      My daughter rents an apartment with Brennan Properties, LLC in ****** *****. I am a cosigner on that lease. She is roommates with 2 other girls. My daughter and one of the roommate emailed the landlord and asked about moving out early. The landlord emailed them back saying they could pay a few and she would make an addendum. My daughter signed a new lease at another location and moved in there. The landlord is now saying she was confused and gave them bad information after they already signed a new lease. Our lease agreement with Brennan Properties states that we can do a roommate change during the lease. The landlord is now staying that we can't do a roommate change wouldn't everyone agreeing, even though that's not stated anywhere in the contract. My daughter is now on the hook for $1600 because the landlord gave us bad information and is refusing to allow a roommate change because the remaining roommate won't agree. The landlord has a friendship/personal relationship with *******, the remaining roommate because her brother previously lived in these units and helped her take care of her dog.

      This issue is not yet resolved. When you sent me the email with the business response it was just that they needed more time to review. Because it wasnt a message to address the problem at all, I didnt realize that you would close the case.

      The complaint is on a 3-bedroom rental where three roommates rented an apartment from us together under one lease, not three individual leases.  There appears to have been internal issues come up between the three roommates, with two of them moving out and wanting to be removed from the lease and all the financial obligations of the lease terms.  We have language in the lease for residents to default, however they are still required to pay the lease costs until the unit is released.  It becomes a little harder when there are three equal people on the lease, and they later don't agree.  It may feel to some that they should be able to be let out of their financial obligations, however we don't feel it is fair to harm us financially for something we did not cause and have no control over curing (the divide between existing equal roommates) 

      Some of the original complaint is about being told they could do something and that was later changed by our office personnel.  Our lease has a clause for defaulting and many of the things that we are accused of appear to be related to understand the language of the lease and supplemental documents and requirements to be able to default that the party didn't to sign.  In addition, there was suggestions that there are people needing places and we should be able to rent to them to make the issue go away.  Concerning that, the unit was not rented to three individual people that were standalone residents, the three people on the lease came to us and wanted to rent one unit together and as such we do not have anything in the lease allowing us to come in at a later day that allows us to tell any or all of them we are going to add another person or persons to the lease, they can change roommates easily, but in this case i don't see any evidence that the two parties that left found other roommates to replace them that the third roommate agreed to.  We do roommate changes all the time, but that is all driven by the wishes of the current tenants

      If there are phone recordings i would be glad to review them to be able to properly respond.  My best guess would be our office provided some potential suggestions based on what they understood one party was explaining the situation as only to later discover that the other related parties were not in agreement.  The lease and all related documents that are required to be executed to default on a lease are in writing and i believe this really is an issue with the other party not agreeing with the outcome of our determination of the documents.  The other two residents and their co-signers came up with a solution, which is the only way we believe it could be resolved, and they are in the final stages of resolution.  We are waiting for final signatures and keys returned.  The other two parties who are not part of this complaint are taking over enough financial responsibility to allow the one resident still in the unit to get remain until the end of the lease.  This was all worked out between the parties of the lease, we just worked to facilitate their solution.  

      We have tenants and parents that have conditions change after they are in the leases and many would prefer not to complete their obligations, however we in good faith provided the lease up front, require all parties to agree by signing prior to any actual move in is allowed.  We believe we try to help in all those conditions; however, we have legal obligations to the lessee's as well and we have to honor those as well
