    I booked a session on 7/16/22 for $80. My session was for 7/21/22. I had to cancel since I wasnt able to make it in. They didnt want to reimburse me so they asked for another time to reschedule. I was forced to choose a date so I chose to reschedule for 7/27/22. My client messaged me at 1am saying he wasnt able to make the session due to his family being involved in a horrible car pile up on ******************* 7/26/22. I asked for a refund or a voucher code and they are fighting to not pay me back making up excuses. I work at a body shop, and have had people cancel dropping off their cars and wed refund them til theyre next available date to drop off a car. This is unprofessional, times are rough and $80 is a lot for me right now. *** never had an issue with them until the new owner came in. I feel they are taking advantage of me because of my age. They also allow smoking weed and drinking alcohol in there, which I believe is illegal, especially with people under 21 booking sessions there.

    These claims are completely without merit. In our policy, which ****************** had agreed to (as highlighted in attachment), there are NO REFUNDS FOR CANCELLATIONS. 

    The reason for this policy is because we are a small business, and when someone books a room it is then blocked off from other customers being able to use, and hence an opportunity cost for us. Things do happen, which is why we have the accommodation of rescheduling the session, where your deposit can still go towards that rescheduled session date. Still an opportunity cost on our part, but one we think is fair. 

    Professionals in our industry understand you have to require deposits from clients, or else these things will happen. As unfortunate as the incident that ****************** claims happened is, if he had requested a deposit from his client when the session was booked he would not be eating the $80 cost. 

    As far as the accusations of ageism go, they could not be more absurd, especially taking into consideration that the majority of both our clientele and staff fall between the ages of *****, without any previous complaints. This particular accusation really speaks to the desperation of ********************** case. All I can really say is that ****************** should thoroughly read and understand all of the terms he is agreeing to before agreeing to them. We made specific accommodations for ********************** needs of rescheduling, and when we finally wouldn't bend our policy to his demands, he took to the BBB to slander us, plain and simple.

    In regards to the final of his scurrilous accusations, in our agreement, which every client must agree to before booking, no illegal activity is allowed in the rooms being rented, a policy we are strict on.

    I am rejecting this response, due to a false narrative painted of me. I myself run a small autobody business with my family.  If  my clients were to want a refund (usually $600-$5000) we will be more than gladly to reimburse their payments, whether we are in the wrong or not. I understand the opportunity cost that was involved, and I wish to clarify that in no way, shape or form was I intending to slander them. I just simply wanted my $80 reimbursed due to it being a security deposit. Correct me if Im wrong, but a security deposit shouldnt be touched until after services are performed, in any field of practice. Again I understand they are a small business and $80 is a lot for them, but its also a lot for me during these times as well. My small business is slow as well

    Under their same policy, that states their business does not allow refunds, you will also see the smoking policy which states: 
    ABSOLUTELY NO SMOKING FROM 3am - 7pm. We are a weed-friendlv studio. However. we have neighbors so we have a
    ABSOLUTELY NO CIGARETTE/CIGAR SMOKING IN THE BUILDING.
    There are ventilation systems installed in both studio's B & C. YOU MUST TURN THESE ON TO SMOKE. Failure to do this
    will result in a minimum fine of $25.
    Smoking must take place STRICTLY in the studio control/main room. NO SMOKING IN BOOTH. NO SMOKING IN
    HALLWAYS. If you smoke in booth, automatic cleaning fee of $100 will be issued & is subject to ban.
    Ash into trash cans or ashtravs if avalable. -allure to do this will resut in a minimum tine of s25.

    If Im not mistaken the state law says smoking of any sort is not allowed in any business open to public whether the building is a private residency or public. I believe the legal smoking age is 21 as well. The law also states the the owner would be fined no less than $250 for the first offense, no less than $500 for the second violation, and no less than $2,500 afterwards. 

    All I was asking was to be reimbursed my $80.

    To address the original complaint & reason for the BBB's involvement in this dispute, I've attached 4 documents as evidence to ********************** agreement to our policies.

    1: The physical signature and driver's license of ****************** which was taken at his freelance engineering orientation. 

    2: The copy of the updated rental agreement which is hyperlinked to the booking form ****************** filled out when purchasing studio time. 

    3: The copy of the booking form filled out by ****************** for his session, which further agreed to our refund/cancelation policies.

    4: Text thread screenshot (from ********************** original complaint attachments) which gives a cancelation notice of 7 hours before his session start time. 

    When ****************** first had his orientation to use our facilities, he signed a contract agreeing to our business polices, and rental agreement. As highlighted in the agreement attached, ****************** acknowledged both in signing the contract, and agreeing in the online booking form, that he understood & agreed that he would not receive a refund of any kind. In addition, ****************** agreed that any rescheduling would be need to be done 24 hours prior to his session start at the latest. This was also conveyed to ****************** via text threads, as uploaded in his initial complaint.
