On 09/26/2022 I filled out a factoring application with Truckstop. I was merely shopping around for factoring companies. Shorty after, I received confirmation that my application was approved, and *********************** sent me closing documents. I did NOT sign the closing documents because I decided to partner with a different factoring company. The emails I received from Truckstop discussed a potential partnership, but I never confirmed via contract that Truckstop was my factoring company. I submitted invoices to my current factoring company, and I received a correspondence indicating that Truckstop filed a financing statement on my behalf, so I would have to get released from Truckstop before moving forward with my factoring company of choice. Truckstop informed me that I or my new factoring company would have to pay a $500 fee for Truckstop onboarding me. The clause in Truckstops agreement is unconscionable, Truckstop exercised undue influence over me, and paying them $500 for a service I NEVER used will unjustly enrich them! The terminology in their application is vague because I basically am being charged $500 for submitting an application with Truckstop when Truckstop never conferred any benefit to me. They are negatively affecting my business and other businesses should avoid this company all costs!!

Truckstop.com has been in continual contact with **************  He is not happy that in the contract he signed with our factoring team that there is a $500 early withdrawal fee which is clearly spelled out in his contract (see attached).  ***************** have talked to ************** and helped him go to another factoring company.

I am rejecting this response because: I never signed the closing documents, thus, the contract clause you attached is without merit. Further, I never used your company. Your company charges POTENTIAL clients $500 whether they decide to use your company or not. As stated before, your company charges a $500 fee just to fill out an application, then you use predatory contract language to disguise it as something it is not. Watch out for this company at all costs!!

      Sincerely,

      *******************

I have been using the Truckstop ********** services since 2016 on a month-to-month basis. my last month to month account # was ***********. This account was reactivated April 23,2021. Whenever I reactivate my account, I was asked to pay in advance. I learned this pass Friday 8/9/2022, that I unknowingly entered into a Termed Account/ contract with a rep by the name of ***********************, with the account number of #***********, for the term of one year, according to TruckStops billing information. I was never contacted concerning this matter until October 6,2022, when I tried to reactivate my account again. According to their billing department, I have a past due balance of $789.00. The past due Termed account/ contract was from October 26,2020. I was also told by a Truckstop representatives that term accounts are used for large companies. I am a 1-man operations. I have never been put into a term account using their services before, and it was not explained to me that I was entering into a contract. I am asking TruckStop to correct this issue and remove this balance from my account so I can us their services again. I was never contacted or notified about this issue until 2 years later. However, I was not allowed to correct this matter before it escalated.

This is the second complaint that ****************** has filed with BBB within a year. ****************** desires to obtain an account however has not fulfilled her contract. Per collections Truckstop.com does require her to pay back the past due balance on her prior termed account as she has cancelled her payments to us. We just ask her to fulfil her agreement before we will give her account back. She claims she didn't know about her contract however she signed with docusign. She has attached her signed contract to her BBB complaint clearly demonstrating she knows about the contract.

I am rejecting this response because: I never stated that I did not sign the contract, however, I stated that I was not told that this was a TERM Account / 1 year contract. I called into TruckStop several times in the past and requested for my same month to month account to be reactivated, and I was given the same steps to follow to reactivate my account as I was given to inter into this TERM ACCOUNT/ one year contract. Because the process was exactly the same as the month-to-month subscription I was not aware that I was signing into a 1-year TERM CONTRACT with the same process. I was even told to pay in advance as if I was reactivating my old account as I was told several times when I reactivate my account. I had never heard of a Term Account until 2 weeks ago.  And I never request to be put into a different kind of account, I always ask for my account to be reinstated. I am requesting that you please resolve this balance, because it was created in era.

And to correct the statement you made concerning I filed a complaint with BBB 2 times within this year. My last complaint was filed in the year of 2020, it is now 2022.

      Sincerely,

      *****************************

I have a subscription with truckstop.com and there's no way to cancel it even though they claim you can do it online, the option isn't available online and no one will answer their phone. It says cancelation pending but yet I had never requested a cancelation prior and I'm still being billed so in my opinion it's their way of preventing me or anyone to be able to follow the instructions on cancelation online.

** or about March 20, I receive a call from collections agency stating on behalf of Truck Stop they attempting to collect a debt that I wasnt aware of. ** or about **** I pay the debt with the collection agency. I was advised to wait **** days for my account to update and for Truckstop to reactive my account. Every week since the 2nd week of April I have been calling Truckstop to either get my account reinstated or get a release letter. Every week its a different story from a different rep. ** April 10th I completed the general release form and waited the 30 days before calling for a status. This company is refusing to reinstate my account and they are refusing to release my account. Over this 3 month period my business has not been able to collect any revenue because Truckstop is listed as our factoring company. I have email communication from the collection agency and Truckstop. 3 months is more than enough time to have this matter resolved. The purpose of this request is to get help with this matter and get a release that is no longer holding up to their end of the contract. My business is on the verge of going out of business because of Truckstop stubbornness.

On 1/2021 **************** Carrier LLC entered in a non-recourse factoring of invoices agreement with Truckstop.com/factoring. On 3-19-21 **************** Carrier contact Truckstop factoring via email with all required documents that Truckstop factoring requires to factor an invoice. In which I was told they were unable to factor this particular invoice due to not getting a hold of someone from the company whos responsible for accounts payable, I would have to **** them directly. Then on June 21, 21 Truckstop factoring sent charm city motor carrier a email to resolve invoice #DS3513427 , which is the same invoice that I was told the will not factor. After the review of accounts Charm City do see were truck stop made payment to account , and also states that I was paid from original debtor of invoice which is false. The factor agreement we agreed on is non-recourse and Truckstop assumes all responsibilities of unpaid invoices except under the following conditions 1. Claims,Damages, and shortages 2. Pallet charges 3. Incorrect or incomplete paperwork 4. Unauthorized lumpers 5. Advances not deducted at the time of factoring 6. Payments made directly to the carrier from Broker or shipper on loads that were factored by Truckstop.com factoring.Charm city ask Truckstop to provide documentation where it shows charm city motor carrier were paid by original debtor(broker), they did not, I was referred to a third party (Veri Core)who was responsible for collecting Truckstop Debt. On 2-3-22 I requested all documents from Veri noReply 5-17-22 contacted Veri Core *********************** to request the same documents requested from Truckstop after unable to get those documents from Truckstop Veri Core closed my accounts with them and referred me to Truckstop per ***********************. On 5-18-22 **************** carrier contact Truckstop about this matter in which they cant talk to me about this I have to deal with VeriCore after I repeatedly inform them that my account with Veri core is closed.
