacted to move the A/C units was not able to accommodate their timeframe so Landscapes by Brett contacted a company that would be able to accommodate the customer.  ******************** by ********************** made it very clear that the customers desire to not complete their required task prevented the start of the project work and even cause supplies to be cancelled.

        With no response from *************/ landscapes by Brett through many different attempts, we now have an active legal case against *************/ Lanscapes by Brett.

      Hello.I paid a deposit for work to be done. I'm requesting money back from my deposit. I paid $5500. At that time the scope of the job was going to be one thing, but as time progressed the scope the of the job changed. I kept the contractor updated many times on all the changes. I also asked the contracted many times if he still wanted to do my job and I was told yes. I gave him an out many times and he did not take it. Within the last few weeks, I asked for money for work he has not done. I actually had to get another contractor to do the work, it was for $1500. He himself told me that I had that money left over from the project. I have asked for that money back now several times and he does not return my calls, he has not come to the house to finish up what he said he was going to do. At times in the past when he did come to my house it was a drag to him, I just knew that he did not want to be there. He never put in a full 3 hours of work. I also changed the scope of his work because of it. He is a one-man small business, and he is lucky if he has help, let alone the right equipment to do the work. There was always some kind of excuse for anything. What is happening now is that he owes me the $1500, plus on top of that the work that he said he was going to complete for me which is additional landscaping around the house which includes edging, plants, and design work. To add with the $1500, is at least another about $1200. So in total I would like my $2700 back. The best part of all of this he said that my orig $5500 is NON-REFUNDABLE... That has never been stated anywhere. I have what he sent me. I was a nice person and give him his deposit right away, and now I want the same back to me. I even said that I would work with him on a solution that would be best for both of use and nothing. I'm disappointed. Please try to get some kind of refund back for me.
