    On February 10, 2025 I paid online and filled out the form for them to file my MCS-150 biennial update. It has not been filed, they will not return emails and my bank account was immediately charged $97.39. I would like a filing done immediately like requested or a refund immediately

    I recently started a business called ***************************. I chose to file pertinent paperwork with the *** (FMCSA) with American Carrier Services as my limited power of attorney. I was new to business at this time, and knew nothing of the process at this time. I was told (mainly on the phone and online) they would file all paperwork for me to have an operating authority with the Van I recently purchased. They had me sign up with them to obtain my *** number (*******) and MC number (MC01659523). I was charged $535.00 (Inv-081232) for this thinking this was to meet federal and state compliances needed to operate. They informed me I would need insurance at the rate of $750,000. On I went to ******************************** to obtain this policy. I was quoted $1178.42. I began making the payments thinking this was how to get started in business. American Carrier Services classified me incorrectly, as the ***** contacted me last November and told me I was not the status of commercial vehicle due to a weight rating under ****** lbs (GVWR). BiBerk has told me they will not lower the rate, and cannot cancel the policy until I file with the ***** as inactive - this means I have gone out of business officially. I believe that if American Carrier had not done this paperwork improperly, I would have been better off. Can they understand my needs in dealing with 2024's insurance payments of $5892? Will they kindly accept responsibility in putting me on the wrong type of insurance, leading to out of business status? I want the $535 payment refunded fully. I believe they wrongly did my paperwork, which led to to high insurance, and now out of business for me. Please consider this option for compensating me.

    Dear Mr. ***************** you for taking the time to reach out to us regarding your concerns. After further investigation of your account, we have found the following:


    * This DOT account was not created by our company; it appears you created this account on your own and filed your own paperwork. When doing so, you applied for Household Goods. Upon your request, we updated your account to reflect a common carrier status.

    * The invoice in question is unrelated to your filing status or insurance requirements. It covers the Safety Reporting System, UCR, and BOC-3, all of which were provided to you in a timely manner.

    * All paperwork filed on your behalf was done correctly. You were changed to a Common Carrier, and LLC was added to your business name. You were listed as having one CMV. This was filed on August 5, 2024, and processed on August 8, 2024. The ***** assigned your insurance to a value of $750,000 based on the cargo and the weight of the truck. We did not file the weight of the truck; this was done by you when you filed for your DOT number. We have no notes or calls indicating that you informed us your truck was under ****** lbs (GVWR).

    * Lastly, someone other than our company filed an update to your SAFER page on November 13, 2024, and changed your status to Non-CMV. When this was done, you would have needed to request an insurance change from the ***** and from your insurance company.

    Additionally, in your statement, you mentioned, "The ***** contacted me last November and told me I was not the status of a commercial vehicle due to a weight rating under ****** lbs (GVWR)." Please note that the ***** does not contact individuals to inform them of incorrect filings. It is possible that another compliance agency informed you of this and may have incorrectly attributed the error to us.

    Based on the findings listed above, we will not be moving forward with your request for a refund. Thank you again for allowing us the opportunity to review your account.

    I am rejecting this response because:

     

    It is incorrect that American Carrier had nothing to do with my filing back in July with the ****** I filed once to the best of my ability (It was my first time and was not educated in the process) and immediately when that application was complete I began receiving phone calls from businesses wanting to help me with the process. One of these business was American Carrier. They told me I would spend approximately $300 to file everything. Form BOC-3 is a form specifically related to the *****. Also, The *** filling, which I now know to be a $37.00 charge, has to do with a motor carrier (MC) number, or docket number. There is place to obtain this outside the *****. These two forms are directly related to the ***** and the **** After I filed for the first time in July, 2024. American Carrier told me on the phone that, for approximately $300, I would be able to file everything with the ***** with their help. They told me to change a few things with my application, and then file officially. Although I don't have a recording of the phone call, I am sure American Carrier has one. They told me what to place on my new application. This I thought would be sufficient, so I paid their $535.00 fee. This was wrong. I was contacted by the ***** in November, 2024, during a check-up that my van was under ****** lbs. and not a tractor-trailer. This was never not true of my vehicle. American Carrier knowingly informed me to file as 1 commercial vehicle. I want a full refund of $535. If you were not to help me file with the *****, why would I have chosen to pay you for your help? The *** alone cost far less that $535. Please do the right thing. They took full advantage of me being new to this process, for the higher fee. Simply refund it. It has created a financial hardship for me, as the process for cancelling my insurance has proven to be a nightmare, and am left with excessive premiums. I trusted you to help me with a difficult process, and because I had never done it before you filed my information wrongly, although it was all done over the phone. Please consider a refund to be the right thing to do.

