    we hired *****(rawlings construction) to re build our deck. when they began the rebuild they stated that the new boards looked warped..they went ahead and installed them..i told them i did not like the look and something was off..the employees stated that they just rolled with it to make it work.I told ***** that he needed to talk with *****..long story short. since he cut and installed them it was out of ***** hands..also the material was installed wrong and the warranty would not with hold. ***** and his team walked off the job in November of 2022. I texted him in December and he said he had not heard from *****. I knew that was a lie because i had been working with them and the Trex manufacturer up until the end of April 2023. I had to hirer another company to take off the boards that they installed and re do my deck. I had to work with ***** and Trex to get my deck done. I had to re buy more boards and supplies .and pay more for someone else to re do the deck. ***** did not do anything to make this right..i had to fight this myself. After the deck was done i reached out to ***** asking him to make this right, i told him in several emails what happened and what ***** and the trex manufacturer had to say(they all said he should have never cut and installed the material and that he installed it wrong) I have picutres of his install and how it looks now. He texted me back stating that he did not install wrong. He has stopped texting us and he or his company has not replied to any of the email.
    I'm sure left something out. I am willing to talk with you if you want to call for more details. Bottom line he did not complete the work, he did nothing to help us get the deck fixed. I had to work with *****/Trex to get anything and the fact that i had to buy/replace boards i had already bought and hire someone else to finish the deck right was not right and it has been very stressful. It cost us so much more then what his bid was. We do not want this to happen to anyone

    ***** ******** contacted me (***** ******** of Rawlings Construction) in summer of 2022 about providing an estimate for decking at her primary residence. A bid was provided to her on July 9, 2022 including labor and material.  Upon receiving it she wanted to know if there was any way possible that she could save some money on this project.  In order to satisfy her request; ***** and **** (homeowners), removed all existing decking and left existing headers and joists as to save money on their replacement. Additionally, to save costs, she ordered all the decking material (boards) herself directly from ****'s.  Rawlings Construction took no part in the ordering of this material.  

    Once the material arrived to her residence (jobsite), she notified me the material had arrived and she was ready for Rawlings Construction to install the decking boards.  The job began on November 15th 2022.  The crew showed up, and began to install the new decking that ***** and **** had ordered.  The install of the new decking went on for 2 1/2 days at which point ***** had been home for the majority of said project. Upon completion on the third day, ***** had come outside and claimed there was an issue with boards and they looked warped.  Her reaction was quite astounding as she claimed she felt nauseous, dizzy and seemed to be suffering from some type of medical condition. I offered her a chair to rest in as I was concerned for her physical well-being as she explained there was something wrong with the deck and that was making her feel ill.  She then claimed she wanted to contact ****'s to get a refund, because she was convinced the decking had imperfections.  

    At this point, she had asked that we no longer continue the install while she tried to contact ****'s to get the supposed "imperfections/defects" resolved/refunded.  I notified her that until I heard further from her we would stop work per her request.  

    It should be noted Rawlings Construction had not billed nor been paid any amount of money at this time for the labor performed to date.  Months had passed and ***** ******** made no contact with Rawlings Construction until late spring 2023.  At this point she was unable to get refunded anything from ****'s, because they found nothing wrong with the material.  This is when the false claims began that the decking was installed improperly--prompting her request for $2,500 to be paid by Rawlings Construction to her for the material (which was not defected nor installed improperly).  

    I (***** Rawlings) made several attempts to explain this to her, and let her know Rawlings Construction was not responsible for repayment of decking that had no flaws or installation issues.  She did not seem to be satisfied, at which point, there was nothing further Rawlings Construction could do.  She continued with threatening/harassing/defamation texts and emails.  

    It should be clearly noted that Rawlings Construction has not been paid ANY AMOUNT for work done for ***** and **** ********.  We removed and disposed of all her original decking that she had torn off at no charge to her.  We also, obtained a handrail that was not being utilized from a family member and installed for her per her request in an effort to save her money at no charge. 

    She claims she hired another company to complete a new deck for her; however, she had her son-in-law who is a carpenter come over and complete the deck to appear as if something had been changed.

    Additionally, Rawlings Construction had done a personal favor for her by transporting a john-boat to her residence as she did not have means to transport it--at no charge (which was completely unrelated to said project for hire).  These allegations are completely false and at this point quite harassing as well as the company is out the money in labor and payroll expense.  Rawlings Construction does have an attorney on retainer that we could further utilize to obtain payment if these false allegations continue.

    I have broken down Rawlings Construction reply by paragraphs.

    #1-As far ordering the material for our deck.  Yes I did order the material, however ***** was involved in the process also. He was on the phone with myself and **** at the pro desk when we were placing the order and then ***** also stopped by ***** to confirm the order.

    #2-On the second day I ask one of *****’s employees (I think his name was *****) if he could tell me why the boards looked funny? (***** was not on site) He asked what did I mean..I said the boards did not look right.  He indicated that when they opened the boards up that there seemed to be some bowing at the ends of the boards and maybe warping. I asked why you would install the boards if something was wrong and why no one came to the door and talked to me about this.  His response was “we hoped it would work out” and “we just decided to roll with it”

    ***** is falsely accusing me of having a medical condition which is not true at all.  What he is referring to is what I said when I seen the deck ..i will quote what I said “ I said wow its like if you have vertigo..the boards are wavy like the ocean” I said I could not stand out there and I stepped back into the door. Not sure how you could think “I was suffering from a medical condition “. I was on the phone with ***** he was not at the house and he never offered me a chair, He came back out the next day and he was on his knees rubbing is hands over the boards saying you could see the wavy in the boards. At this time is when we called **** at *****-***** and I talked with **** on speaker phone about the boards.

    #4-This is false-(please see attached) statement. Attached is a text message I sent ***** on December 18, 2022 one month after they stopped work on my deck. I was checking in with him since I had not heard from him. I gave him the update from *****. He claimed he had been working with ***** and that they needed more pictures. ***** had no idea that I been working closely with ***** and the management team..they said they had not talked or seen *****. Even with me giving this up date to ***** he did nothing until I reached out again this spring.

    It is not false claims about being installed improperly.  Here is the name of the Trex rep that inspected and concluded that indeed the deck boards were installed improperly..*** *******. If you need his contact information I can provide that.

    #5-This statement is also false.  I tried several times to ask you to talk about this so that we could settle this matter. I told you I had information to back this.

    #6-The Rawlings Construction did remove a load the first day but it most definitely was not all of the old decking..we had to remove it. And you most definitely did not install the railing(you can see in the attached pictures) the company that I had to hire installed all railing. The company HC Remodeling.

    #7-I most definitely hired another company HC Remodeling (see attached invoice)

    Also see attached letter from my son-in-law. You falsely accused him of being a carpenter. He is NOT he is a painter.

    #8As far as you transporting the railing and the paddle boat-we told you we could pick up you offered several times and said it was not a problem to bring over. And later you stated that you add the cost into our bill.
