    My family purchased a home from Armstrong builders in March 2023. At that time, we agreed with Armstrong, and our Sales Contract stated, that our basement would be "finished out in like kind fashion" to a nearby Armstrong home. That home included a laundry hookup in its basement.

    At closing, Armstrong had not installed a laundry hookup in our basement. We expressed that the laundry hookup was a priority at our one-year walkthrough, and a representative of Armstrong agreed to install the laundry hookup. Armstrong repeatedly scheduled and rescheduled the date of the laundry hookup installation, but conflicts with other homes prevented Armstrong from completing it. We were happy to move the date of installation as long as the laundry hookup was eventually installed.

    By January 2025, the basement laundry hookup had not been installed, but Armstrong indicated that it would be handled the following week. To avoid further rescheduling, we suggested that either (A) we get a quote for the laundry hookup and Armstrong reimburse us for the cost of installation or (B) Armstrong estimate the cost of installation and simply provide us with reasonable payment up front. At that point, a senior representative of Armstrong informed my wife and I that Armstrong would neither install the laundry hookup nor provide us with money to do so. His stated justification was based upon a creative and generous reading of the Sales Contract which insisted that the "basement" was distinct from the adjacent "mechanical room." He argued that the project was already complete despite our repeated plans to install the laundry hookup.

    I offered two responsive objections to Armstrong. First, the plain reading of the Sales Contract ignores any distinction between the main basement area and the mechanical room within the basement. Second, Armstrong waived its ability to dispute the installation altogether after repeated attempts at scheduling.

    I would like payment covering the cost of installation.
