    The contractor, **** ********, has essentially stolen $13,006.20 of mine. The 'phase one' deposit in the amount of $13,900.00 was given on 6/27/24 with ck# ***. Phase one was to include the following:1. Excavation - $4,500.00 (not performed)2. Concrete - $5,000.00 (not performed)3. Drafting - $1,000.00 (ended up costing $806.25)4. Engineering - $0 5. Permiting - $900.00 (not complete)6. Labor cost - $2,500.00 (nothing performed)Total: $13,900.00 The only thing completed in 'phase one', as outlined, was the cost of the draftsman ($806.25). If I deduct the payment made to the draftsman, the remaining balance is $13,093.75. I contacted the City of Coeur d'Alene & was informed that a "Plan Review Fee" was due at the time of submittal. The total for this fee was $87.55. Nothing else has been paid towards the cost of the permit thus far. If I deduct the "Plan Review Fee" from $13,093.75, that would leave $13,006.20 owed to me for 'phase one'.The contractor did partially complete the existing kitchen floor project with customer provided tile. The agreed upon *** for the existing kitchen floor is $2,300, all-inclusive, if done separately. The contractor stopped replying to & skirted around my requests for add'l information in regard to the upcoming addition project. The contractor stated that the kitchen floor project was built into the overall addition in the estimate. Flooring is listed in phase 4 totaling $3,000 (new AND existing combined). In that case, he should only be owed $1,500 (half of the estimate) now. He doesn't have the legal right to unilaterally change the agreed-upon terms. The local pricing is irrelevant. He is fully aware that he agreed on a $2,300, all-inclusive, price for the existing kitchen floor. If I deduct the fixed price of $2,300 for the kitchen floor only project (once satisfactorily completed) from $13,006.20, that would leave $10,706.20 owed to me. He has put me in a position of great economic loss. He neglected to meet plans.
