First week of August 2023 cost was $16,000 The agreement was a new driveway and a new patio. The driveway was a little soft, so they brought in some geomat along with rock. Which was a separate charge, within our total amount. They poured the patio and they poured the driveway. We had worries about how muddy the backyard was where the patio would be poured. He said as theres no standing water it will be fine. But after a few days, we noticed there were wet spots that would not go away. They eventually broke, and there were many holes exposed they were filled with mud. Walking around mud was falling off of their boots and into the concrete. It took two months to have somebody come fix those holes and he agreed to get back $1000 which seemed fair for the job on the patio. I also noticed the driveway was poured very thin maybe 2 inches by the garage because i wanted a frost board put down. With the rock and the frost board, they didnt take account the depth. He said if something happens, h*** make it right. Im still waiting for that, granted this crack happened over the winter. Im still waiting for the refund as well. As a paying customer, I just wanted the service that I paid for and nothing more. Ive been very patient and understanding. But at this point, hes just avoiding the problem. The problem is I need the refunded money and he needs to replace a section by my garage. That will make it right

I HIRED ******* IN MAY OF 2021. THE *** WAS TO TEAR DOWN A SMALL RETAINING **** BY MY FRONT DOOR AND REDO IT, POUR NEW STEPS AND RECONDITION SOME OF THE EXISTING STEPS AND PUT A COATING ON THEM. THEY WERE ALSO TO POUR A SMALL *** NEXT TO THE STEPS AND CONNECT THAT TO THE SMALL RETAINING ****, AND POUR A 16X10 PATIO SLAB BEHIND THE HOUSE. THEY MISSED SEVERAL DEADLINES DURING THE SUMMER TO DO THE ***. THEY FINALLY SHOWED ** IN NOVEMBER 2021 TO DO THE ***. THEY POURED THE SMALL *** IN THE WRONG PLACE AND DIDNT CONNECT IT WITH THE **** AS DISCUSSED. ALSO THE COATING ON THE STEPS STARTED PEELING OFF IN LARGE SECTIONS ALMOST IMMEDIATELY. I ASSUME THIS WAS DUE TO THE ***** BY THE **** THEY SHOWED ** TO DO THE *** IN NOVEMBER. I TOLD THEM ABOUT THE PEELING AND THE *** IN THE WRONG SPOT AND THEY CAME OUT TO FIX THE PEELING. RECOATED IT IN THE ***** THAT WERE BAD. IT IMMEDIATELY STARTED PEELING AGAIN. AT THIS **** I TOLD THEM AGAIN THAT THE COATING WAS PEELING AND THAT THEY STILL NEEDED TO FIX THE *** BY CONNECTING IT TO THE **** AS DISCUSSED. I WAS TOLD IT IS TOO LATE TO GET IT DONE THIS YEAR AND THAT I WOULD BE FIRST ON THE LIST IN THE SPRING. THEY ASKED TO BE PAID AND PROMISED TO COME BACK IN THE SPRING TO FINISH THE ***. I PAID THEM WITH THE PROMISE OF FINISHING THE ***. ****** CAME AND THEY TOLD ME AS SOON AS THE ***** ROSE THEY WOULD DO IT. I THEN CALLED AGAIN WHEN THE AVERAGE ***** WERE WELL ABOVE AND THEY SAID THEY COULD DO IT BY JULY 1ST. NEVER CAME. NOW I HAVE SENT TEXTS AND EVEN SENT A REQUEST THROUGH THEIR BIDDING PROCESS TO GET A CALL BACK AND NOTHING. I HAVE CALLED MANY MANY ****S AND NO COMMUNICATION AND IT APPEARS THEY HAVE BLOCKED MY NUMBER. THEY WILL NOT CALL, TEXT, OR COMMUNICATE WITH ME AT ALL AT THIS POINT.

