    I bought a 6-session plan from a hypnotist for my anxiety issues at "Boise Hypnosis, *******************, CHt" place of business in Boise (when I still lived there). I just moved back to **************** so I just wanted to get a refund on the sessions I purchased and did not use.He told me to buy the 6-session package ($900) so I can get a deal on the cost/session and he assured me that any unused sessions would never expire and I could get a full refund at any time for the unused sessions (at $150/session). I have tried to contact him for over a month now via email, phone calls, voicemail messages, and his website message board. I have not received ANY response back whatsoever. All I want is a $750 refund for the (5) unused sessions!

    Thanks for reaching out to me. Below you will find my response to this matter.


    In her complaints she claims that she paid $900. This is false. I have the receipt. She paid exactly $774 for a 6 session package.  At the time, I charged $149 for a single session which makes the disputed amount $624. 


    She also intentionally omits key information in her complaints. She fails to mention she was well aware of and agreed to the cancellation policy. I have the physical document with her signature on it. She also fails to mention that she waited 15 months to address this complaint.


    These factors lead me to believe she is acting in bad faith.


    If she can provide evidence that she was in compliance with the cancelation policy or that her other claims that I promised her a refund are true I will consider discussing the disputed amount ($624) further. Otherwise, I consider the matter closed.

    It was not 15 months when I reached out to him on this matter. I reached out to him way sooner before I filed this claim and he straight up ignored all my attempts! 

    As the business owner he should have an appointment book verifying I never had any further appointments, never a no-show and had 0 cancellations. I only booked with him 1 time. I let him know I did not want to book further since I was going back up to WA for family matters and did not know when I'd be back in Boise. He assured me that if I bought the 6-package deal that those sessions would not expire and were refundable, so why he argues that time is a factor in this dispute is baffling.  

     I do not understand why he places that burden on me to prove that I was indeed in 100% compliance to his cancellation policy. He is obviously grasping at straws. He has not provided 1 date where I violated his policy. If he did then he would be lying and I could prove that. 

    I wouldn't know how to go about proving that since I only booked 1 time; only by disclosing 14 months of my call logs & email history to show I never reached out for another appointment? I directly asked him what I needed to show him for proof and he again ignored my direct email again. He has provided no date where I was noncompliant to the cancellation policy because I have never booked outside of the 1 appointment I went to.

     I first reached out on September 8,2022 and did not receive a response to any of my emails, voicemail, or the message sent through his website. I only got a response once I wrote a review over a month later (and that was before I warned him that unless I got a response I would do so). ****** says his average response time is 10 minutes (which is accurate when I first try to book with him in 2021) so that makes me believe he is the one acting in bad faith and ignoring a client who paid good money for services that he has not rendered!
    He's ignored many of my direct attempts to contact him on this matter (a few emails are attached for reference; I can screen grab phone calls). He has been the one acting in bad faith and poor character and I do not understand his hostile behavior towards me when I have tried everything to civilly solve this issue. I only went to a mediator once he clearly ignored me.

    **** told me as long as he was in business that any of my unused sessions would never expire and I could get a refund on any unused sessions, whenever and for whatever reason. That is the only reason why I agreed to the 6-session package since I was between Boise and Washington at the time. 

    I can get further bank statements, appointments & positive covid tests proving I have been in WA most of 2021 and 2022. Why would I book an appointment in Boise when I had been in WA state?

    I am still also confused why the duration of time matters all; there is no paper I signed saying the sessions expire. I had some huge life events happen within the past year and have been living in a different state so I was not able to get to this matter sooner.

    I believed it was $150/session and I had bought 6, but I didn't realize I got a deal and it was less than what I claimed in my complaint so I apologize for that discrepancy. 

    All I want is a refund of the $624. It is my money, why can't I get it back when he has not rendered any of those services to me and he clearly disclosed that he offers refunds for unused sessions.
