      Complaint: 22577152

I am rejecting this response because:
Here is the reply to ****** **********.

Pictures of Driscoll Roofing work are below.
Lets get some of the untruths out of the way which were described by ****** **********.

1: Driscoll roofing broke the agreement on the contract by not completing the work by October 18, 2024,
this is a 'breach of contract', plus the quality of the work was inferior.
There was 'No Inclement weather' Mr. ********* refers to, all week the weather was perfect,
that's a fact, nor did anyone call me about their delay.

They showed up to start the work on October 19 only when I called their office, asking where are they.
They never completed (there version) of the work until October 22nd then left the property without fixing what I requested.
The work was to be completed by October 18, 2024 as signed in the contract.

2: I have no idea if the people that worked at my home were employees, subcontractors, legal or Illegal,
there is no proof either way.
I asked for a Mechanics Lien agreement from Driscoll Roofing to not have a Lien put on my house
       and never received one.
This can be taken up at a later time if legal action is not dropped by Driscoll roofing.

3: Driscoll Roofing made zero attempts to resolve this matter, that is pure fiction that they even tried.
Resolving an issue is fixing the problems you created and making an attempt to satisfy the homeowner,
none of that was ever done.
***** Driscoll showed up on my property with his Father inspecting the back of the house after I called the office to complain about the work performed.
The only attempt to fix any of the problems, **** Driscoll suggested painting the * Flashing a color to match the house so the eyesore that is 1 inch that's supposed to be 3/8 of an inch, doesn't stand out.
      None of it was done.
They refused to fix any of their work and left the property.

      4. The siding around the window was part of the contract, its exactly why my wife and myself
called Driscoll Roofing to come here, there was no other reason, the * Flashing was work I later added.
My wife was in the family room, the door was opened and heard me discussing the work with ***** Driscoll
to be done around the Bay window.
I asked him if it was a problem for him to get rough sawn cedar sheeting to replace the current siding
      and he said no.
This is referenced in the contract as 'replacing the wood including the Bay Window'.

      5. The homeowner was never seeking additional work as Mr. ********** stated, that is mythical,
the homeowner wanted the contractor to come clean up the incorrect * Flashing
that was installed at 1 inch, which according to the * Flashing experts say its suppose to be 3/8 inch and there is no variance (see exhibit below).
So, there was no additional work to be done.

On 11/14/2024 I took a check to the office of Driscoll roofing, as payment in full, just to end this, so I could
move onto another contractor to fix the problems.
They refused the payment of the check, and I was called the next day by **** Driscoll told to come to the office.
The next day I returned again to pay off the balance, they again refused, now they wanted me to sign
some release agreement about the work they performed.

When Driscoll Roofing installed the flashing, they couldn't get it high enough to make the gap 3/8 of an inch so they left it as is.
Below is the email from ** products stating 3/8 inches should be used for the flashing not the 1-inch Driscoll installed.
So there's proof the * Flashing was installed improperly.
The * Flashing needs to be installed properly and fit in with the siding as to not be an eyesore, which it is.
I told the workers here to fix the problem as soon as I saw it.
***** Driscoll stated the reason the * Flashing was not moved up was because they didn't want to damage the siding
which they did, see pictures below.

      In conclusion:
This is a mediation process where you have to give something to get something.

Here is what ****** ********** is willing to provide to end this, so I can move onto a contractor to fix the problems
      described above.

1.Provide a check for the balance, which I've offered twice already and Driscoll Roofing signs the contract                    paid in full.
2.****** ********** will retract or update any complaint against Driscoll Roofing stating I am satisfied with the            resolution provided by the business.

Here is what Driscoll Roofing needs to provide:

1.A signed document stating Driscoll Roofing will not peruse any legal action now or in the future against Robert            **********.

Hopefully these issues can be resolved, the next step is a Contract Litigation Attorney if these issues are not resolved.

      Respectfully
      ****** Pisaneschi

Subject: Guidance on * Flashing Installation
      Dear ******,
Thank you for reaching out with your question about using  * flashing for your project.
To ensure proper installation and durability, we recommend maintaining a 3/8" gap between the rough sawn cedar siding and the ** trim board. This gap allows for proper drainage and ventilation, which helps prevent moisture buildup and potential damage.
Ive included an installation diagram below to illustrate the recommended setup. If you have any additional questions or need further clarification, feel free to reply to this email.
Thank you for choosing ** products for your project!
      Best regards,
      ****
      =============================================================================
Here is your work, totally unacceptable, why wasnt the * trim pushed up to the top?
Why was the existing siding damaged all the way across the back of the house?
The old drip edge was chiseled off which caused the damage,  instead they should have used a rotary saw.
This is what a 1 inch gap looks like.
Here is my neighbors house next door, which was shown to ****** Driscoll before the contract
was even signed and I told him I wanted it to look like this.
This is what a 3/8 " gap looks like, you'll notice the appealing appearance
      of the drip edge.

      Sincerely,

****** **********er spend their time arguing with them.
