      Based on the things the auction is responsible for it list engine, transmission, steering and brakes. From the time I picked up the vahicle it had the check engine light on and started very rough barely at all. I brought this up to them once I got it home and called to ask when I should be getting title. They told me when I should be getting title but dismissed the issue. I called again when the title took longer than expected and brought this up again and the person said if I would've let them know sooner they could've seen what they could do to help. This seems to be a common response based on the reviews I've seen. I have since taken it to a mechanic to be disgnosed and they said it needs new timing chains and cam phasers both engine issue related things. This as you can see by the listing was not disclosed which is their responsiblty and would've been impossible to not know it had engine issues based on how it started and the check engine light. I have reached out to see how they will make it right and no reponse, so now I am reaching out to you. The repairs will cost me $3000 which is a cheaper estimate I was able to get. For their lack of fulfilling their reposnsiblty when listing the vehicle what I am looking for is payment for the repairs as well as $1000 for having to have it on my insurance longer than neccessary and having to take time off work and time spent to find out what is wrong with it.

      The Infiniti was purchased in our 3/20/25 sale with 106,644 miles on the odometer. The customer picked up the vehicle 3/21/25.

      During our assessment with the vehicle and our short courtesy 1.5 mile test drive, we found that the vehicle ran and drove okay for us. In the listing, we photo the odometer while the vehicle is running, which clearly shows a check engine light on. We do not list check engine lights in our descriptions of the vehicles, nor is it our responsibility to run codes or diagnose vehicles. We are open for viewing for 2 full days prior to the auction closing, this is the time when customers can come inspect the vehicles, and run codes on them, even bring a mechanic with them to assess the condition. I understand that this buyer did not utilize the preview days and purchased the vehicle sight unseen from Utah. 

      The terms and conditions of our auction have to be agreed to in order to participate. Our terms and conditions state: 
      Every vehicle is being sold “as is,” including any and all defects, and without any warranties, express or implied. 
      All implied warranties, including those of merchantability and fitness for a particular purpose, are expressly disclaimed by TAID and waived by me. This waiver of implied warranties was specifically bargained for and that absent my agreement to it, I would not be allowed to participate in this auction. 
      I am assuming the entire risk that a vehicle I purchase will have defects, whether present now or arising in the future, whether visible or hidden, including, but not limited to, defects in the paint, windows, tires, frame, doors, brakes, steering, engine block, drive train, sensors, display, interior, transmission, fuel systems, suspension, tubes, electronic components, and each and every other part. I understand that defects in a vehicle I purchase may render it inoperable or unsafe to drive. Despite knowing these risks, I agree that TAID, its owners, and employees and agents shall not be liable for any defects in any automobile I purchase, for any reason, whatsoever. I agree to hold TAID harmless from and against any and all claims, liability and damages with respect to any defect in any automobile I purchase. 
      TAID and its owners, employees and agents act merely as agents for Sellers. Statements regarding the description and condition of the automobiles made by the owners, employees and agents of TAID, including those made on its website, advertising, auction materials and the auction itself, are based on a rudimentary vehicle inspection and a short drive of up to 1.5 miles. I understand that all statements by TAID are not intended to be relied upon by me, may contain errors, and I agree that I am not purchasing in reliance on those statements. I understand that all statements by TAID regarding the description and condition of any vehicle are expressly disclaimed and do not constitute any promise, covenant, agreement or warranty. 
      Every vehicle is available for inspection prior to the auction, and that it is my sole responsibility to determine the condition of a vehicle prior to purchase. 
      By making a bid, I am making an offer to purchase the vehicle at the bid price, which if accepted, forms a binding contract to purchase the vehicle between TAID and myself. I understand that any such contract includes the terms in this Acknowledgment. 
      Purchases may not be removed from the premises until payment in full is received. I understand that if payment is made by means other than cash or certified funds, the property will not be released from the premises until the funds are clear and received. 
      I may not rescind or challenge a purchase for any reason, including later dissatisfaction or discovery of defects. 

      Upon payment and pickup the customer signed the as-is no warranty and the implied warranty negotiation statement stating the vehicle is purchased as is where is with no warranty. 

      The customer purchased this vehicle from Nampa, Idaho and drove it to Eagle Mountain, Utah. This is roughly a 6 hour drive or 393 miles based on google maps. 

      We received a phone call from the customer stated the vehicle had something going on with the engine the Monday or Tuesday after the auction 3/24 or 3/25. He had driven the vehicle roughly 393 miles at this point before notifying us that he thought it had an issue. At this point, we cannot do anything for him. Had he notified us 50 miles down the road that something was going on and that he could not limp it 300+ miles back to Utah, we would have had a better chance to rectify the issue quickly.  However, I cannot do anything when the vehicle has had that many miles put on it. I cannot return a car to a consigner with over 300 miles on the odometer.  These are used vehicles purchased as is where is regardless of our courtesy assessment. The full responsibility to inspect the vehicles prior to purchase is on the buyer. We do a courtesy test drive of 1.5 miles and we did not notice issues during the time it was in our possession, therefore we have no way to know if we missed an issue or if something happened during his 300+ mile drive home. 

      If he had stopped as soon as he noticed the issue and called in, as he said we would have been able to get the car back and have a mechanic diagnose it and continue the arbitration process from there with the consigner. However, he did not inform us of the issue until he had made it home in the Infiniti, to Utah, 300+ miles away.

      If he noticed the issue immediately when picking up the vehicle as stated, I don’t understand why he drove it all the way home, 300+ miles to Utah, and didn’t turn around and come back in and say hey, I cant drive this to Utah. He states in an emailed complaint that the vehicle “started rough” and that “I have not been able to drive it with concern of what may be wrong with it” yet, he was able to drive it successfully back to Utah. He also states that “the issue would’ve been difficult to not notice based on how it started” Yet, he didn’t come in when he was in the parking lot and say, something is wrong. Our test drives are based off the drivability of the vehicle, which this vehicle clearly drove all the way to Utah. 

      Per the Carfax report, the vehicle was serviced 3/24/25 in Orem, UT with 107,076 miles. 
      Carfax states “Vehicle Serviced” – Maintenance inspection completed, recommended maintenance performed, battery/charging system checked, body lubricated, oil and filter changed, tire condition and pressure checked, tires rotated, vehicle washed/detailed” 


      Overall, these vehicles are purchased as-is where-is with no warranty of any kind regardless of the vehicle descriptions. The customer drove away with the vehicle with the odometer reading 106,644 and didn’t call us until the odometer read 107,076 miles. He drove it a grand total of 432 miles before contacting us. If the vehicle was driving so poorly I’m not sure how it made it 432 before getting it checked out. 

      The customer also complained about how long it took to receive the title. It is stated that out of state titles take up to 30 days. His title was mailed out 4/16- less than 30 days from purchase. The customer still, to this day 6/12/25 has not transferred that title into his name, though it was delivered to his address 4/18/25 at 2:39pm per the USPS tracking number.
