    On Tuesday, February 14, 2023, I took my automobile to **********************s Automotive. My complaint was that the odometer needle was going up and down and the vehicle was surging. I left my car at **********************s Automotive. On Wednesday, February 15, 2023, I received a call from *** at **********************s Automotive. She said the mechanic could not get the car to surge or the odometer needle to go up and down when they took it out for a test drive. *** told me the mechanic inspected the brakes and rotors and all 4 would need replaced. My reply was o.k. That was all I said. She later called me the afternoon of February 15, 2023, and stated to me that my car was finished and they had put rotors and brake pads all the way around. I said what? *** said the mechanic had replaced all of the brake pads and rotors. I told ******** had not authorized this repair. *** said well when I told you the car needed rotors and brake pads all the way around you said o.k. I told her I said o.k. acknowledging what you said NOT saying o.k. go ahead and repair it. *** stated to me oh Im sorry that was my mistake. A normal prudent person would say after the customer acknowledged the statement of what the mechanic shop wanted to repair is would you like us to make that repair? It will cost X amount of dollars. A contract is not merely a customer saying o.k.*** then told me the repair was $928.00. She didnt tell me PRIOR to repair being made when she called and initially said I needed rotors and brakes all the way around. I said what? I told her I did not have $928.00 and said I never authorized that repair. She also told me that my transmission needed fluid and a flush. I emphatically told her do not do it! I asked *** what can be done about this mistake. I need my car back. *** told me that the owner would not be back until the following week and I would have to wait to speak to the owner when he got back in town, as no vehicle can leave the shop without being paid for. In the meantime, I was without my car for 1 week. I also had called and left a message telling them to put my old parts back on the car. This message was never acknowledged and the old parts were not put back on the car. I have the following rights under ********:You have the right to receive a written or oral estimate for any repair that is expected to cost more than $50, and shops must notify you of this right. Make sure to request a written estimate.The repair shop may not charge you for any repairs that are unnecessary or that you did not authorize.**********************s Automotive did not give me an estimate as required by law and the repair done to my car was not the reason I went up to this repair shop. Further, I do not believe that I needed brakes and rotors and this repair was unnecessary. My odometer needle going up and down has nothing to do with brakes and rotors! In fact, my car still has the same issue it did before they decided to put all new brakes and rotors on my car and charge me $928.00, which is unreasonable and price gouging. I had to borrow the $450.00 and it created a hardship. I am enclosing another estimate from a repair shop showing $200.00 less.When I finally got to meet with the owner, **** **********************, on Tuesday, February 21, 2023. I went into the shop. He was there will ***, the woman that gave the mechanic the go-ahead to put brakes and rotors on my car. He was very defensive when I told him that **********************s Automotive never had a contract with me. I told him that a contract (whether verbal or written) requires a meeting of the minds between 2 parties; and an offer and an acceptance. Neither one of these were met, therefore there was no contract. Mr. ********************** told me if we were going to talk legal the conversation was over and he would get lawyers involved. The only thing he offered to do to settle this mistake (which was the fault of this business, not my fault) was that I had to pay half. I had to pay $450.00 to get my car back. (He thought this was more than fair, as it was both of our faults). It was never my fault! The invoice I enclose only shows the $450.00 I paid, it does not show the original invoice of $928.00. This business was holding my car hostage and if I didnt pay, then they would keep my car until I paid. They knew they had me over a barrel. This business was clearly in the wrong, did not fix what I brought the car in for. In my opinion, this is a deceptive practice by this automotive shop. To date, the odometer needle still goes up and down and the car still surges. This mechanic shop needs to return my money to me.
