SEPT 8 THROUGH SEPT 16, 2022 I paid Concuer Concrete *** for concrete work at my home. They performed the work, but at a very low level of quality. They came back and completed the work properly, but then did not pay the concrete suppliers for the concrete. The concrete supplier now wants me to pay the $4,392.00 plus $350 filing fee and attorney fees. They have files a lien. They have a no luck collecting the money from Concuer Concrete and I can not get them to pay me to pay them as well. I want the money to pay the concrete supplier and warn other people of this unethical and act of theft. They can refund me $7,000.00

On June 7, 2022, I hired Conquer Concrete to come pour 850sqft of concrete in my backyard. I filmed and took pictures of the whole process. ******, the business owner, dealt directly with me the whole time as his other workers didnt speak much English- if any. The contract stated they would move the sprinklers. They didnt. I paid for it and they accepted payment. They failed to show up five times to fix mistakes and clean up after the date of the pour. I had a kid pool full of concrete in the street blocking the driveway. They left my return gate on the ground. Ruined my grass. Hit my fence with heavy machinery. Splashed concrete on my house. Rebar was to be two feet on center. They laid it closer to 3.5 feet. They had a pile of rebar in the front yard they were trying to hide and I told them it wasnt what we agreed to so they pulled it out and 3.5 feet was the best they could manage. They made one pass to compact the gravel under-payment. The stamp I chose was different from the one they rented. **** took the stamps to get new ones but the rental company already rented them out. By that time the concrete was starting to dry. He started working the slab so it wouldnt set. He sprayed one side with a solution he said was supposed to help draw the water out and it stained the concrete when he didnt come back to wash it off. Contract stated stamp and color and he only stamped one of three slabs. He double stamped sections of the main slab. I voiced my disapproval and he said he would fix it. Came over almost a month and several attempts later to demo the stairs going to the house and left leaving a step of almost 20. He said he would come back the next week to pour the new steps. Never showed. No response. Finally got a hold of him and said he wasn't coming back violating our agreement and breaching contract to service concrete for five years and finish the job. I still have concrete blocks I picked up from ********** where his steps should be.

On the day that we started prepping, the grass unfortunately did get damaged because of machine but we went back to fix the grass. The discoloration that customer is talking about was due to rain, which putting sealer on it wouldve fixed that. I offered to put the sealer on for free, which sealer originally is an extra charge, but customer declined the offer. We went back on Saturday to rip out and redo the steps that customer didnt like, were planning to pour the following Monday since the concrete dispatch isnt opened on weekends. I was more than willing to fix whatever client wanted to redo but client started to harass me because I couldnt pour steps the same day, client started calling me out of my name. I decided to walk away from the job and told the client to not pay me the rest of the money. I only received 50% of payment from the project because I also did a back patio. I was not paid in full. Client still kept sending me messages after and was very disrespectful. I did not respond anymore. Contract was breached because I was never paid for full job.

I am rejecting this response because:

**** said he was going to come four times to fix the steps and ended up showing up to demo steps and left leaving a dangerous ledge and uneven jagged concrete on Saturday, July 2, 2022 when the job was poured on June 8, 2022. I have 3 kids under 7 that have fallen multiple times trying to get in and out of the backyard. If they couldn't get concrete, then they should have communicated that and came back to demo another day instead of leaving a ledge and no steps. He made it hard to believe this wasn't going to be an ongoing issue due to all the times he said he was going to be there and did not show. Always an excuse. He failed to come back until a week after to clean up his mess and put my fence back up after they took it down.

I was very polite the entire transaction and very accommodating towards his constant scheduling mistakes and no shows. The concrete slopes towards the house, set up different from left to right, discolored throughout, I told him to rip it out, he was supposed to stamp all of the pours, he never moved sprinklers, all of these were breaches of contract. I still have water under the pads coming from the pipe they never moved and sprinklers that don't work because they cut them off.

I gave 50% upfront and was going to give 50% upon completion as I was contractually obligated to do. Contractor never finished job and told me to keep the money because he didn't want to come back and fix his mistakes.

    Sincerely,