    Business Response

    Date: 09/12/2022

Part of what the customer says is true, and part is not.  He did, in fact, hire us to do the work he described in the spring.  We did not, however, miss several deadlines.  I know this because we do not give our customers deadlines.  We give an approximate start date with a disclaimer that we are a weather dependent business, and schedules change frequently.  Whether we started his job before or after his expected start date, I have no record of, but there were no deadlines to hit or miss.

The size and scope of the job is as he described in his complaint. Where he is either mistaken or being dishonest is when he says the pad was in the wrong place, and didnt connect with the wall as discussed.  This was not what was discussed.  Both my ******* at the time and myself understood that the pad be a specific size, but not connected to the wall. Neither of us recall this being the case.  The customer reached out to me about the pad and we had a discussion about it along with the peeling coating on the steps.  I said we would fix the steps, and as a courtesy we would come back and pour the pad when we had another job in the area. It was explained to him that the pad would be poured when we fixed the coating, and that we would do it first thing in the spring when the temps warmed up.  This courtesy was conditional on another job being in the same area, as it was also explained to the customer that because this pad is not what we discussed initially, we were unwilling to pay the minimum load fee associated with such a small order, which would be around 450$.  It was stated multiple times that we would do them simultaneously.

The job that was in his area was postponed multiple times and then cancelled, so our arrival to pour this pad and fix the patch was delayed. We communicated throughout this process.  Not on the customer's time and schedule, but around a normal business schedule.

The customer has displayed a lack of boundaries when it comes to contacting the business.  He has called and texted well into the night, between 11pm-12am.   Around the time of the last delay, he began calling the business, which is also my cell phone, repeatedly.  Specifically, 4-5 times back to back, multiple days.  At this point, I chose to block his number, as it was apparent that he was very upset and was going to continue calling me in this manner.  Our plan was to get over there and complete this fix and pour the courtesy pad as soon as we had another job in that area, as was discussed, but at that point we refused to be called repeatedly when we had already communicated what was happening.

After this, the customer showed up at our business address, which is also my home address, wanting to talk to me.  It was around 10:00 in the morning so I was out at work, while my wife was at home.  He told her that I had blocked him and he wanted me to contact him.  She stated that she would relay the message.  The customer then continued to express anger towards my wife, raising his voice, and repeating the same statement over and over.  My wife then told him if he didnt get off the property that she would call the police, as she felt the conversation had turned into harassment from his end.

My wife called me immediately after this, crying and frightened.  She asked that I come home because she didnt know what this man was capable of, and that he seemed unstable.

Because of this, and the way he has communicated without boundaries throughout this process, we are unwilling to work with this person any longer.  We will be issuing a refund check of 400$, which covers more than the cost of materials and labor for the stair coating.  He was sent a text message that explained this.

We truly wish we could have showed ** in a better way for this customer, as we strive to do with every customer.  At this point, this is the best we can do.

I am rejecting this response because:
In *********** response to me he stated that they would refund me for the stair coating and a portion of the concrete. The offer only covers the coating as I can see it plus I still have my front step coating peeling. I would like it removed. Also many of his statements are untrue. I told them I wanted the pad butted up to the wall. I did not harass his wife or become irate. I expressed my displeasure that they stopped communicating with me. I stated that I believe they blocked my number. She was very pleasant until she realized I was there to complain and then promptly told me to get off their property which was in fact their home. I expressed that I was only there because it was the listed business address and ONLY because he was ignoring me completely and not communicating whatsoever. I did not calling often until it became obvious to me he was stonewalling me. I honestly didnt know what else to do. No response to either texts or phone calls. That is not the answer. Very displeased with their lack of professionalism and wanting to do the right thing.
    Sincerely,

I am rejecting this response because:

We have still not heard from this business. Ultimately, we would like for them to remove the coating on the steps and complete job as it was originally discussed. In their last response, they offered a refund for $400. Although this is not preferred, we would be willing to accept this if removing the coating is not an option. I can be be reached directly at ************.

    Sincerely,
