    I left my previous employer on June 28. Within the 30 day grace ****** alotted by ******* I attempted to use my FSA card to purchase items from their online FSA store. When the card wouldnt work, I contacted their customer service line to let them know my card was no longer working. A representative told me the *** card stopped working my last day of employment (June 28) and that now I would need to purchase items out of pocket and submit a claim for reimbursement. And further, that I would have until Sept 26th to do so.I followed the instructions provided to me by ******* and upon submitting a claim for the *** store purchases, the claim was denied as it was beyond June 28th. This was not what I was told over the phone and now I am out $1300 from *** account, plus I have $1300 of band-aids and pepto bismol that I purchased out of pocket SOLELY to recoup the funds in my *** ********** a second mistake, the company reimbursed me for order ****** but refuses to do so for order ******. Both orders were made the same date&time, how can 1 be reimbursed but not the other?? How can a company provide me incorrect information, resulting in the loss of my money, and not be held accountable?! It is ALL MY MONEY - I'm not trying to get something for nothing. This is my hard earned cash they are refusing to fork over and are standing behind one of their employees mistakes as the reason for denying me MY MONEY!Their behavior is without integrity or accountability and this must be corrected.

    Dear Mr. Venden,

    We have provided several responses directly with you regarding this complaint.  Per the plan rules, expenses cannot be incurred after your last day of employment.  This was explained by the team at Peak One, available in the online portal and mobile app, as well as in a letter sent to you by your previous employer.  You had until the deadline to submit expenses with a date of service on or before your last day of employment, which is why your debit card could not be used after your termination date.  We have apologized for any misunderstanding of the plan rules, but have to abide by the plan rules and cannot approve your claim.  I want to clarify that you had a balance of $1,261.35, which included a rollover from 2023 of $248.32.  You contributed approximately $780.00 and spent $546.97 of those contributions for the 2024 plan year.  We understand you are frustrated, but as we have stated, we must follow the plan rules to keep the plan in compliance.  We appreciate your understanding.

    I am rejecting this response because:  I contacted YOUR company with a question.  YOUR representative instructed me to spend money out of my own pocket on the FSA online Store YOU directed me to.  This was after my last date of employment.  If YOUR employee had said, sorry Mr. Venden you can no longer get reimbursed for those funds this wouldn't be an issue.   Instead, I followed YOUR company's instructions and, whether these instructions were correct/incorrect/whatever, as a direct result of following YOUR instructions, I am out roughly $2600 of MY MONEY.  I am not asking for any money from the company that wasn't mine to begin with.  I followed the instructions provided by YOUR company representative and your response was "tough shit" we screwed up and you lost money.  

    That is UNACCEPTABLE no matter what policy or rules or whatever crap you try to pawn this off as.  YOU told me wrong, you made several mistakes and I lost MY MONEY.

    Make it right, please.  I can't believe this is such a difficult thing for your brains to process?!  If I walked up to you on the street and offered you a service for $20 and then you wanted the service and I said, oh but to get $20 worth of the service, you need to pay us $20 more dollars of your money.  And then, after taking your $40 I just turn and walk away.  THAT IS CALLED STEALING.   

    You stole MY MONEY, now give it back!!  This is so ridiculously inhuman and pathetically corporate.  Where are your hearts?!  Better yet, where are your brains?!!

    To whom it may concern,

    We have worked with this participant multiple times to explain the plan rules and policies, which is the reason his claim was denied.  This claim is for an FSA plan, Section 125, and has specific rules to follow per compliance and regulations.  He did submit an appeal, which was reviewed and denied due to the plan rules.  His previous employer is aware of his aggressive and inappropriate interactions with our staff, as well as the appeal.  They denied the appeal because they notified him of the plan rules as well.  We cannot approve this claim and did not "steal" his money as he claims.  He had deadlines to submit claims with a date of service on or before his term date.  This was stated in the letter he received from his previous employer.  We do not agree with his complaint as we were following the plan rules.  He has sent multiple emails and messages in claim submissions with unprofessional language as well.  He was asked to stop sending those emails and has now filed this complaint.  If you need copies of his emails or the letter his employer sent, please let us know.  At this time, we do not agree with his complaint and this matter is closed as we were following the plan rules.
