On Sept 22, 2023 we went to look at an ** and found one we liked. The dealer suggested we put a $1000 deposit down to hold it while we try to obtain a truck to tow it and secure the money to purchase it. They had us fill out all purchase agreements. Well, we couldn't obtain a truck to pull it as they kept getting sold out from under us at numerous dealerships. We told this to the dealer and they said they would continue to hold it until we found a truck. After 6 weeks, we still could not find a truck and then money we had to purchase it fell through. When we told this to the dealer, they said they contacted "the owner" and he refuses to return the $1000 because he had taken the ** off the market for 2 months when he could have had it sold. We were told by the dealer, we could get it back whey we first contacted them about the unit. All we want is our $1000 back.

    Business Response

Here is the full context and transaction as we see it.

*************** contacted us by phone on Sept 9th and worked with one of our salepeople, asking about option discussing trade values.  Our saleperson put together a Buyers Order that was sent to the Powells for consideration.  Being that the Powells were out of state our saleperson offered to take a deposit to hold the unit until they cold come see it in person to verify its features and conditions.  They declided to place a deposit on the unit at that time.  A few weeks later they again contacted our salesperson and asked if the unit was still available and then scheduled a time to come see the unit in person.  That day was the 22nd of September, this wasnt a rushed purchase.  They walked through the unit and decided that that was the one they wanted to buy.  They at this completed all purchasing paperwork for the 5th wheel including signing an application for title, an extended warranty, and the application of a paint a fabric protection product.  They gave us a $1000 down payment and stated they would bring the balance due and their trade in when they picked up the 5th wheel.  This was not a "hold it unitl i decide deposit", this was a down payment for the purchase of the 5th wheel as all of the paperwork clearly shows.

Not only did we lose the ability to sell this unit to anyone else for the last 2 months, but we have also applied products to the 5th wheel at their request. They used the excuse that they couldn't find a truck to purchase to tow the 5th wheel, but in his texting with the salesperson he referenced that he was tied up with lawyers and stating that he lost $250k and wanted to back out of the deal.  We were more than happy to release him from the obligation of following through on this deal at this time and we even told him that we would apply his down payment towards any future purchase and we still stand by this.

If he wishes to move forward with any RV purchase from us he has his $1000 down payment that we will apply towards that purchase.