Upon reviewing the notes and services associated with your account, I can confirm that all services were completed within the agreed timeline. Our cancellation policy clearly states: "To cancel this transaction, you must mail or deliver a signed and dated copy of this cancellation notice, or any other written notice, to our offices no later than midnight of the third business day after you received this notice." This policy was acknowledged and signed by you in our Terms and Conditions on July 25, 2024.


    Additionally, we have no record of being informed that your vehicle weighs under ****** lbs. All services rendered were based on the information provided during your initial interview call with our administrative team. Given this context, we must uphold our original decision regarding your request for a refund.

    I received email and call from a **** ******, whom stated that he was my assigned Compliance Officer due to me being approved for my, Dot number for my transportation business. **** misled me and advised that this compliance was a requirement to finish up my DOT file. He does not work or have any affiliation with ***** as he led me to believe. I receive no goods no services from this company and I was misled into thinking I had to pay $220 per driver =2 to a total of being charged $440. They are a scam and I received ********** from them. I completed my Dot application by myself and did not need nor request compliance assistance from them. This company is a total scam. Josh * ************* and I will be disputing the charges to my charge card once posted.

    I was a first time applicant for a DOT # this year and was contacted by American Carrier Services by phone who represented themselves as a "contractor for the ****** who would review my *** application. They said the fee for the first time DOT # was $812 which I paid. I now realize this was not legitimate. They do not answer phone calls and I can't get any response from the company. This is 100% a scam and they intentionally misled me into thinking I had to pay their fee to be issued a DOT #.

    We reviewed the complaint sent in by *****************  The services in which **************** was sold, have all been taken care of as far as we can take care of them.  The Safety Reporting System was purchased on 6/15 and completed 6/20.  CA Operating Number was completed on 6/19.  In checking with the ******************* DMV, they stated that they need proof of insurance from **************** in order to activate the ********** MCP.  You will just need to send them a MC65M form for proof of insurance.

    I am rejecting this response because: The "services" they claim to have provided are granted by the ***** regardless of American Carrier Servies involvement. 

    SEE:  " The services in which **************** was sold, have all been taken care of as far as we can take care of them." Which is to say they do NOT take care of anything required to get the *** # or compliance.

    They state: "The Safety Reporting System was purchased on 6/15 and completed 6/20.  CA Operating Number was completed on 6/19..."

    The Safety Reporting System they claim was not even relevant to me and a fictious service. My CA operating number completed on 6/19 was done by me.  All of these "services" are not legit, the CA number would have been issued regardless of American Carrier Servies involvement. 

    They have done nothing other than call me after my info went public when I registered for a ***#, read me back the information I had already provided the ***** (with the intention to confuse me into thinking they were confirming my info on the behalf of the ***** so my application could be processed), and then charged me $812 for the fee again insinuating it was for the *** # and NOT their business profit.  I thought I was was paying the government.

    I never heard from them again after this phone call and cannot reach anyone by phone since.

    AND the number they listed in the BBB response above STILL gets no answer!  This business is a SCAM

    American Carrier Services likes to receive payment but can't be bothered with following through on their contracted obligations. Agents don't return phone calls or emails. They also mislead our company that they were a registered agency with the ***** which they are not!!! False advertising and they never sent documentation for our second driver added to the CDL processing though we paid them $894 originally for first driver plus permitting and then an additional $227.00 for our second driver. I am missing documents, and no one returns phone calls or emails. I have sent email on 7/25/23 and another today but I have left three voicemail messages over the last week, and no one returns phone calls.
