    *********************** came and gave us a bid on a bathroom. His quote required a deposit of 50% down. June 9, 2023 I signed the contract and gave him the deposit of $3554.87 in order to get on his schedule and he would let us know the exact start date. He said he would email us a copy of the contract. After contacting him several times he finally sent us a copy of the contract days later. I then texted him asking when the start date would be. After multiple attempts to contact him he informed me that we were on schedule to start July 31st. I texted him on July 30th to ask if he was still planning on starting our job July 31st and no response. After multiple attempts to get in contact with ************ he finally responded "I'm currently trying to reschedule some things to fit everything in." I responded and asked him when he was needing to reschedule to & again no response. After multiple attempts to contact him asking when he was needing to reschedule, he never responded. I then let him know that we would like to cancel our contract and get our deposit back. He emailed over a cancellation agreement (again after multiple attempts to contact him) and texted us letting us know that once the cancellation was signed he would forward it to his accountant for a refund. August 3, 2023 i signed the cancellation and emailed it back. On August 4, 2023 he texted me stating that the contract cancellation had been sent to his accountant and once it was ready he would call me. After multiple attempts to ask him how long that would take his accountant and when we could expect our deposit back, he responded saying that I was harassing him and that he would turn this matter over to his attorney if need be. I never once harassed ************. We got a lawyer involved who was able to get in contact with ************ on August 15, ***************************************************** the next 2 weeks which would be August 29, 2023. That date came and went and we never got anything back. Our lawyer tried getting in contact with ************ again to ask if he had any update before we start legal proceedings against him. So far, we have not been able to get in contact with him and have not heard from him at all. Unfortunately, we have read and spoke with many people who have stated that they have been in the same situation as us where ************ has taken their money and they never saw him again or only done partial jobs. All we want is for our deposit to be returned to us since there was no work done on behalf of ******* and he just took our deposit and ghosted us.

    On June 17, 2021 we paid Re-lived construction 50% down to start work which was $23,257.84. On September 9th they still hadnt started working on our deck/cement so I started calling and texting. On October 6th the concrete was done so he wanted the next 25% which was $6000.00 more. We paid it the next day with a check. On October. On October 19th I told him about a hole in the concrete and was asking about them cleaning up because we have a big concrete pile on our grass and concrete splatter all over the house. He assured me they would clean it up. On October 19th he told me he didnt know when they would be back because trex decking was behind on orders. I let it go for a few months because it was a cold ***** winter but on April 3rd 2022 I started texting him again. I told him about 2 large cracks in the concrete. On April 5th he said he would get me on the schedule. On May 16th I texted him pictures of the hole in the cement, the concrete on the house and grass and the cracks in the concrete. I also told him it wasnt level because melting snow/rain water was coming into our garage. He blamed the water leaking into our garage on the door but it didnt do that with our old concrete. May 26th ************************************************** My husband tried calling and leaving a message from his phone and I have tried texting numerous times asking for him to give me a date as to when he is coming to work on my stuff. He wont give me a date. He usually ignores my texts unless I seem to upset him then he responds rudely back. I have ask numerous times for them to come clean up and to fix the concrete and to give me a refund if they dont want to finish what they started. He got very upset when I said I was going to have to get a lawyer. I dont want to get a lawyer I just dont know what to do. I just want what I paid for. That was on May 26 2022. On July 6th I told him to please reply when he was coming and I still havent heard anything. I have all texts.

    First of all,  I have never gotten upset with the customer, said anything rude,  or anything of that nature.  I have told the customer several times that we are busy and I would get back to them.  When they decide to call and call i cannot answer my phone 24/7 and our Regular Business hours are clearly hearable in our voice mail. We are open for regular business hours Monday Thru Friday, 8am-5pm.  before or after those hours you will always get a voicemail.   Also when you call and immediately threaten a business with a lawyer,  99% of them will stop having any contact with you and inform you to contact there attorney.   Threatening a business or a consumer with any action like that will not get you anywhere. Business for everyone these last 2 years has been unbelievably busy and stressful.  The issue is, when we let you know that we will get you on our schedule as soon as we can,  that means we recieved your valid request and we will put you on our schedule.  Just because you call somewhere and they say they have material in,  doesnt mean its the same supplier we use.  We dont purchase our material locally from *********** Lowes, BMC, Sunpro, etc.  Our material comes out of Salt Lake.  

     Also as you know when we Completed our "Estimate" with you, that is just an Estimate of the Cost of goods at the time being.  Material costs for Composite Decking is still Extremely High, as most people know. Also other materials are still raised in price as well.  As I have told you probably 3 or 4 times, we will get back over, as it sits right now, we have the material to frame the deck and stairs but we dont have the material yet to deck it.  If you wanna choose a different color then grey, perhaps in a grey tone then we can get that alot sooner the grey.

    I am rejecting this response because: I just want some kind of communication. If I was told from the beginning that this was going to be a very long process I would have been much more understanding. I dont care what color my deck is. I just want a deck. I am very worried because the concrete that was put down has a hole and cracks in it. I dont want the deck to collapse because of this. When I am told that Im on the schedule but I cant get a date how do I know when and if you are ever coming back to finish? I know that you have other customers but its been over 9 months since I gave you $6000 for the second installment and you havent been back to clean up the mess or fix the bad concrete or do anything on the deck. Just communicate and let me know whats going. Thank you
