      Hired company to help complete **** exchange. Company failed to release ******* money on time, and refused to release ******* money as a stand alone transaction as requested, putting us out of contract on our purchase to complete ****. Company contacted us stating they were cancelling transaction without our knowledge. They refused to complete the transaction as originally contracted. Forced us to sign a release in order to receive our money. If we didn't sign release, our purchase would have fallen through due to being out of contract with no fault of our own. Contacted company multiple times to request refund of fees paid and they refused to acknowledge any wrongdoing, except in the last email where they admitted to not releasing ******* money and still will not refund. They charged $750 for their **** service but never completed the service for the reasons described above. Due to their mistakes we should be entitled to a refund. We would have and had every intention of completing exchange through their company until we were out of contract.

      Firstly, we acknowledge the importance of customer satisfaction and strive to address any issues promptly and fairly. Upon thorough examination of this case with ********************, it is our stance that his request for a refund is not eligible based on our company's policies.

      Our records indicate that the services in question were provided in accordance with the terms agreed upon at the time ************************ **** file was opened. We have also reviewed the correspondence and interactions between our company and ********************, and it appears that our team diligently addressed any concerns raised during the course of our engagement. Additionally, our team went further in advising ******************** that the property he identified for his  exchange was not like-kind property as outlined under Internal Revenue Code (IRC) Section **** guidelines. Failure to follow said rules has the potential to trigger unwanted tax consequences for the client.

      Lastly, in an email to received by one of our staff dated Tuesday, September 26, 2023 at 8:19pm MST, ******************** instructed our company to cancel his **** exchange which contradicts his claim that we closed his file without his knowledge.

      We understand that sometimes situations may arise that lead to dissatisfaction, and we sincerely apologize if ******************** was not completely satisfied with the outcome. However, in light of this unique situation, a refund of fees for services rendered is not warranted in this case

      I am rejecting this response because:

      The company did not fulfill their end of the contract and did not timely deposit the ******* money for the transaction into the proper account. Therefore we had no choice but to cancel the **** in order to keep the real estate contract valid. The company refused to deposit ****** money into the account when contacted and told us we must cancel or wait until closing date for funds which put us out of contract for our real estate transaction as ****************** was required 3 days after mutual acceptance. Any real estate transaction would not be valid without proper deposit of ******************. Company still refuses to acknowledge this and has offered no apology.
