My apartment complex has a contract with ***** towing. They also had an improperly marked/ illegal handicap space which I sent photos of, where I have been parking for the past 4 years. On the morning of 10/27/2024 I awoke to my car missing. I called the police thinking it was stolen. The police helped me find it in the tow lot, and the office was the one who told me that the parking space I was towed from was not a legally marked handicap space. I called ***** and advised as such. They argued with me and told me to call Chapel Ridge West apartments to resolve the issue as they have the contract with them and tell them what spots to tow from. ************ said it is up to ***** to know the laws regarding towing and they won't reimburse. ***** says they don't have a manager in office every time I call and that they don't know when a manager will ever be in office as, " they come and go as they please". I've left several messages, no one will respond. I'm going to be seeking resolution in small claims court since no one will respond to my requests to speak to someone. Also, ************ had since put in a legal handicap parking sign, acknowledging that the space was improperly marked to begin with, but only after I threatened to file complaints with the ************************** and the BBB. As such, I'm filing complaints on both organizations. ***************** has also indicated that they have forwarded my complaints on to ****** ******************* as well, so I will file a complaint against them also. All I was asking was the $240.75 to be refunded to me as it was not a legal tow. Both companies are difficult to work with, and unwilling to do the right thing, even though I've provided several pieces of evidence that proves that the space was not legally marked, per the *** and the laws in the state of ****.

This vehicle was removed at the direction of property management as it was parked in a clearly marked handicap spot.

    Per ****

    Signs
Accessible parking spaces must be identified by signs that include the International Symbol of Accessibility. Signs at van-accessible spaces must include the additional phrase van-accessible.
Signs should be mounted so that the lower edge of the sign is at least five (5) feet above the ground. This helps ensure visibility both for motorists and local enforcement officials.

    Exceptions
Small parking lots of four or fewer spaces must have accessible spaces, but those spaces do not need a sign and anyone, with or without a disability, can park in the accessible space. This is intended so very small entities do not have to reserve 25% to 100% of their available parking for individuals with disabilities.
Residential facilities where parking spaces are assigned to specific dwelling units are also not required to post signs at accessible spaces.

I am rejecting this response because: the parking spot was NOT properly marked at the time of the tow, per the photos I have provided. The sign was posted THIS WEEK, the tow took place in October. Also, Chapel Ridge has stated they did specifically order the tow.

    Sincerely,

The ground is clearly marked with an ADA ****** showing it is handicap parking only. There was no obstruction to the ground ****** as you can see in the photos.

To Whom It May Concern,I am writing to file a formal complaint against **** Towing regarding damage to my vehicle while in their care. My car was towed by **** Towing on the direction of the police, entirely out of my control, despite not being intoxicated as alleged. Upon picking up my car from their lot, I noticed clear and significant damage that was not present prior to towing.Specifically, there was a noticeable ding on the door with visible white paint streaks and the rear diffuser was pulled back and clearly scraped. I took detailed, time-stamped photos of my car both before the towing and after retrieving it from **** Towing lot. The before photos clearly show my car in pristine condition, while the after photos show the damage that occurred while under **** custody.I contacted the individual **** Towing directed me to for resolution, and, to my disappointment, I was told that the company is not liable for any damages because it happened in their lot. I find this response unacceptable, as the company had sole custody of my vehicle during this time. It is their responsibility to ensure vehicles in their possession are handled and stored properly.I am deeply upset by this lack of accountability and will be pursuing legal action if necessary. I believe I have a strong case with clear photographic evidence showing the vehicles condition before and after their care. It is not only the financial burden of repairs but also the principle of accountability and trust that has been violated here.I urge the BBB to assist in resolving this matter by holding **** Towing accountable for the damage caused to my vehicle. I am seeking reimbursement for all necessary repairs and a formal acknowledgment of their responsibility in this matter.Thank you for your attention to this issue.

We were called by the Iowa State Patrol on 11/8 at 11:11pm for a Tesla to be impounded because the driver was being arrested on suspected OWI. We dispatched a flatbed wrecker immediately. We were on scene with the officer at 11:27PM. Our driver took multiple pictures before coming in contact with the Tesla and was also observed loading the Tesla onto our flatbed wrecker by the officer. There was nothing done to the vehicle to cause any damage. The Tesla was then transported to our impound lot where it was unloaded and parked. We also have pictures of it in our lot and where there are no vehicles around to come in contact with the Tesla. On top of pictures we have security cameras and reviewed the driver safely unloading and parking the Tesla. After paying the impound fee and retrieving the ***** The owner tried claiming a door ding with white paint was our responsibility. The paint color of our flatbed wrecker is red and black and in our lot there was not another vehicle close enough to come in contact with the Tesla in the area of the white scraped door ding. We have already been in contact with the owner explaining to them all the evidence we have of not being at fault for the door ding and he refuses to accept the facts.

I am rejecting this response because:

You have made it clear you won't provide me with any sort of documentation or photos of my car while in your care.  Your manager was extremely rude on the phone and basically told me I'm wrong and I don't know what I'm talking about and shouldn't have gotten pulled over and arrested.  That's funny because I was not arrested and did not get an OWI.  The car was in your care when it was damaged, I am requesting solid evidence proving that you did no damage to my car.  Furthermore I will be calling the same tow truck out to load my car up and take it somewhere.  We will test this "impossible to cause damage to undercarriage" theory in person.  In the meantime I will get quotes to fix my car.  Also the manager on the phone did mention there is a piece of paper in the lot saying any damages done there is not their fault, and went on saying it was probably a door ding, and he went over the videos and said it did not show my car at all in the video.  I'll take this to court and sue for damages and my time waisted.

    Sincerely,

    ***** *******

Vehicle was towed to company due to being in accident. Police stated there would be no fines for tow and that I would be able to have AAA tow to residence. **** tow is claiming that there is a fee for the tow from scene of accident and time in lot. I feel the company is committing fraud. Vehicle has only been in their lot less than 4 hours.

    Hello,

Whenever we tow a vehicle we require payment. I am not sure what you were told, but once a service is rendered, we need paid. Your complaint is not with us if you were told something differently from someone who is not a representative of our company.
