I received a call from a customer asking if we would like to purchase his vehicle. I get in the alley way where the vehicle is parked at.  After discussing a purchase price for his vehicle,he inquired about a vehicle that was parked in the same area from his property because the vehicle had been sitting there and he was wanting his parking area.
I told the gentleman we could take it; he would have to sign paperwork so we had his written permission to take it off the property. After the gentlemen signed the paperwork and we called the police department to make sure it was not wanted or missing vehicle. We finished the documentation on it, along with photos of the vehicle. We then proceeded to take it off of the property and put it in our towing yard.
A few days later, a lady called me stating she is the landlord of the property and demanded that the vehicle be returned. I asked her if the vehicle was hers, she said no it was her tenants. I explained to her we cant just return the vehicle without proof of ownership because of liability reasons. If we had returned it without the owner knowing, the owner could bring suit to us if it was previously damaged or missing items. Because we didnt know if the vehicle was inoperable. The landlord proceeded to demand the return of the vehicle, even after I explained the logistics of the situation. I explained again that the registered owner of vehicle is the only person that is able to sign the paperwork in order to retrieve the vehicle.I explained to her again I could not legally just bring it back. She kept demanding saying she is the landlord, but she has no legal rights under these circumstances. I explained to her the rules and the laws we have to obey by and follow. What we did is common practice. All towing companies should obey by there state laws.
She threatened to call the police department and slander us on social media. We went to the police department website and it was on their as information. I told her repeatedly my hands were tied; I could not just bring the vehicle back. I explained to her this is ******** and the liability of the situation. She proceeded to tell me of the two houses on the property, the tenant was still living in one of the houses. The new tenants didnt realize that was the other persons spot. The landlord proceeded to tell me the tenant was using the truck every single day to go to work.  But after all the paperwork was done, we noticed we had records of us towing that vehicle over 1 year ago. The transmission had dumped fluid all over OReillys parking lot. The landlord didnt know that the vehicle hadnt moved in over a year, had no knowledge the vehicle had been inoperable. After the landlord threatened me, I hung up the phone on her. The landlord has no legal rights to tell me what to do with the vehicle because its not hers.
The landlord filed a police report about the situation. We have not yet been contacted by the police.  About ***** days later, the owner of the vehicle called and asked about the truck. I explained to her the situation. The customer had mentioned she sold the vehicle months ago and the new owner was keeping it there for storage. She hasnt claimed her vehicle after all this time, probably because she sold it. By ******** we have so many days to send a certified letter to the registered owner of the vehicle. We proceeded Sending the Certified Letter to the registered owner, which was not even the tenant of the property. The landlord divulged tenants first and last name which is a violation of the privacy act. She broke the law by doing so. I was also contacted by the individual that signed the paperwork; they stated the landlord threatened to evict them for this situation.
The landlord is still convinced that because it is her property, she can demand and have the legal right to have the vehicle brought back. I mentioned to her that even your tenants have legal rights that you cant break. She has rules that she is supposed to follow and she cant break them.As do we as a towing company, we have rules and regulations that we do follow and cant break them.
The landlord does still not understand that we have to obey by laws and rules as she does to her tenants. I would highly recommend to never rent from this person because she seems to think everybody has to follow her rules only.
We work for a number of property owners, some are apartment complexes, some are houses.Yet I have never encountered someone like this that would violate their tenants rights, just to get what they wanted. If any one of our landlord customers did something like this, we would stop working for them immediately. It is wrong what she is trying to do and very unethical.
P.S Her tenant was very surprised when I told her what she was trying to do.
Any questions about this we are open to talk about this. We will not disclose any personal information, but you are welcome to call us if anyone has any questions. Im hoping this is resolved in the right manner.

    Sincerely
    Owner Of Daves Towing
